Available in PDF, EPUB and Kindle. Book excerpt: From Kennebunkport to Kauai, from the Rio Grande to the Northern Rockies, ours is a vast republic. While we may be united under one Constitution, separate and distinct states remain, each with its own constitution and culture. Geographic idiosyncrasies add more than just local character. Regional understandings of law and justice have shaped and reshaped our nation throughout history. America’s Constitution, our founding and unifying document, looks slightly different in California than it does in Kansas. In The Law of the Land, renowned legal scholar Akhil Reed Amar illustrates how geography, federalism, and regionalism have influenced some of the biggest questions in American constitutional law. Writing about Illinois, “the land of Lincoln,” Amar shows how our sixteenth president’s ideas about secession were influenced by his Midwestern upbringing and outlook. All of today’s Supreme Court justices, Amar notes, learned their law in the Northeast, and New Yorkers of various sorts dominate the judiciary as never before. The curious Bush v. Gore decision, Amar insists, must be assessed with careful attention to Florida law and the Florida Constitution. The second amendment appears in a particularly interesting light, he argues, when viewed from the perspective of Rocky Mountain cowboys and cowgirls. Propelled by Amar’s distinctively smart, lucid, and engaging prose, these essays allow general readers to see the historical roots of, and contemporary solutions to, many important constitutional questions. The Law of the Land illuminates our nation’s history and politics, and shows how America’s various local parts fit together to form a grand federal framework.

Book excerpt: Land Use and Society is a unique and compelling exploration of interactions among law, geography, history, and culture and their joint influence on the evolution of land use and urban form in the United States. Originally published in 1996, this completely revised, expanded, and updated edition retains the strengths of the earlier version while introducing a host of new topics and insights on the twenty-first century metropolis. This new edition of Land Use and Society devotes greater attention to urban land use and related social issues with two new chapters tracing American city and metropolitan change over the twentieth century. More emphasis is given to social justice and the environmental movement and their respective roles in shaping land use and policy in recent decades. This edition of Land Use and Society by Rutherford H. Platt is updated to reflect the 2000 Census, the most recent Supreme Court decisions, and various topics of current interest such as affordable housing, protecting urban water supplies, urban biodiversity, and "ecological cities." It also includes an updated conclusion that summarizes some positive and negative outcomes of urban land policies to date.

This book was released on 2018-03-08 with total page 86 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Short Lectures Explanatory of Our Land Laws Necessity of some knowledge of the history of the land laws - Manner of holding land in England before the Conquest - Effect of the Conquest on the holding of land - Introduction of the Feudal System - Fundamental principle of the land laws - Tenure - History and description of tenures - Different classes of estates: Freeholds Copyholds - Leases for terms of years - Varieties of freehold estates fh-estate for life. The law relating to the land of this country cannot be rightly understood without some previous know ledge of its history. It is not alone that its subtle theories, fine distinctions, restrictions, forms, and terminology cannot be made clear without some refer ence to their origin; but the law itself is very ancient, many of its rules having come down to us from the days when the foundations of our jurisprudence were laid. Some of the commonest every-day dealings with land derive their validity from Acts of the Parliaments of Edward I. And decisions of the Judges of Edward IV., while the modern changes in the law have touched the ancient system so lightly that an acquaintance with it is necessary before the very changes can be understood. Book The Special Land Tenure Bill of 1911

Download or read book The Special Land Tenure Bill of 1911 written by Herbert Wheatley Knocker and published by Forgotten Books. This book was released on 2017-12-19 with total page 48 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Special Land Tenure Bill of 1911: A Critical Analysis As it appeared to our Executive that if the Bill became Law the delimitation of Gavelkind lands would be of no practical value, Mr. Knocker was requested to prepare a Critical Analysis of the Bill itself. This he has been good enough to do at very short notice, and our Fellows and Associates are urged to favour the Society, through me, with their views upon the policy of the proposed measure. It has, of course, been impossible for Mr. Knocker - in the limited time and space at his disposal - to discuss all the results of such a measure, but he undoubtedly shows that they cannot prove so simple or so innocuous as those responsible for the introduction of the Bill possibly anticipate. Surprise, not unmixed with contempt, has frequently been expressed by our Colonists and by our American cousins at the complicated state of our Land Laws and at the piecemeal legislation essayed to bring them into line with modern ideas and requirements. Indeed, many of our own countrymen have passed severe strictures upon the apathy of successive Govern ments in that direction. Book Land Law and Policy in Israel

Download or read book Land Law and Policy in Israel written by Haim Sandberg and published by Indiana University Press. This book was released on 2022-07-05 with total page 268 pages. Available in PDF, EPUB and Kindle. Book excerpt: As one of the smallest and most densely populated countries in the world, the State of Israel faces serious land policy challenges and has a national identity laced with enormous internal contradictions. In Land Law and Policy in Israel, Haim Sandberg contends that if you really want to know the identity of a state, learn its land law and land policies. Sandberg argues that Israel's identity can best be understood by deciphering the code that lies in the Hebrew secret of Israeli dry land law. According to Sandberg, by examining the complex facets of property law and land policy, one finds a unique prism for comprehending Israel's most pronounced identity problems. Land Law and Policy in Israel explores how Israel's modern land system tries to bridge the gaps between past heritage and present needs, nationalization and privatization, bureaucracy and innovation, Jewish majority and non-Jewish minority, legislative creativity and judicial activism. The regulation of property and the determination of land usage have been the consequences of explicit choices made in the context of competing and evolving concepts of national identity. Land Law and Policy in Israel will prove to be a must-read not only for anyone interested in Israel but also for anyone who wants to understand the importance of land law in a nation's life.
