Book Complications and Quandaries in the ICT Sector

Download or read book Complications and Quandaries in the ICT Sector written by Ashish Bharadwaj and published by Springer. This book was released on 2017-10-27 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is open access under a CC BY 4.0 license. With technology standards becoming increasingly common, particularly in the information and communications technology (ICT) sector, the complexities and contradictions at the interface of intellectual property law and competition law have emerged strongly. This book talks about how the regulatory agencies and courts in the United States, European Union and India are dealing with the rising allegations of anti-competitive behaviour by standard essential patent (SEP) holders. It also discusses the role of standards setting organizations / standards developing organizations (SSO/SDO) and the various players involved in implementing the standards that influence practices and internal dynamics in the ICT sector. This book includes discussions on fair, reasonable and non-discriminatory (FRAND) licensing terms and the complexities that arise when both licensors and licensees of SEPs differ on what they mean by “fair”, “reasonable” and “non-discriminatory” terms. It also addresses topics such as the appropriate royalty base, calculation of FRAND rates and concerns related to FRAND commitments and the role of Federal Trade Commission (FTC) in collaborative standard setting process. This book provides a wide range of valuable information and is a useful tool for graduate students, academics and researchers.

Book Intellectual Property Rights and Competition in Standard Setting

Download or read book Intellectual Property Rights and Competition in Standard Setting written by Valerio Torti and published by Routledge. This book was released on 2015-10-05 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: Competition and intellectual property rights (IPRs) are both necessary for a market to work efficiently and to promote consumer welfare. Properly applied, intellectual property rules define a legal framework which allows undertakings to profit from their inventions. This in turn encourages competition among firms and enhances dynamic efficiency, to the benefit of consumer welfare. Standard setting represents one of the fields where the interaction between competition law and IPRs clearly comes to light. The collaborative goal of standard setting organizations (SSOs) is to adopt and promote standards that either do not conflict with anyone’s right or, if they do, are developed under condition that patents are licensed under defined terms. This book examines the tension between IPRs and competition in the standard setting field which can arise when innovators over-exploit the rights they have been granted and hold up an entire industry. The book compares EU and U.S. jurisdictions with a particular focus on the IT and telecommunication sectors. It scrutinizes those practices which could harm standard setting and its goals, looking at misleading conducts by SSOs’ members which may lead to breach the EU and U.S. antitrust provisions on abuse of market power. Recent developments in EU and U.S. standard setting are analysed highlighting the differences in enforcement approaches. The book considers how the optimal balance between IPRs and industry standards can be struck, suggesting a policy model which takes into account both innovators’ interests and SSOs’ goals.

Book A Competitiveness Strategy for America

Download or read book A Competitiveness Strategy for America written by United States. Competitiveness Policy Council and published by . This book was released on 1993-01-01 with total page 61 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Competitiveness Policy Council (CPC) concludes that the United States continues to face major competitiveness problems despite recent increases in the growth of both the economy and national productivity. It proposes sweeping educational reform in three areas: developing content and performance standards; ensuring that schools have the flexibility, expertise, and resources to achieve the National Education Goals; and holding schools accountable for students' achievement. CPC's recommendations for training have four dimensions: lifetime learning, school-to-work transition, retraining for dislocated workers, and improvement of worker training programs. Industry should be promoted in the following ways: enacting an innovation and commercialization tax credit; redirecting government spending to civilian and dual-use research and development; expanding federal support for cooperative projects with private industry; monitoring by boards of directors of corporate performance; preparing by companies of periodic analyses of long-term performance; and expanding exports. Private investment should be encouraged through a permanent equipment tax credit, authorization of industry consortia for joint production, and more rapid depreciation allowances. Recommendations to improve the public infrastructure, especially the transportation system, have also been proposed. The CPC recommends that national saving be increased by raising private saving and reducing public spending. (Members' biographies and subcouncil member lists are appended.) (YLB)

Book Global Governance and China

Download or read book Global Governance and China written by Scott Kennedy and published by Routledge. This book was released on 2017-09-18 with total page 290 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume offers systematic analysis of China’s growing engagement in global governance institutions over the past three decades. During this period, China has gone from outsider to observer to insider. The volume is based on studies of Chinese involvement in a wide cross section of regimes, including trade, finance, intellectual property rights, foreign aid, and climate change. The contributions show that China’s participation in global governance reflects the mutually interactive processes of China’s own socialization into the global community and the simultaneous adaptation of global institutions and actors to China’s growing activism. Both China and the international system are internally complex. Hence, Chinese engagement varies across economic regimes, yielding different results in terms of Chinese compliance, its influence on regimes, and the extent of cooperation and conflict in addressing challenges in international society. The chapters reveal that China is neither purely a savior nor scofflaw of the global economic system, and while China is a defender of the status quo in some areas, it is a reformer in others, and occasionally a revisionist in still other spheres. A detailed analysis of many areas of global governance, this volume will be essential reading for students and scholars of international relations, Chinese studies and global governance.

This book was released on 1995-03-29 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: Mandated standards used for vehicle airbags, International Organization for Standards (ISO) standards adopted for photographic film, de facto standards for computer software--however they arise, standards play a fundamental role in the global marketplace. Standards, Conformity Assessment, and Trade provides a comprehensive, up-to-date analysis of the link between standards, product testing and certification, and U.S. economic performance. The book includes recommendations for streamlining standards development, increasing the efficiency of product testing and certification, and promoting the success of U.S. exports in world markets. The volume offers a critical examination of organizations involved in standards and identifies the urgent improvements needed in the U.S. system for conformity assessment, in which adherence to standards is assessed and certified. Among other key issues, the book explores the role of government regulation, laboratory accreditation, and the overlapping of multiple quality standards in product development and manufacturing. In one of the first treatments of this subject, Standards, Conformity Assessment, and Trade offers a unique and highly valuable analysis of the impact of standards and conformity assessment on global trade.

Available in PDF, EPUB and Kindle. Book excerpt: "The ongoing COVID-19 pandemic marks the most significant, singular global disruption since World War II, with health, economic, political, and security implications that will ripple for years to come." -Global Trends 2040 (2021) Global Trends 2040-A More Contested World (2021), released by the US National Intelligence Council, is the latest report in its series of reports starting in 1997 about megatrends and the world's future. This report, strongly influenced by the COVID-19 pandemic, paints a bleak picture of the future and describes a contested, fragmented and turbulent world. It specifically discusses the four main trends that will shape tomorrow's world: - Demographics-by 2040, 1.4 billion people will be added mostly in Africa and South Asia. - Economics-increased government debt and concentrated economic power will escalate problems for the poor and middleclass. - Climate-a hotter world will increase water, food, and health insecurity. - Technology-the emergence of new technologies could both solve and cause problems for human life. Students of trends, policymakers, entrepreneurs, academics, journalists and anyone eager for a glimpse into the next decades, will find this report, with colored graphs, essential reading.
