Book excerpt: This book provides a thorough introduction to Roman property law by means of "cases," consisting of brief excerpts from Roman juristic sources in the original Latin with accompanying English translations. The cases are selected and grouped so as to provide an overview of each topic and an orderly exposition of its parts. To each case is attached a set of questions that invite the reader to, e.g., clarify ambiguities in the jurist's argument, reconcile one holding with another, supply missing but necessary facts to account for the holding, and/or engage in other analytical activities. The casebook also illustrates the survival and adaptation of elements of Roman property law in the modern European civil codes, especially the three most influential of those codes: the General Civil Code of Austria (Allgemeines Bürgerliches Gesetzbuch), the German Civil Code (Bürgerliches Gesetzbuch), and the Civil Code of Switzerland (Zivilgesetzbuch). All code excerpts are accompanied by English translations. By comparing and contrasting how the codes have adopted, adapted, or rejected an underlying Roman rule or concept, it is possible for the reader to observe the dynamic character and continuing life of the Roman legal tradition. To facilitate comparison with corresponding rules and concepts in the English common law tradition, additional texts and questions prepared by the translator will be mounted on an accompanying website, www.oup.com/us/romanpropertylaw.

Book excerpt: Marriage in the Western Church examines how marriage acquired a specifically Christian identity in the Western Church from the patristic through Carolingian periods. It shows how theologians came to regard marriage as an ecclesiastical institution and how they developed a Christian theology of marriage. The first part of the book deals with marriage and divorce in Roman and Germanic law. Other parts deal with marriage and divorce in ecclesiastical law, with the Latin Fathers' distinction between the divine and human laws of marriage, and with the customary stages by which persons became married. Several chapters are devoted to Augustine's views on marriage and sexuality. The author shows how the doctrine of indissolubility became the West's chief means of christianizing marriage, and how theologians found here their preferred arguments for affirming the holiness and the 'sacramentality' of marriage. The author argues that the Western regime of indissolubility was the product of a fourth century reform movement. Doctrine is examined in Jewish, Islamic, Roman, common and civil laws. Investigating such diverse legal systems and doctrines at the intersection of laws governing bank deposits, obligations, the assignment of debts, and negotiable instruments, the author identifies the common denominator for the evolving legal principles and speculates on possible reciprocity. At the same time he challenges the idea of 'law merchant' as a mercantile creation. The book provides an account of the evolution of payment law as a distinct cohesive body of legal doctrine applicable to funds transfers. It shows how principles of law developed in tandem with the evolution of banking and in response to changing circumstances and proposes a redefinition of 'law merchant'. The author points to deposit banking and emerging technologies as embodying a great potential for future non-cash payment system growth. However, he recommends caution in predicting both the future of deposit banking and the overall impact of technology. At the same time he expresses confidence in the durability of legal doctrine to continue to evolve and accommodate future payment system developments.

This is a tour de force of scholarship and historical anthropology. The author's argument may be controversial, but few can fail to be fascinated by the evidence she marshals to support it.

The modern image of immoral Rome derives from ancient accounts which are largely critical rather than celebratory. Upper-class Romans habitually accused one another of the most lurid sexual and sumptuary improprieties. Historians and moralists lamented the vices of their contemporaries and mourned for the virtues of a vanished age. Far from being empty commonplaces these assertions constituted a powerful discourse through which Romans negotiated conflicts and tensions in their social and political order. This study proceeds by a detailed examination of a wide range of ancient texts (all of which are translated) exploring the dynamics of their rhetoric, as well as the ends to which they were deployed. Roman moralising discourse, the author suggests, may be seen as especially concerned with the articulation of anxieties about gender, social status and political power. Individual chapters focus on adultery, effeminacy, the immorality of the Roman theatre, luxurious buildings and the dangers of pleasure. This book should appeal to students and scholars of classical literature and ancient history. It will also attract anthropologists and social and cultural historians.

Book excerpt: In this ground-breaking analysis of the world's first private banks, Edward Cohen convincingly demonstrates the existence and functioning of a market economy in ancient Athens while revising our understanding of the society itself. Challenging the "primitivistic" view, in which bankers are merely pawnbrokers and money-changers, Cohen reveals that fourth-century Athenian bankers pursued sophisticated transactions. These dealings--although technologically far removed from modern procedures--were in financial essence identical with the lending and deposit-taking that separate true "banks" from other businesses. He further explores how the Athenian banks facilitated tax and creditor avoidance among the wealthy, and how women and slaves played important roles in these family businesses--thereby gaining legal rights entirely unexpected in a society supposedly dominated by an elite of male citizens. Special emphasis is placed on the reflection of Athenian cognitive patterns in financial practices. Cohen shows how transactions were affected by the complementary opposites embedded in the very structure of Athenian language and thought. In turn, his analysis offers great insight into daily Athenian reality and cultural organization.
