Book Founding Republics in France and America

Download or read book Founding Republics in France and America written by John Anthony Rohr and published by . This book was released on 1995 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: Recalling Tocqueville's exhortation for the French to "look to America" for a better understanding of their own government, John Rohr returns the favor by revealing how much we can learn about American constitutionalism from a close study of French governance. The French and American republics both emerged from the same revolutionary era and share a common commitment to separation of powers, rule of law, and republicanism. Even so, the two constitutional traditions are quite different. France, after all, has replaced its constitution at least thirteen times since 1789, while the American constitution has endured essentially intact. Yet, as Rohr shows, French constitutionalism merits our careful attention. Focusing upon the founding of the French Fifth Republic and the drafting of its constitution, Rohr compares the nations' divergent approaches to executive, legislative, and judicial power; independent administrative authority and discretion; and the relation of administrative law to statutory law. His analysis of France's divided versus our unified executive, the two presidents' exceptional powers, and their influence on the legislative process provides particularly fresh insights into how the two constitutional traditions promote and inhibit the capacity for administrative action. Rohr shows that French administrative institutions are much more thoroughly developed than their American counterparts due to recurrent presidential and constitutional crises. Without such a strong public administration, daily life in France would likely be extremely unstable if not quite chaotic. The proper role of the French institutions, he suggests, is largely determined by their relationship to elected officials whereas their American counterparts are essentially shaped by the constitutional order. A model for future comparative work in constitutional law and public administration, Rohr's study should help us see that the constitutional path we've pursued wasn't the only possibility—and why we've chosen that route nevertheless. As such, it should have great appeal for students, teachers, and practitioners in U.S. and French law, politics, and public administration.

Book Australia s Constitution after Whitlam

Download or read book Australia s Constitution after Whitlam written by Brendan Lim and published by Cambridge University Press. This book was released on 2017-04-06 with total page 303 pages. Available in PDF, EPUB and Kindle. Book excerpt: Australia's constitutional crisis of 1975 was not simply about the precise powers of the Senate or the Governor-General. It was about competing accounts of how to legitimate informal constitutional change. For Prime Minister Gough Whitlam, and the parliamentary tradition that he invoked, national elections sufficiently legitimated even the most constitutionally transformative of his goals. For his opponents, and a more complex tradition of popular sovereignty, more decisive evidence was required of the consent of the people themselves. This book traces the emergence of this fundamental constitutional debate and chronicles its subsequent iterations in sometimes surprising institutional configurations: the politics of judicial appointment in the Murphy Affair; the evolution of judicial review in the Mason Court; and the difficulties Australian republicanism faced in the Howard Referendum. Though the patterns of institutional engagement have varied, the persistent question of how to legitimate informal constitutional change continues to shape Australia's constitution after Whitlam.

Book Regional Integration in East Asia

Download or read book Regional Integration in East Asia written by Satoshi Amako and published by UN. This book was released on 2013 with total page 392 pages. Available in PDF, EPUB and Kindle. Book excerpt: Asian regional integration, which has shown remarkable progress since the end of the 1990s, is at a major crossroads. It faces confusion of and debate over the direction and effectiveness of integration as well as friction brought about by the rise of China. Meanwhile, the changing balance of power among nations, the rise of nonstate actors, the internationalization of internal problems, and the internalization of international problems are rendering the cross-national structure of Asia increasingly complex and multilayered. Signs of instability of the global economy are growing, and environmental and resource challenges are deepening. East Asia needs new approaches to understanding the state of regional integration and mechanisms to address the challenges. Regional Integration in East Asia is the culmination of five years of intensive research on Asian regional integration by Waseda University. It reexamines theoretical approaches to comprehending the actual state of integration in the region and presents the most compelling ones. It also examines the state of cooperation in Asia in areas ranging from the economy to energy and the environment, security, and education. In addition, the book offers long-term historical perspectives, including those of Japan, ASEAN, and China on Asian regional integration. Thus, it sheds light on diverse aspects, levels of analysis, and time spans and offers a comprehensive portrayal of the actual condition of Asia and the state of attempts to build regional cooperation and institutions. This volume will open a new research frontier in Asian regional integration research.
