Book excerpt: Excerpt from Street Work Laws of the State of California The street laws peculiar to the state of California are those statutory enactments which provide for improvements upon existing streets - streets opened or dedicated to public use; also, those enactments which provide for the opening, widening, extending or closing up of streets, in whole or in part. To many these street laws are terra incognita. They, are sui generis, covering a special territory by themselves quite outside of the common and ordinary domain of the general and usual practice. Heretofore these laws have constituted a branch of the practice so specialized that it has been explored by but few members of the profession; nevertheless, it is one of the most important branches in the whole wide range of jurisprudence. Municipal corporations are little more than public improvement corporations on a large scale; and, as the present tendency seems to be in the direction of a still further centralization of power in the municipalities of the country, with the investiture of still greater powers over public improvement in the municipal authorities, confiding to their care the conduct of many enterprises which have heretofore usually been in the hands of private individuals, it follows that any branch of the law which deals with the exercise of these powers is of great and growing importance, both to the profession and the laity. Cities and towns are rapidly springing up in this empire commonwealth, and streets are as rapidly being opened up and improved. Hence the necessity for some book which shall facilitate the researches of those whose business it is to study these street laws and assist in their administration. With this end in view the author has prepared this book for publication, and will feel himself amply repaid for his labors if he has succeeded in bringing together between the covers of one book such material upon the subject of the street laws of this state as will serve to simplify the subject and render a comprehensive knowledge thereof easy of attainment. Book excerpt: Excerpt from The General Street Law of California: With Annotations The Resolution of Intention requires more precision and care than any other proceeding of the municipal legislature. From it alone is jurisdiction derived. If it is fatally defective, all subsequent proceedings, however regular in form, are without jurisdiction, and are absolutely void. The precision required in it does not, however, extend to such amplification of detail as is needed in the Specifications, whether general-or special. These specifications must be adopted before the order of work. It is safer to have them precede the Resolution of Iuten tion also, but that is not absolutely necessary. Yet, however general may be the work named in the resolution of intention, the limits or points between which work is to be done must be clearly fixed from the outset. For instance: It may be sufficient to declare an in tention to Construct culverts and crosswalks in intervening crossings, and afterwards, in the order of work, specify how many crosswalks and culverts shall be constructed in each of the crossings. Each crossing may have a peculiar requirement. Whatever these may be they must be specified by the City Council as its own conclusion. Nothing must be left subject to variation or the discretion of any city official or the contractor. The Council is supposed to be acting always under the advice of the Engineer or Street Superintendent, and thereafter neither odi cial has the power to make changes. N 0 such phrase as where necessary can be allowed to creep into any street resolution of the Council. Those two fatal words haveinvalidated street assessments in the city of San Francisco alone to the amount of more than half 8. Mil lion of dollars. But the decisions are that the words where not already done are sufh ciently certain to support a contract. In some cases attempts have been made to change these grades without following the course Of procedure set forth in the Statutes, with the result that Contractors have refused to enter con tracts for street work, on the advice of their attorneys, on the sole ground that the grades of the streets proposed to be im proved had not been legally established. This has necessitated the abandonment of the street proceedings and the institution of proper establishment of grades, with a resultant delay of many months in the performance of the work. For this reasonwe have included the Change of Grade Act of 1909, which has proven most satisfactory for this purpose.
