Discrimination against LGBTI individuals is also supported by such laws and policies as the 2008 Pornography Law. UNHCR is concerned about the potential impact this could have on LGBTI refugees and asylum-seekers in the country.

Book excerpt: The Convention Relating to the Status of Refugees adopted on 28 July 1951 in Geneva continues to provide the most comprehensive codification of the rights of refugees yet attempted. Consolidating previous international instruments relating to refugees, the 1951 Convention with its 1967 Protocol marks a cornerstone in the development of international refugee law. At present, there are 149 States Parties to one or both of these instruments, expressing a worldwide consensus on the definition of the term refugee and the fundamental rights to be granted to refugees. These facts demonstrate and underline the extraordinary significance of these instruments as the indispensable legal basis of international refugee law. This Commentary provides for a systematic and comprehensive analysis of the 1951 Convention and the 1967 Protocol on an article-by-article basis, exposing the interrelationship between the different articles and discussing the latest developments in international refugee law. In addition, several thematic contributions analyse questions of international refugee law which are of general significance, such as regional developments, the interrelationship between refugee law and general human rights law, as well as the relationship between refugee law and the law of the sea.

La metodología incluye un diseño de investigación documental comparativo y la evaluación de estudio de casos. Esto incluye una evaluación de varios casos que analizan el papel de las instituciones internacionales y su interacción con los derechos humanos. Intentar encontrar patrones comunes en diferentes estructuras y procesos nos da alguna indicación, una imagen del tipo de problemas que estas instituciones enfrentan actualmente. Los casos estudiados en esta investigación revelan una serie de desafíos que enfrentan dichas instituciones que van desde el fortalecimiento de aspectos organizacionales y estratégicos hasta, en general, el fortalecimiento de la capacidad institucional. Sin embargo, el principal desafío encontrado es el desarrollo de la reflexividad institucional intencional. Esto implica la adopción, por parte de las instituciones internacionales, de una nueva orientación hacia principios y valores. La promoción de este nuevo enfoque debe comenzar con una reestructuración completa a nivel mundial.

The analysis focuses specifically on the main countries of asylum within the Association of Southeast Asian Nations that are not parties to the 1951 Refugee Convention, namely Thailand, Malaysia and Indonesia. Using an international law perspective based on the doctrine of the ‘two elements’ (practice and opinio juris), the author argues that these states have long recognized that people fleeing persecution, armed conflict and generalized violence, namely refugees, should be protected. This in turn demonstrates that they recognize the existence and relevance of the international refugee regime despite their refusal to accede to the Refugee Convention. Offering a different perspective on the links between international refugee law and refugee protection in Southeast Asia, this book will be of interest to researchers and practitioners in the fields of international relations, international refugee law, international human rights law, migration governance and Southeast Asian Studies.
