Available in PDF, EPUB and Kindle. Book excerpt: This dissertation analyzes the effectiveness of tax and expenditure limits. I contend that these limits are frequently implemented unfaithfully. Further, the politics of circumvention used to evade these limits causes unintended secondary and tertiary effects. To understand the policy implementation process, I apply principal-agent theory. The first chapter of my dissertation analyzes the effectiveness of tax and expenditure limits empirically. I pay close attention to pitfalls of time-series, cross-sectional data. Specifically, I account for violations of Guass-Markov caused by serial correlation or heteroskedasticity. I employ flexible TEL indicators to test for temporary and heterogeneous effects of the limits. In the second chapter I leverage two conditions previously shown to produce successful delegation to agents from the principal-agent literature. I apply each condition to the case of tax and expenditure limits and test whether or not limits are more effective when these conditions are met. My results show that tax and expenditure limits are more successfully when implemented by agents that share ideological convictions for cutting the size of government. I also present suggestive evidence that making limits easier to monitor makes them more effective. My third chapter focuses on the secondary and tertiary consequences of tax and expenditure limits. Specifically, I present evidence that property tax limits have detrimental effects on state and local revenues during recessions. Property tax limits cause states to rely on income-elastic revenue sources which cause greater revenue declines during economic downturns. Finally, my fourth chapter is a case study of Massachusetts' 1980 Property Tax Limit, Proposition 2 1/2. This initiative limits municipal property taxes to growth by 2.5% per year. In this chapter I look at the formula used to calculate the limit, highlighting how changes to this formula over time have made the limit less effective. I also analyze the extent to which revenue substitution, such as increases in state aid and charges and the extent to which revenue substitution, such as increases in state aid and charges and fees, can be attributed to the property tax limit.

Book Tax and Expenditure Limitations

Download or read book Tax and Expenditure Limitations written by Jerome G. Rose and published by Rutgers Univ Center for Urban. This book was released on 1982-01 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: Tax and Expenditure Limitations contains fourteen essays, most of which were based on papers presented at a symposium sponsored by the American Law Institute-American Bar Association (ALI-ABA). The symposium was organized and chaired by the late Donald Hagman, Professor of Law, U.C.L.A. School of Law. Professor Rose has assembled and edited the papers presented at that symposium and has added several others to provide a thorough analysis of the varied types of tax and expenditure limitations (TELs) adopted in the 1970s. New Jersey adopted its spending limitation, known as the "Cap" law, in 1976. Other states including California, Texas and Massachusetts, among others, followed suit in the next few years. Professor Rose has selected the programs of the above states for a comparative analysis of the effect of these laws on metropolitan growth, the delivery of government services, and the changed relationships among federal, state and local governments. Professor Hagman describes the California Propositions 13 and 4 in two essays. Professor Robert Freilich describes the effect of TELs on growth, housing and development mix. Professor Bruce Kramer analyzes the Texas TELs. Professor Ernest Reoch, Director of the Rutgers Bureau of Government Research, analyzes the effect of TELs on the New Jersey school budget. Other contributors include Professor Andrew Reschovsky, Betsy Strauss, George Peterson and Edith Netter, among others. Professor Rose has included three of his own essays in the collection. His introductory article provides an overview exploration of the programs and an analysis of some of the problems raised by them. His second article describes the New Jersey "Cap" law and the third article offers some speculations on the effect of the "Cap" law on land use in New Jersey.
