Book excerpt: Defining Canada's Place in the World and the Government's Overall Approach to Defence As a point of departure, the government needed to set out the broad foreign and national security policy context within which it was positioning Canada and its defence policy, and this was clearly not contemplated in the process it followed in the defence policy review. [...] Analysis of the Global and Regional Strategic Outlook Minister Freeland's speech also contained a remarkably candid and pragmatic summary of the government's analysis of the global and regional strategic outlook for Canada and this provided good context for the new defence policy. [...] These missions are clearly defined in terms of size and nature, so for the first time since the end of the Cold War National Defence has reasonably hard metrics around the capabilities it is required by the government to establish and maintain. [...] While the timeline for release of it was likely delayed to allow for discussions with the new US leadership, and some modest adjustments could certainly have been made as a result of them, the main thrusts of the new defence policy can't have been changed radically in the few months available. [...] Defining the Defence Capabilities to be Acquired, Maintained or Divested With the sound defence strategy foundations set out in the policy, it is not surprising that Strong, Secure, Engaged is similarly solid in its articulation of the defence capabilities the Canadian Armed Forces are required to establish and maintain.

In “Strong, Secure and Engaged,” the Government of Canada called on the Canadian Armed Forces (CAF) to adopt a more assertive cyber posture. To implement this policy, the CAF will have to rely heavily on Canada's civilian signals intelligence agency, the Communications Security Establishment (CSE). Under the proposed Bill C-59: An Act Respecting National Security Matters, CSE's responsibilities will be expanded to include the provision of technical and operational assistance to CAF and the Department of National Defence, and a mandate to engage in defensive and active cyber operations. This paper assesses the international legal implications arising from CSE's expanded mandate and the risks of relying on civilians to engage in offensive operations in an armed conflict. Looking to our five eyes partners for guidance, the paper also makes a series of policy proposals to minimize the risks to Canadian security and international relations arising from those implications.
