Book excerpt: Se hace necesario profundizar en lo religioso, por el analfabetismo o marginación de su estudio en las Ciencias Sociales. ¿No ha repercutido este alejamiento en la desorientación que vive hoy el Derecho de familia, cuya realidad antropológica era custodiada con celo por las tradiciones religiosas? La carencia se ha denunciado por diversas personalidades del mundo de la religión, la cultura y la política. El hecho religioso se presenta como una constante en todos los pueblos, con notas peculiares que lo singularizan entre los factores que vertebran la vida social. Las notas principales de la religión son: 1ª) su apertura a lo Absoluto (más o menos personalizado, en una escala que va del animismo, pasa por la mitología, y llega al monoteísmo); 2ª) que va más allá de lo inmanente, pero siempre existen relaciones mutuas religión-realidad temporal, y 3ª) la gran variedad que reviste lo religioso. Con la última nota apuntamos a la pluralidad de respuestas que se dan al interrogante «Dios y hombre» y a la relación trascendencia–inmanencia, plenitud de ser y condición de criatura. Existe cierta polisemia en el término religioso. En su utilización jurídica destacamos tres acepciones: 1º) religión, en cuanto que definición de un tipo de agrupación que identifica y organiza una respuesta característica que se le da a Dios; 2º) el objetivo o propósito de una acción o proyecto, prácticas y fines religiosos, y 3º) los rasgos característicos que merecen particular protección por su entronque con las opciones radicales de la persona (signos, sentimientos o creencias religiosas) (Palomino, 2013 c: 236). El Derecho actúa en la vida social con intención de ordenarla, según criterios de justicia y razón. Esto se refiere tanto al ejercicio del poder que debe ser controlado y dirigido –cualquier orden social reclama una autoridad–, cuanto a las relaciones entre iguales. En el último punto lo fundamental es crear instrumentos ágiles de entendimiento y solución de conflictos. La religión forma parte del universo jurídico como elemento permanente de la condición humana. La religión y otras cosmovisiones que hacen sus veces amplían el conocimiento y articulan una respuesta ante la realidad de carácter holítico o de sentido (todo lo que nos rodea adquiere en ellas significado). La imagen intelectual del mundo, en multitud de pueblos, mantuvo categorías particularmente ricas, extraídas del humus cristiano o de otras de las grandes religiones. Las ideologías, fruto del racionalismo (teorías para la acción), se van configurando a lo largo del siglo XIX. Entre este siglo y el XX, desciende la religiosidad, primero, de parte de las clases altas y medias, y luego del proletariado. Hubo que llenar , con algo, el vacío de la fe religiosa. «Y este algo no podía ser sino las doctrinas políticas –anarquismo o socialismo–» (Brenan, 1994: 18). Más tarde se perfilan otras muchas ideologías, en ocasiones, solapadas con aquellas y, en otras, ampliando su difusión y alcance. Tales corrientes fueron abrazadas «con el mismo fervor religioso y la misma simplicidad» que el ideal religioso (ibidem).

Los autores de este libro —que quiere serlo «de texto»— han sido durante bastantes años profesores de Derecho eclesiástico en la Facultad de Derecho de la Universidad de Almería. Los tres explicaban el mismo programa y trataban de dar el mismo enfoque e impartir semejantes contenidos en sus clases. Así pues, la experiencia docente de un trabajo en equipo durante un tiempo prolongado, junto a la necesidad de unos materiales de estudio más acordes con la actual posición académica de la asignatura (también desde el punto de vista de su inclusión en los primeros cursos de los grados, en lugar de en los últimos de las anteriores licenciaturas), han alentado a los autores para preparar estas lecciones. Passing to América is at once a historical biography and an in-depth examination of the sex/gender complex in an era before “gender” had been divorced from “sex.” The book presents readers with the original court docket, including Don Antonio’s extended confession, in which he tells his life story, and the equally extraordinary biographical sketch offered by Felipa Ybañez of her “son María,” both in English translation and the original Spanish.
