Available in PDF, EPUB and Kindle. Book excerpt: The federal government, by statute, has an annual, governmentwide procurement goal of at least 5 percent for small disadvantaged businesses (SDB). SDBs are eligible for various price and evaluation benefits when being considered for federal contract awards. Recently, SDB firms are required to receive certification of their status as an SDB from the Small Business Administration (SBA) in order to receive these benefits and for agencies to be able to count contracts awarded to these firms toward their SDB goals. In your capacity as Chairman of the Subcommittee on Government Management, Information, and Technology, House Committee on Government Reform and as a Member of the Subcommittee, you requested that we provide information on the status of SDB certifications under the new Small Disadvantaged Business Certification (SDBC) program. You were concerned about reports that there were fewer businesses receiving SDB certification than expected. As agreed with your office, the objectives were to (1) determine the number of businesses that SBA had certified as socially and economically disadvantaged since the implementation of the SDBC program and (2) obtain views on reasons for the difference, if any, in the number of SDB certifications from the number that had previously self-certified as SDBs.

Book excerpt: This report discusses what constitutes a "disadvantaged" small business for purposes of federal and federally funded contracting programs and how firms are certified or otherwise designated as such. Three primary categories of disadvantaged small businesses are currently eligible for various contracting programs: (1) small businesses participating in the Small Business Administration's (SBA's) Minority Small Business and Capital Ownership Development Program (commonly known as the 8(a) Program) (8(a) participants); (2) "small disadvantaged businesses" (SDBs) and (3) "disadvantaged business enterprises" (DBEs). These firms are characterized as disadvantaged because they are at least 51% owned by one or more socially and economically disadvantaged individuals or groups. However, social and economic disadvantage is defined somewhat differently for each program. Members of certain racial and ethnic groups are presumed to be socially disadvantaged for purposes of the 8(a) and SDB programs, while women are also presumed to be socially disadvantaged for purposes of the DBE program. Similarly, individuals' net worth must be $250,000 or less for entry into the 8(a) Program, while net worth can be as high as $750,000 for newly designated SDBs or DBEs. It also reviews and synthesizes problems faced by state DOTs in the administration of their DBE programs and identifies race-neutral remedies used to overcome these challenges. As state DOT's carry out their highway construction programs, they are required to direct a portion of their federal-aid fund expenditures toward small businesses called DBEs. A DBE is defined as a small, for-profit business concern that is at least 51% owned and controlled by one or more socially and economically disadvantaged individuals. States are required to meet the maximum feasible portion of their DBE participation goals using race-neutral means designed to remove barriers and enhance opportunities for all small businesses, not just DBEs.
