Book excerpt: The idea that European welfare states are struggling to meet new social risks during a process of adaptation to a post-industrial setting has been an acknowledged theory in welfare state research for some time. The authors of this remarkable book have chosen to study a powerful indicator of how this trend might affect legal protection and access to justice for individuals: reforms in social security systems as they apply to cases of reduced earnings capacity. While previously the notion of social protection made welfare state inhabitants feel that the risk of loss of income due to physical or psychological hindrances was minimal, this sense of security can no longer be taken for granted. This book presents in-depth analyses, by nine leading scholars in social security law, of recent reforms in the field of incapacity benefits in four European countries: Germany, the United Kingdom, the Netherlands, and Sweden. The authors emphasize how recent reforms in the field of social security have been transformed into legal provisions, how the gate-keeping function is implemented in the legislation of the different countries, and to what extent the reforms have affected the legal position of the individuals concerned. They find that ever-tightening requirements designed to reduce benefit dependency, in combination with policies emphasizing individual responsibilities rather than individual rights, cause increased social risks for exposed groups. Among the specific aspects covered are the following: Measuring the reduction of earnings capacity; rights and obligations attached to reintegration into the labour market; work capability assessment procedures; "rehabilitation chains" with fixed time limits; the real and increased risk of poverty faced by long-term incapacitated persons; constitutional concerns raised by increased dependency on means-tested benefits; conditionality of benefits on work-related activities, participation in training programmes, or active job searching; and sanctions that can be applied if the claimant fails to comply with activation measures. All the country chapters provide thorough surveys of recent reforms, as well as analyses of their different weaknesses and strengths. The European dimension is explored with particular reference to anti-discrimination legislation, health and safety law as well as the Open Method of Coordination. As a systematic analysis of the current reforms relating to reduced earnings capacity, this book will attract a wide readership among lawyers and policymakers for its thorough coverage of the current landscape and the far-reaching implications it suggests. The aim of this work is, first, to clarify the impact of the globalisation process on social security systems and, second, to formulate substantive and technical proposals for the adaptation of existing social security schemes to an altered socio-economic context and for the elaboration of international legal instruments aimed at an effective substantive and procedural protection of social security as a fundamental right.The report is divided into three parts. The first part is concerned with the social impact of globalisation and its consequences for social security systems in the high-income economies. The first article of this section considers the nature of globalisation as well as its social impact. It spells out some fundamental challenges facing social security systems. The following article elaborates further on one specific challenge, that is: the need for social security to adapt to the increased territorial mobility of workers.The second part looks at the effects of globalisation on social security in relation to middle- and low-income countries and examines the extent to which existing arrangements in these countries are able to provide adequate income protection to me majority of the population. For the group of middle-income countries, the relevance of globalisation for the privatisation of pension systems is analysed as well as the consequences with respect to their main social functions, i.e. the provision of old-age income security and income redistribution. This is done so through a comparative analysis of Latin American countries that have implemented pension policy reform. The following two articles consider the experience of social security systems in low-income countries. In the first article the impact and challenges of globalisation for existing formal and informal social security arrangements in low-income countries are explored and options are suggested for alternative approaches to social security provision that are better suited to the circumstances of low-income countries. The arguments have been illustrated with evidence from Cote d'Ivoire, a country with a socio-economic situation and social security framework that is typical for the majority of low-income countries. The second article discusses in greater depth the link between informal economic and social security in Sub-Saharan Africa.Finally, the third part calls for a global approach to social security. To this end, the first article in this section outlines a possible strategy for a generalised social protection at the global level based on the human damage theory while the last chapter of this work is concerned with the international legal instruments most appropriate for a better substantive and procedural protection of social security as a basic human right.

Citizens have seen their pensions, unemployment benefits, and general healthcare policies shrink as “belt tightening” measures are enforced. But in contrast, long-term care has seen a general growth in public financing, an expansion of beneficiaries, and, more generally, an attempt to define larger social responsibilities and related social rights. The aim of this book is to describe and interpret the changes introduced in long-term care policies in Western Europe. The volume argues that recent reforms have brought about an increasing convergence in LTC policies. Most of the new programs have developed a new general approach to long-term care, based on a better integration of social care and health care. The book explores increasing public support given to family care work (in the past, the family would take care of the elderly or infirm) and increasing growth and recognition of a extended social care market (by which care has shifted from a moral obligation based on family reciprocity to a paid, professional activity). A new social care arrangement has therefore been developing in Western countries, based on a new mix of family obligations, market provision, and public support. In order to understand such changes, this analysis will take into account the social and economical impact of these reforms.
