It presents a human rights-based assessment of the various modes of state–religion identification and of the various forms of state practice that surround and characterize these different state–religion models. A close assessment of norms of human rights law substantiates that, although human rights law on the face of it is seemingly neutral to the issue of state–religion identification, legal principles can be extrapolated that have a profound bearing on the question of legitimacy of the possible diverse relationships that may exist between the state and religion. A range of thematic case studies on, among other issues, Establishment of Religion & the ‘Equal Religious Rights of Others’, Religion & Freedom of Expression, Religion & Political Rights, Religion & Educational Rights, Religion & Freedom of Association and Religion & Equal Employment Opportunities, demonstrates that existing regimes of positive state identification with religion are not devoid of forms of institutionalised discrimination and de facto practices of discrimination on grounds of religion or belief (or lack thereof). At the same time, it is observed by the author that in some secular or separationist states the ideals of state secularism and separationism have come to be considered ends in themselves. This has given rise to situations where the principles of secularism and separationism are construed so as to impose illegitimate limits on the activities of religions or illegitimate limits on the individual manifestation of certain beliefs. This book makes a case for the recognition of a state duty to remain impartial with respect to religion or belief in all regards so as to comply with people’s fundamental right to be governed, at all times, in a religiously neutral manner.

Book excerpt: Freedom of religion or belief implies that people have the right to embrace a full range of thoughts and beliefs, including those that others might deem blasphemous; freedom of expression implies that they have the right to speak or write about them publicly. These rights are guaranteed in international documents to which most countries have agreed. Chapter 1 examines and compares the content of laws prohibiting blasphemy ("blasphemy laws") worldwide through the lens of international and human rights law principles. The right to practice your religion freely is one of the cornerstone freedoms we have in the United States. Freedom of religion is in the very first amendment of the Bill of Rights in the Constitution. Other countries take a narrower view of freedom of religion. Some impose an official religion, while others actively persecute those practicing a disfavoured religion. Chapter 2 reports on the levels of religious freedom in different countries. The International Religious Freedom Act of 1998, requires the president to issue annually an International Religious Freedom Report and designate the worst violators as Countries of Particular Concern CPC a country so designated when its government has engaged in or tolerated particularly severe violations of religious freedom. Chapter 3 discusses the efforts of the United States to combat religious freedom violations in Eurasia. The gravity of the situation facing religious freedom in Central Asia is of particular concern. Despite the professed desire to enact more permissive regulations on religious life, the arguments opposing far-reaching reforms are cast in terms of national security and regime stability. The terms of this argument are familiar in Central Asia, not to mention in other parts of the Muslim world, where Islam simultaneously occupied a revered position in national, social, and private life, while also preoccupying national security agencies and regime loyalists who fear its potential to catalyse political opposition and terrorism as reported in chapter 4.

Relying on a new source of coded data for nearly 200 countries and case studies of six countries, the book offers a global profile of religious freedom and religious persecution. Grim and Finke report that persecution is evident in all regions and is standard fare for many. They also find that religious freedoms are routinely denied and that government and the society at large serve to restrict these freedoms. They conclude that the price of freedom denied is high indeed.

Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. Book excerpt: “Long live the red terror!” This and other political slogans were used by China’s communist rulers as leverage for conflict and conflict management during 1949. China’s Cultural Revolution movement understandably fueled anger, fear, and terror among Chinese citizens. Currently, contrary to the positive façade that China, under the control of the Communist Chinese Party (CCP), tries to project regarding human rights, a dark reality reveals a brutal authoritarian state with no concern for religious freedom. What guiding philosophy could best help procure, provide, and protect religious freedom for all in a post-communist, Christianized, democratic China? Bob Fu argues that while various Christianity-oriented theories may appear promising, they fail to provide an adequate pluralistic foundation for protecting the religious freedoms of people of all faiths and none. The predominant theory of political liberalism in the West likewise fails to prove sufficiently inclusive for all faiths and worldviews. As an alternative, the author defends Baorong Duoyuan (inclusive pluralism), his own contextualized theory modeled after principled pluralism. This model, he believes, has the potential to help ensure that religious freedom for all becomes a reality.
