Book excerpt: In order of priority, the recommendations address the following: • urgent renewal of the Agreement on Internal Trade, with provisions that would replicate some of the key characteristics of the country's international trade agreements; 1 The Standing Senate Committee on Banking, Trade and Commerce • a potential reference to the Supreme Court of Canada; and • other federal actions that would contri [...] The committee is strongly of the view that the AIT's dispute-resolution mechanism is ineffective, and feels that the mechanisms in other trade agreements - including the North American Free Trade Agreement, the Canada-European Union Comprehensive Economic and Trade 6 The Standing Senate Committee on Banking, Trade and Commerce Agreement and the New West Partnership Trade Agreement - should be cons [...] To that end, section 121 of the Constitution Act, 1867 prohibits explicit barriers to trade and commerce between the provinces, stating: "All Articles of the Growth, Produce or Manufacture of any one of the Provinces shall, from and after the Union, be admitted free into each of the other Provinces." At the same time, the committee is aware that Canadian federalism - in respect of which the divisi [...] Given that the deadline for a renewed AIT has passed, and that the Committee on Internal Trade has not announced a new deadline, the committee believes that the federal government has a responsibility to plan, not only for the implementation of a renewed AIT, but also for the possibility that a renewed agreement may not be reached in a timely manner or may be inadequate. [...] The committee is strongly of the view that now is the time - in fact, the time is overdue - for the federal government to focus on tearing down the walls that inhibit internal trade.

Estimates suggest that complete liberalization of internal trade in goods can increase GDP per capita by about 4 percent and reallocate employment towards provinces that experience large productivity gains from trade. The positive impact highlights the need for federal, provincial and territorial governments to work together to reduce internal trade barriers. There is significant scope to build on the new Canadian Free Trade Agreement to more explicitly identify key trade restrictions, resolve differences, and agree on cooperative solutions.

Trade and Commerce fills this gap by bringing to light a lost understanding of how the Constitution structures economic relations. As Malcolm Lavoie reveals, the Constitution includes foundational commitments to property rights, local government autonomy, and the principle of subsidiarity. At the same time, it creates a platform for integrated national markets with secure channels for interprovincial trade. This economic vision remains a vital part of Canada’s constitutional order and is relevant to a purposive interpretation of the Constitution. But contemporary legal discourse has begun to lose touch with this vision, with regrettable consequences in a number of different policy areas. A strong United States economy, expansionary fiscal and monetary policy, and stable oil prices are expected to lift real GDP growth to 2.5 percent in 2017 and 1.9 percent in 2018. Residential construction is expected to expand at a more moderate pace, reflecting tighter macroprudential measures.
