Available in PDF, EPUB and Kindle. Book excerpt: Multi-owned properties make up an ever-increasing proportion of commercial, tourist and residential development, in both urban and rural landscapes around the world. This book critically analyses the legal, social and economic complexities of strata or community title schemes. At a time when countries such as Australia and the United States turn ever larger areas into strata title/condominiums and community title/homeowner associations, this book shows how governments, the judiciary and citizens need to better understand the ramifications of these private communities. Whilst most strata title analysis has been technical, focusing on specific sections of legislation, this book provides higher level analysis, discussing the wider economic, social and political implications of Australia’s strata and community title law. In particular, the book argues that private by-laws, however desirable to initial parties, are often economically inefficient and socially regressive when enforced against an ever-changing group of owners. The book will be of particular interest to scholars and legal practitioners of property law in Australia, but as the Australian strata title model has formed the basis for legislation in many countries, the book draws out lessons and analysis that will be of use to those studying privately-owned communities across the world.

This book was released on 2016-09-22 with total page 347 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Boundaries of Australian Property Law offers a unique perspective on real property law in Australia. As the overwhelming majority of land interests in Australia now fall under the Torrens title system, this book's particular focus on the development and operation of the Torrens system in Australia is both timely and welcome. Addressing the prescribed Priestly 11 requirements for a property law subject in Australia, this informative and academically rigorous book includes carefully selected statutory material and case law from all Australian jurisdictions, as well as the United Kingdom. The general law system is also discussed and referred to where necessary, to give context and depth to the analysis of real property law. Written by prominent real property law academics from law schools around Australia, and edited by Hossein Esmaeili and Brendan Grigg, this text is a modern and much-needed addition to real property law literature.

Download or read book Even As We Breathe written by Annette Saunooke Clapsaddle and published by University Press of Kentucky. This book was released on 2020-09-08 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: Nineteen-year-old Cowney Sequoyah yearns to escape his hometown of Cherokee, North Carolina, in the heart of the Smoky Mountains. When a summer job at Asheville's luxurious Grove Park Inn and Resort brings him one step closer to escaping the hills that both cradle and suffocate him, he sees it as an opportunity. With World War II raging in Europe, the inn is the temporary home of Axis diplomats and their families, who are being held as prisoners of war. Soon, Cowney's refuge becomes a cage when the daughter of one of the residents goes missing and he finds himself accused of abduction and murder. Even As We Breathe invokes the elements of bone, blood, and flesh as Cowney navigates difficult social, cultural, and ethnic divides. After leaving the seclusion of the Cherokee reservation, he is able to explore a future free from the consequences of his family's choices and to construct a new worldview, for a time. However, prejudice and persecution in the white world of the resort eventually compel Cowney to free himself from larger forces that hold him back as he struggles to unearth evidence of his innocence and clear his name.

Download or read book Condominium Governance and Law in Global Urban Context written by Randy K. Lippert and published by Routledge. This book was released on 2021-02-09 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines condominium, property, governance, and law in international and conceptual perspective and reveals this urban realm as complex and mutating. Condominiums are proliferating the world over and transforming the socio-spatial organization of cities and residential life. The collection assembles arguably the most prominent scholars in the world currently working in this broad area and situated in multiple disciplines, including legal and socio-legal studies, political science, public administration, and sociology. Their analyses span condominium governance and law on five continents and in nine countries: the United States (US), China, Australia, the United Kingdom (UK), Canada, South Africa, Israel, Denmark, and Spain. Neglected issues and emerging trends related to condominium governance and law in cities from Tel Aviv to Chicago to Melbourne are discerned and analysed. The book pursues fresh empirical inquiries and cogent conceptual engagements regarding how condominiums are governed through law and other means. It includes accounts of a wide range of governance difficulties including chronic anti-social owner behaviour, short-term rentals, and even the COVID-19 pandemic, and how they are being dealt with. By uncovering crucial cross-national commonalities, the book reveals the global urban context of condominium governance and law as empirically rich and conceptually fruitful. The book will appeal to researchers and students in socio-legal studies, law, sociology, political science, urban studies, and public administration as well as journalists, social activists, policymakers, and condo owners/board members.
