A complainant centred standpoint is developed to counteract the marginalization of the interests of victims, which is held to demonstrate that the drive for effective and efficient law enforcement has overshadowed the public interest in holding officers to account for misconduct. After officer accountability before the criminal courts diminished in the nineteenth century, missed opportunities to reform complaints procedures following commissions of inquiry in 1906-08, 1928 and 1960-62 are discussed. The second volume of the study, Combating Impunity: Complaints Against Metropolitan Police, 1964-2021, will examine the part played by complainants and civil society organisations in combating police impunity in the citizen oversight era.

The impending new Police Bill, the Scarman report and the pressure from many sides for an independent complaints machinery hinged on this issue, and a careful review of the problem was badly needed. The Cobden Trust commissioned Tony Jefferson and Roger Grimshaw to research into the matter, and Controlling the Constable, originally published in 1984, is the result of their findings. The authors examine closely the concept of constabulary independence at the time. They look at the relevant legal history and at how this independence was used by chief constables from day to day. On this basis, they then re-assess two of the most controversial policing operations of modern times – Brixton prior to the 1981 Riots and Southall on 23 April 1979, a day which resulted in hundreds of arrests and the death of Blair Peach. They conclude that the concept embodies a fundamental incoherence: the reliance on the law to guide the chief constable, and the failure of the law to do so. They show that all the current proposals for reform, which entailed greater emphasis on the democratic system as a guide, could result in similar incoherence. A new approach to the conflict between legal authority and democratic authority was urgently needed. Controlling the Constable points the way to the only satisfactory resolution – and this included a concept of justice which was coherent and which could serve as a real guide for the chief constable in using his discretion. The book was controversial, but quite clear on one point: however independent any new complaints procedure may become, and however much committees were ‘consulted’ by chief constables via ‘Scarman-type’ liaison committees, until the problem was tackled on this fundamental level, there could be no significant change in police behaviour.

The Empire Strikes Back examines the place of 'race' and racism in the political transformation of Britain at the end of the seventies, and argues that Britain has entered a longterm political and economic crisis which has brought new urgency to the politics of race and nation. The authors explore the elements of a new, culturally focused racism which, in representations of black families, stresses their alienness and the supposed criminal inclinations of the black population. They argue that the British state is very far from its popular image as a liberal democracy, and that all our notions of culture, nation and class are based on deeply racist structures. Key areas of state intervention such as schooling, policing and policy-oriented 'race relations' research are analysed to demonstrate that a definition of the growing crisis in the economy and social services is emerging, which shifts the focus of blame on to black people. The authors argue that existing race relations theory has significantly failed to deal adequately with the British situation. In particular, the experience of black women and the political organization of young black people raises major problems for race-blind feminism and Eurocentric Marxism alike. In conclusion, the book assesses the political relation of race to class, and suggests that any long-term struggle against racism must begin by recognizing the autonomy of black struggles at all levels of British society.

Subsequent two chapters locate the core problem in considering police independence within the legal domain, and the role and political orientations of the three intrapolice organizations in reinforcing the development of autonomy. Chapter 7 demonstrates that different forms of relationship have historically characterized the relations between police institutions and the different social classes. The last two chapters present evidence on consent, and draws the themes of autonomy and consent together by focusing on the role of the chief police officer, positioned at the nexus between structural demands and organizational restraints, in continually negotiating definitions and practices of police work.
