At a time of unprecedented partisanship and high-profile breaches of legislative norms in the modern Congress, the relationship between norms and the functioning of the institution is a growing and pressing concern. Despite the importance of the topic, recent scholarship has not focused on congressional norms. Meanwhile, previous research leaves open many relevant questions about the role of norms in the Congress of the twenty-first century. A Social Theory of Congress brings norms back in to the study of Congress by defining what are legislative norms, identifying which norms currently exist in the U.S. Congress, and examining the effects that congressional norms have. This book provides a new research approach to study congressional norms through a comprehensive review of previous scholarship and a combination of interviews, survey research, and analysis of member behavior. What’s more, an innovative theoretical framework — a social theory of Congress — provides new perspectives in the study of legislatures and political behavior. The findings are striking. Norms of cooperation are surprisingly alive and well in an otherwise partisan Congress. But norms of conflict are on the rise. In addition, norms of a changing culture are affecting how members understand their role as lawmakers and in their interactions among one another. Together, these findings suggest that norms play an important role in the functioning of the legislature and as norms evolve so too does the performance of Congress in American democracy.

She herself had done little or nothing to bring about her present state. Now she is quite mad. Claudius, too, could never have guessed where he would end. Yet the rest of us, although not significantly more knowing than they, profess to think we can actually make Me decisions which genuinely good reasons will support.Experience seems to have convinced us that, deficient in self-knowledge though we may be, sometimes the arrow of decision reaches its mark. Kadish examines how decisions hi the conduct of our lives are possible, how they may be justified, and what the limits of that justification might be for a self that defines itself in a context of social change. Although the need for self-justification tends to be regarded as a weakness, this book suggests that it may also be regarded as the inevitable outcome of the desire to make justifiable decisions, those for which on reflection one can approve oneself.The prime problem of the conduct of life, according to Kadish, is to say when one can and when one cannot justify oneself for one's conduct not to others but to oneself. He proposes that through self judgment individuals develop that very self-interest in virtue of which they endeavor to choose one course of action rather than another. He proposes also that they justify and form themselves through their self-identification as members of communities in conflict and in process of transformation. From this difficult social and human condition the basic problems of ethical and social theory, together with the possibility of a theory of good reasons, are held to arise.In the present time of discontent and emphasis on change hi social, economic, and political life, The Ophelia Paradox has a particular pertinence to the prospects for resolving the basic issues of conduct. It should be of interest to philosophers, sociologists, and psychologists, and of special relevance to anyone concerned with the interrelationships of ethics, art, and law.

In Conflict and Compliance, Sonia Cardenas examines responses to such pressure and challenges conventional views of the reasons states do--or do not--comply with international law. Data from disparate bodies of research suggest that more pressure to comply with human rights standards is not necessarily more effective and that international policies are more efficient when they target the root causes of state oppression. Cardenas surveys a broad array of evidence to support these conclusions, including Latin American cases that incorporate recent important declassified materials, a statistical analysis of all the countries in the world, and a set of secondary cases from Eastern Europe, South Africa, China, and Cuba. The approach is seen as a useful tool to explain human behaviour and actively initiate behavioural changes. This paper sheds light on the social norms approach from a different perspective, namely from the perspective of Non-Violent Communication (NVC). First, the social norms theory (SNT) is presented, referring to the larger framework of the theory and then to the study “The Constructive, Deconstructive and Reconstructive Power of Social Norms” of Wesley Schultz and his colleagues. In chapter 3, the basic assumptions and principles of NVC after Marshall Rosenberg are contoured. In chapter 4, the assumptions of SNT also drawing on the study of Schultz and his colleagues are examined from the perspective of NCV. The conclusion summarizes the findings and points towards implications for ethical culture.
