Book excerpt: This book provides an illuminating commentary of law reform in the early modern era (1500–1740) and views the moves to improve law and legal institutions in the context of changing political and governmental environments. Taking a fresh look at law reform over several centuries, it explores the efforts of the king and parliament, and the body of literature supporting law reform that emerged with the growth of print media, to assess the place of the well-known attempts of the revolutionary era in the context of earlier and later movements. Law reform is seen as a long term concern and a longer time frame is essential to understand the 1640–1660 reform measures. The book considers two law reform movements: the moderate movement which had a lengthy history and whose chief supporters were the governmental and parliamentary elites, and which focused on improving existing law and legal institutions, and the radical reform movement, which was concentrated in the revolutionary decades and which sought to overthrow the common law, the legal profession and the existing system of courts. Informed by attention to the institutional difficulties in completing legislation, this highlights the need to examine particular parliaments. Although lawyers have often been seen as the chief obstacles to law reform, this book emphasises their contributions – particularly their role in legislation and in reforming the corpus of legal materials – and highlights the previously ignored reform efforts of Lord Chancellors.

Reexamining psychiatric interventions from a cultural-historical and political-economic perspective, Szasz demonstrates that the main problem that faces mental health policy makers today is adult dependency. Millions of Americans, diagnosed as mentally ill, are drugged and confined by doctors for noncriminal conduct, go legally unpunished for the crimes they commit, and are supported by the state—not because they are sick, but because they are unproductive and unwanted. Obsessed with the twin beliefs that misbehavior is a medical disorder and that the duty of the state is to protect adults from themselves, we have replaced criminal-punitive sentences with civil-therapeutic 'programs.' The result is the relentless loss of individual liberty, erosion of personal responsibility, and destruction of the security of persons and property—symptoms of the transformation of a Constitutional Republic into a Therapeutic State, unconstrained by the rule of law. Szasz shows convincingly that not until we separate therapy from coercion—much as the founders separated theology from coercion—shall we be able to get a handle on our seemingly intractable psychiatric and social problems. No contemporary thinker has done more than Thomas Szasz to expose the myths and misconceptions surrounding insanity and the practice of psychiatry. In a diary entry for June 1812 Henry Crabb Robinson recorded the following conversation with the elderly Mrs. Buller: "She received me with a smile, and allowed me to touch her hand. 'What are you reading, Mr. Robinson?' she said. 'The wickedest cleverest book in the English language, if you chance to know it. ' - 'I have known the "Fable of the Bees" more than fifty years. ' She was right in her guess.

This apparently illogical system where debtors were kept away from their places of work remained popular with creditors into the nineteenth century even as Britain witnessed industrialisation, market growth, and the increasing sophistication of commerce, as the debtors’ prisons proved surprisingly effective. Due to insufficient early modern currency, almost every exchange was reliant upon the use of credit based upon personal reputation rather than defined collateral, making the lives of traders inherently precarious as they struggled to extract payments based on little more than promises. This book shows how traders turned to debtors’ prisons to give those promises defined consequences, the system functioning as a tool of coercive contract enforcement rather than oppression of the poor. Credit and Debt demonstrates for the first time the fundamental contribution of debt imprisonment to the early modern economy and reveals how traders made use of existing institutions to alleviate the instabilities of commerce in the context of unprecedented market growth. This book will be of interest to scholars and researchers in economic history and early modern British history.
