Book Smothering the Right to Strike

Download or read book Smothering the Right to Strike written by Shae McCrystal and published by . This book was released on 2008 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This article examines the recent changes to the federal legal regime that controls the taking of protected industrial action in Australia. It considers the impact of both the Building and Construction Industry Improvement Act 2005 (Cth) and the Workplace Relations Amendment (Work Choices) Act 2005 (Cth). The article provides an overview of the restrictions now faced by federal system employees and unions that wish to engage in protected industrial action. This includes the imposition of secret ballots, restrictions on the level and content of bargaining and the removal of the discretion of the Australian Industrial Relations Commission in decision making. The article concludes that the Work Choices changes represent the most fundamental attack on the right to strike in Australia since its introduction in 1993, smothering the ability of employees and trade unions to take strike action in support of free collective bargaining.

Book excerpt: This edited collection is the culmination of a comparative project on 'Voices at Work' funded by the Leverhulme Trust 2010 - 2013. The book aims to shed light on the problematic concept of worker 'voice' by tracking its evolution and its complex interactions with various forms of law. Contributors to the volume identify the scope for continuity of legal approaches to voice and the potential for change in a sample of industrialised English speaking common law countries, namely Australia, Canada, New Zealand, UK, and USA. These countries, facing broadly similar regulatory dilemmas, have often sought to borrow and adapt certain legal mechanisms from one another. The variance in the outcomes of any attempts at 'borrowing' seems to demonstrate that, despite apparent membership of a 'common law' family, there are significant differences between industrial systems and constitutional traditions, thereby casting doubt on the notion that there are definitive legal solutions which can be applied through transplantation. Instead, it seems worth studying the diverse possibilities for worker voice offered in divergent contexts, not only through traditional forms of labour law, but also such disciplines as competition law, human rights law, international law and public law. In this way, the comparative study highlights a rich multiplicity of institutions and locations of worker voice, configured in a variety of ways across the English-speaking common law world. This book comprises contributions from many leading scholars of labour law, politics and industrial relations drawn from across the jurisdictions, and is therefore an exceedingly comprehensive comparative study. It is addressed to academics, policymakers, legal practitioners, legislative drafters, trade unions and interest groups alike. Additionally, while offering a critique of existing laws, this book proposes alternative legal tools to promote engagement with a multitude of 'voices' at work and therefore foster the effective deployment of law in industrial relations.

Download or read book Human Rights at Work written by Colin Fenwick and published by Bloomsbury Publishing. This book was released on 2010-10-12 with total page 658 pages. Available in PDF, EPUB and Kindle. Book excerpt: Concerns associated with globalisation of markets, exacerbated by the 'credit crunch', have placed pressure on many nation states to make their labour markets more 'flexible'. In so doing, many states have sought to reduce labour standards and to diminish the influence of trade unions as the advocates of such standards. One response to this development, both nationally and internationally, has been to emphasise that workers' rights are fundamental human rights. This collection of essays examines whether this is an appropriate or effective strategy. The book begins by considering the translation of human rights discourse into labour standards, namely how theory might be put into practice. The remainder of the book tests hypotheses posited in the first chapter and is divided into three parts. The first part investigates, through a number of national case studies, how, in practice, workers' rights are treated as human rights in the domestic legal context. These ten chapters cover African, American, Asian, European, and Pacific countries. The second part consists of essays which analyse the operation of regional or international systems for human rights promotion, and their particular relevance to the treatment of workers' rights as human rights. The final part consists of chapters which explore regulatory alternatives to the traditional use of human rights law. The book concludes by considering the merits of various regulatory approaches.

Book Law Corporate Governance and Partnerships at Work

Download or read book Law Corporate Governance and Partnerships at Work written by Richard Mitchell and published by Routledge. This book was released on 2016-04-22 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines how businesses manage their labour systems, and particularly how they manage the complex interaction of factors which give rise to instances of 'partnership' style relations between businesses and their employees. The book draws from the literature concerning 'Varieties of Capitalism' (VoC) and the different institutional and regulatory designs inherent in different types of political economy. The book is informed by a new and extensive set of empirical data from Australia that examines the activities of national and multinational business corporations, their outlooks and relationships with stakeholders, and relates these to new and evolving theoretical frameworks based in political economy and law. The book places the Australian regulatory model within this international debate, and assesses the extent to which the system does or does not fit into the general categorisation created in the VoC literature.

Book excerpt: The most successful film franchise of all time, Star Wars thrillingly depicts an epic multigenerational conflict fought a long time ago in a galaxy far, far away. But the Star Wars saga has as much to say about successful strategies and real-life warfare waged in our own time and place. Strategy Strikes Back brings together over thirty of today's top military and strategic experts, including generals, policy advisors, seasoned diplomats, counterinsurgency strategists, science fiction writers, war journalists, and ground‑level military officers, to explain the strategy and the art of war by way of the Star Wars films. Each chapter of Strategy Strikes Back provides a relatable, outside‑the‑box way to simplify and clarify the complexities of modern military conflict. A chapter on the case for planet building on the forest moon of Endor by World War Z author Max Brooks offers a unique way to understand our own sustained engagement in war-ravaged societies such as Afghanistan. Another chapter on the counterinsurgency waged by Darth Vader against the Rebellion sheds light on the logic behind past military incursions in Iraq. Whether using the destruction of Alderaan as a means to explore the political implications of targeting civilians, examining the pivotal decisions made by Yoda and the Jedi Council to differentiate strategic leadership in theory and in practice, or considering the ruthlessness of Imperial leaders to explain the toxicity of top-down leadership in times of war and battle, Strategy Strikes Back gives fans of Star Wars and aspiring military minds alike an inspiring and entertaining means of understanding many facets of modern warfare. It is a book as captivating and enthralling as Star Wars itself.
