Download or read book Sloan Vs New York State Board of Elections Albany Supreme Court No 4003 14 Decisions Briefs and Record written by Neil V. Grimaldi and published by . This book was released on 2014-08-23 with total page 100 pages. Available in PDF, EPUB and Kindle. Book excerpt: On or about July 8, 2014 there were filed with the New York State Board of Elections certain papers allegedly constituting petitions purporting to designate for the September 9, 2014 Democratic Party Primary Election Sam Sloan, Candidate for the Democratic Party nomination for Governor, Nenad Bach Candidate for the Democratic Party nomination for Lieutenant Governor and Geeta Rankoth Candidate for the Democratic Party nomination for Comptroller of New York State. These petitions included more than 4000 numbered pages and were facially valid and regular with a cover sheet consistent with New York Election Law and the Rules of the Board of Elections of the State of New York. Upon information and belief the said New York State Board of Elections improperly illegally and in violation of the United States Constitution 14th Amendment due process clause and under the New York State Constitution at an official meeting on August 1, 2014 threw them off the ballot without ever informing Sam Sloan, Candidate for the Democratic Party nomination for Governor, Nenad Bach Candidate for the Democratic Party nomination for Lieutenant Governor and Geeta Rankoth Candidate for the Democratic Party nomination for Comptroller of New York State that there would be a hearing and determination of the validity of their petitions and the possibility of their signatures being invalidated. 2. Order and decree and direct the New York State Board of Elections to restore the names of Sam Sloan, Nenad Bach and Geeta Rankoth to the ballot as Candidates for the Democratic Party nomination for Governor, Lieutenant Governor and Comptroller of New York State to be printed and placed on the official ballots to be used either at the September 9, 2014 Democratic Primary Election and the November 4, 2014 General Election and why the Petitioners should not have such other and further relief as to this court may seem just and proper.

Book The Law of Life and Death

  • Author : Elizabeth Price Foley
  • Publisher : Harvard University Press

Download or read book The Law of Life and Death written by Elizabeth Price Foley and published by Harvard University Press. This book was released on 2011-08-01 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: Are you alive? What makes you so sure? Most people believe this question has a clear answer—that some law defines our status as living (or not) for all purposes. But they are dead wrong. In this pioneering study, Elizabeth Price Foley examines the many, and surprisingly ambiguous, legal definitions of what counts as human life and death. Foley reveals that “not being dead” is not necessarily the same as being alive, in the eyes of the law. People, pre-viable fetuses, and post-viable fetuses have different sets of legal rights, which explains the law's seemingly inconsistent approach to stem cell research, in vitro fertilization, frozen embryos, in utero embryos, contraception, abortion, homicide, and wrongful death. In a detailed analysis that is sure to be controversial, Foley shows how the need for more organ transplants and the need to conserve health care resources are exerting steady pressure to expand the legal definition of death. As a result, death is being declared faster than ever before. The "right to die," Foley worries, may be morphing slowly into an obligation to die. Foley’s balanced, accessible chapters explore the most contentious legal issues of our time—including cryogenics, feticide, abortion, physician-assisted suicide, brain death, vegetative and minimally conscious states, informed consent, and advance directives—across constitutional, contract, tort, property, and criminal law. Ultimately, she suggests, the inconsistencies and ambiguities in U.S. laws governing life and death may be culturally, and perhaps even psychologically, necessary for an enormous and diverse country like ours.

Book Capitalizing on Environmental Injustice

Download or read book Capitalizing on Environmental Injustice written by Daniel Faber and published by Rowman & Littlefield Publishers. This book was released on 2008-07-17 with total page 317 pages. Available in PDF, EPUB and Kindle. Book excerpt: Capitalizing on Environmental Injustice provides a comprehensive overview of the achievements and challenges confronting the environmental justice movement. Pressured by increased international competition and the demand for higher profits, industrial and political leaders are working to weaken many of America's most essential environmental, occupational, and consumer protection laws. In addition, corporate-led globalization exports many ecological hazards abroad. The result is a deepening of the ecological crisis in both the United States and the Global South. However, not all people are impacted equally. In this process of capital restructuring, it is the most marginalized segments of society -poor people of color and the working class-that suffer the greatest force of corporate environmental abuses. Daniel Faber, a leading environmental sociologist, analyzes the global political and economic forces that create these environmental injustices. With a multi-disciplinary approach, Faber presents both broad overviews and powerful insider case studies, examining the connections between many different struggles for change. Capitalizing on Environmental Injustice explores compelling movements to challenge the polluter-industrial complex and bring about meaningful social transformation.
