Book Switzerland and the International Protection of Refugees La Suisse et la protection internationale des refugi s

Download or read book Switzerland and the International Protection of Refugees La Suisse et la protection internationale des refugi s written by Vera Gowlland-Debbas and published by BRILL. This book was released on 2021-10-18 with total page 293 pages. Available in PDF, EPUB and Kindle. Book excerpt: The present volume highlights the new challenges of the international protection of refugees fifty years after the adoption of the 1951 Geneva Convention relating to the Status of Refugees. Focusing on the problems faced by Switzerland in the field of international protection of refugees as well as on the specificity of its asylum law and practice, this publication addresses the refugee problem from a national, European and international perspective. The Swiss experience serves to illustrate the wider problematic of on the one hand, the tensions between security, political and humanitarian concerns encountered by refugee-receiving states, and on the other, the need to preserve an international refugee protection regime which remains an essential component of international law and relations for so long as political solutions are not brought to the root causes of refugee exodus. This reflection on the international protection of refugees is organized around four main themes. The first examines Switzerland's response in the past to mass influx, in the light of historical case studies and the evolution of Swiss asylum law and practice. The second focuses on the question of access of refugees to asylum territories and refugee status determination procedures within the framework of the 1951 Convention on the Status of Refugees and the current Swiss asylum law. The third centres on the wider protection regime currently being forged in Europe to address a broader category of refugees, including solutions for temporary and subsidiary protection. The final theme revolves around return of refugees, including those under the Dayton and recent Kosovo agreements and covers reintegration of returnees, assistance and long-term development. This work is based on papers presented at a colloquium of the Graduate Institute of the International Studies in Geneva which was organised in collaboration with the Office of the United Nations High Commissioner for Refugees as a contribution to the 50th anniversaries of the UNHCR and the Geneva Convention relating to the Status of Refugees.

Book Internally Displaced Persons and International Refugee Law

Download or read book Internally Displaced Persons and International Refugee Law written by Bríd Ní Ghráinne and published by Oxford University Press. This book was released on 2022-03-15 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: Internally Displaced Persons (IDPs) are persons who have been forced to leave their places of residence as a result of armed conflict, violence, human rights violations, or natural or human-made disasters, but who have not crossed an international border. There are about 55 million IDPs in the world today, outnumbering refugees by roughly 2:1. Although IDPs and refugees have similar wants, needs and fears, IDPs have traditionally been seen as a domestic issue, and the international legal and institutional framework of IDP protection is still in its relative infancy. This book explores to what extent the protection of IDPs complements or conflicts with international refugee law. Three questions form the core of the book's analysis: What is the legal and normative relationship between IDPs and refugees? To what extent is an individual's real risk of internal displacement in their country of origin relevant to the qualification and cessation of refugee status? And to what extent is the availability of IDP protection measures an alternative to asylum? It argues that the IDP protection framework does not, as a matter of law, undermine refugee protection. The availability of protection within a country of origin cannot be a substitute for granting refugee status unless it constitutes effective protection from persecution and there is no real risk of refoulement. The book concludes by identifying current and future challenges in the relationship between IDPs and refugees, illustrating the overall impact and importance of the findings of the research, and setting out questions for future research.

This book was released on 2017 with total page 29 pages. Available in PDF, EPUB and Kindle. Book excerpt: Abstract: The December 2018 Global Compact on Refugees reaffirmed the international community's commitment to refugee protection - yet willingness to accept refugees is in decline globally. No progress has been seen in the search for viable modes of responsibility-sharing. With the exception of Germany, all the main host countries are middle-income or developing countries. In a situation where more people are forced to leave their homes than are able to return every year, the more affluent countries must shoulder more responsibility. That would mean pledging more resettlement places and increasing public and private funding to relieve the poorer host countries. Aid organisations regularly find themselves faced with funding shortfalls. As the second-largest donor of humanitarian and development funding, Germany should campaign internationally to expand the available financial resources and improve the efficiency of their use. None of the new funding ideas will master the multitude of deman
