In the legal sphere, however, it is argued that this could open the gates for ‘eigenrichting’. In this context, Astrid Bosch raises the following questions: Have the legal norms constraining citizens' right to enforce the law become outdated? Is there, thus, a gap between the current legal and social opinions regarding citizen’s arrest? Would bridging this gap, by broadening the legal space for citizen’s arrest, endanger the rule of law?

Book excerpt: In analyzing the obstacles to democratization in post- independence Africa, Mahmood Mamdani offers a bold, insightful account of colonialism's legacy--a bifurcated power that mediated racial domination through tribally organized local authorities, reproducing racial identity in citizens and ethnic identity in subjects. Many writers have understood colonial rule as either "direct" (French) or "indirect" (British), with a third variant--apartheid--as exceptional. This benign terminology, Mamdani shows, masks the fact that these were actually variants of a despotism. While direct rule denied rights to subjects on racial grounds, indirect rule incorporated them into a "customary" mode of rule, with state-appointed Native Authorities defining custom. By tapping authoritarian possibilities in culture, and by giving culture an authoritarian bent, indirect rule (decentralized despotism) set the pace for Africa; the French followed suit by changing from direct to indirect administration, while apartheid emerged relatively later. Apartheid, Mamdani shows, was actually the generic form of the colonial state in Africa. Through case studies of rural (Uganda) and urban (South Africa) resistance movements, we learn how these institutional features fragment resistance and how states tend to play off reform in one sector against repression in the other. The result is a groundbreaking reassessment of colonial rule in Africa and its enduring aftereffects. Reforming a power that institutionally enforces tension between town and country, and between ethnicities, is the key challenge for anyone interested in democratic reform in Africa.

Book excerpt: A recurring theme in the history of modern Britain in the twentieth-century has been the failure of its manufacturing industry and the record of disorder and conflict in the industrial workplace. This image was reinforced by the evidence of national strikes from the 1960s until 1984. This emphasis on decline and disorder in British manufacturing has distorted our understanding of workplace relationships and cultures in the post-war years. This volume provides a fresh assessment of the diverse and complex world of the workplace and Britain's production cultures during the long boom. Essays investigate the public and private sectors, and both manufacturing and service industries. The volume begins with a comparison of labour management in the post-war automobile industry, exploring the role of the foreman in the management of shop floor labour in Britain and the USA. The following two essays are concerned with relations between management and workers in the publicly-owned corporations. The first examines negotiations over pay and effort at the Swindon locomotive works, including the cultural values which informed the behaviour of the bargainers. The second investigates managerial responses to technical change in the British gas industry. We then move into the service sector, with an essay on the management of clerical staff in banks, including a discussion of the different roles available to male and female workers, and the incorporation of automated technologies. The final essay looks at the involvement of the unions in workplace productivity and the extent to which Labour politics informed union behaviour. The essays in this volume shed new light on the reasons for Britain's economic performance and opens up earlier interpretations of national decline and adversarial workplace cultures for further debate.

Book excerpt: The exceptional weakness of the American labor movement has often been attributed to the successful resistance of American employers to unionization and collective bargaining. However, the ideology deployed against labor's efforts to organize at the grassroots level has received less attention. In Citizen Employers, Jeffrey Haydu compares the very different employer attitudes and experiences that guided labor-capital relations in two American cities, Cincinnati and San Francisco, in the period between the Civil War and World War I. His account puts these attitudes and experiences into the larger framework of capitalist class formation and businessmen's collective identities. Cincinnati and San Francisco saw dramatically different developments in businessmen's class alignments, civic identities, and approach to unions. In Cincinnati, manufacturing and commercial interests joined together in a variety of civic organizations and business clubs. These organizations helped members overcome their conflicts and identify their interests with the good of the municipal community. That pervasive ideology of "business citizenship" provided much of the rationale for opposing unions. In sharp contrast, San Francisco's businessmen remained divided among themselves, opted to side with white labor against the Chinese, and advocated treating both unions and business organizations as legitimate units of economic and municipal governance. Citizen Employers closely examines the reasons why these two bourgeoisies, located in comparable cities in the same country at the same time, differed so radically in their degree of unity and in their attitudes toward labor unions, and how their views would ultimately converge and harden against labor by the 1920s. With its nuanced depiction of civic ideology and class formation and its application of social movement theory to economic elites, this book offers a new way to look at employer attitudes toward unions and collective bargaining. That new approach, Haydu argues, is equally applicable to understanding challenges facing the American labor movement today.

During the Second World War women's clubs, guilds, and institutes provided a basis for the mobilization of up to a million women, mainly housewives, into unpaid part-time work. Women's Voluntary Service, which was set up by the Government in 1938 to organize this work, generated a rich archive of reports and correspondence which provide the social historian with a unique window into the female public sphere. Questioning the view that the Second World War served to democratize English society, James Hinton shows how the war enabled middle-class social leaders to reinforce their claims to authority. Displaying 'character' through their voluntary work, the leisured women at the centre of this study made themselves indispensable to the war effort. James Hinton delineates these 'continuities of class', reconstructing intimate portraits of local female social leadership in contrasting settings across provincial England (towns large and small, shire counties, the Durham coalfield), tracing complex and often acerbic rivalries within the voluntary sector, and uncovering gulfs of mutual distrust and incomprehension dividing publicly active women along gendered frontiers of class and party. This study reminds us how much Britain's wartime mobilization relied on a Victorian ethos of public service to cope with the profoundly un-Victorian problems of total war. The women's associations so evocatively explored here reached the apex of their effectiveness during the Second World War, sustaining an uneasy balance between voluntarism and the expanding power of the state. In the longer term female social leaders found themselves marginalized by bureaucracy and professionalization. The stories told here demonstrate that the Second World War changed English society far less than is often assumed. It was not until the 1950s and 1960s that practices and attitudes laid down in the nineteenth century finally lost their purchase.
