Book Gender and Feminist Theory in Law and Society

Download or read book Gender and Feminist Theory in Law and Society written by Madhavi Sunder and published by Routledge. This book was released on 2017-11-30 with total page 534 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume chronicles a quarter-century of feminist theorizations on equality and liberty. The essays demonstrate a continuing commitment to feminist method (a democratic notion that all people have a right to participate in the production of knowledge of the world, including legal knowledge) and manifest feminism's continuing critical tradition (namely, theorists' willingness to see multiple factors, including feminism itself, as obstructing enlightened constructions of the world). Taken together, the essays suggest that liberty to make the world is not just a means to an end - equality - but is a substantive end in itself.

Book Feminist Perspectives on Criminal Law

Download or read book Feminist Perspectives on Criminal Law written by Lois Bibbings and published by Routledge. This book was released on 2013-03-04 with total page 554 pages. Available in PDF, EPUB and Kindle. Book excerpt: Criminal law has traditionally been taught and analysed as if the gender of criminals and their victims is irrelevant. It has also been taught and analysed as if criminal law doctrine has no connection with questions of criminalisation, crime detection, decisions to charge and prosecute, lawyers trial tactics, decisions as to guilt and sentencing policy and practice, all of which are significantly affected by gender. This book seeks to fill these gaps by looking at the major areas in which gender affects the way that suspected criminals and their victims are treated by the criminal justice system. However, this book is not just a supplement to traditional criminal law discourse. It is a dangerous supplement, in that the focus on gender challenges laws claim to neutrality and even-handed justice. The essays in this book establish that, not only does the law frequently fail to offer women the sort of protection from male violence and sexual invasion that they need, but it continues to discriminate on grounds of gender. Even when discriminating in favour of women, it does so in ways that reinforce dangerous gender stereotypes. More specifically, both criminal law doctrine and criminal justice personnel apply and reinforce ideas, on the one hand, of female passivity, irrationality and proneness to illness, and, on the other, of natural male aggression - both physical and sexual.

Book excerpt: To mark the 2000 Annual Conference of the Society of Public Teachers of Law,the Society has organised a distinguished team of contributors to write a set of reflective and critical essays on the future of law in the United Kingdom, considering how it will or should develop over a wide range of areas. The essays are concerned not only with all the main branches of the law but also with socio-legal studies, legal education and legal practice. In most of these areas the essays are written by two contributors so that the dialogue between them adds perception to their forecasts, taking account of past experience of developing the law via judicial activism or statutory reform processes and also of the European dimension. This reflection upon the possible future milestones of UK law will provide stimulating and illuminating reading for all lawyers, whether academics or practitioners. Book At the Boundaries of Law RLE Feminist Theory

Download or read book At the Boundaries of Law RLE Feminist Theory written by Martha Albertson Fineman and published by Routledge. This book was released on 2013-05-20 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: Feminists have recently begun to challenge the powerful influence of the law on the social and cultural construction of women’s roles, identities, and rights. At the Boundaries of Law is a timely and path-breaking work that provides a series of non-technical, interdisciplinary explorations into the nature and effects of legal regulation on women’s lives. Together the essays examine the fertile – and radically revisionary – links between feminism and legal theory. But At the Boundaries of Law rejects the abstract ‘grand theorizing’ of traditional feminist legal theory, focusing instead on the concrete and material implications of the legal injustices endured by women. These essays emphasise the complex diversity of female experience, collectively arguing for legal theory and practice that both recognises and accommodates the concept of ‘difference’ – in gender, class, race and sexual orientation. At the Boundaries of Law also raises provocative questions about the methodology and future of feminist legal theory itself. In its rich variety of issues and approaches, this volume will command the interest not only of legal theorists, but of those interested in women’s studies, philosophy, politics, sociology and history. It is sure to set the future agenda for scholars, policymakers and anyone concerned with the role of law in society.

Book Nancy Fraser Social Justice and Education

Download or read book Nancy Fraser Social Justice and Education written by Carol Vincent and published by Routledge. This book was released on 2020-05-21 with total page 239 pages. Available in PDF, EPUB and Kindle. Book excerpt: The American scholar and activist Nancy Fraser has written about a wide range of issues in social and political theory, and is well-known for her philosophical perspectives on democratic theory and on feminist theory. Her work on justice and identity politics has been particularly widely cited, and she has also been active in developing a ‘feminism for the 99%’. Although education has not been a direct focus for much of her work, her thinking has been widely disseminated within the critical study of education. This volume illustrates the way in which education researchers have taken up and developed Fraser’s theories in the areas of alternative education, higher education, inclusion and disability, and the effects of neoliberalism upon public (state) education, as they ask how social justice within the education system can be enhanced. These insightful essays cover a range of countries and topics, as the authors work with Fraser’s concepts, to argue for the development of a more equitable education system. The chapters in this book were originally published as articles in Taylor and Francis journals.

Book Feminist Perspectives on Law Law Schools and Law Reform

Download or read book Feminist Perspectives on Law Law Schools and Law Reform written by Kathy Bowrey and published by . This book was released on 2021 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Emerita Professor Jill McKeough is a pioneer of Australian intellectual property scholarship and teaching, former Head of School and Dean, Chair of the Council of Australian Law Deans and law reform commissioner. This volume considers Jill's career in light of the politics of legal education, university management, law reform and university research assessment. Each of the chapters discusses particular career achievements, hurdles faced and critical reflections on her legacy. Gender themes addressed include: agency and opportunity; approaches to management and leadership; valuing labour and contribution; authority in public life; and understanding research impact. Today only about 4% of festschrifts touch on women's careers. This festschrift includes consideration of the underbelly of women's success in a university. Successful careers do not magically unfold. Nor are they accidents. In exploring how one 'gets on with it' and what can be achieved given the chance, it is hoped that this collection can help to seed more ideas about what is possible and to keep bringing about necessary change. -- Provided by publisher.
