The Law of the Sea Convention sets forth a comprehensive framework governing uses of the oceans. Adopted in 1982, and substantially modified by the1994 Agreement relating to the deep seabed mining provisions, the Convention has been in effect since 1994. There are now 162 parties to the Convention, including almost all of the traditional allies of the United States. The 1995 UN Fish Stocks Agreement further implements certain provisions of the Convention. There are now 78 parties to this Agreement, including the United States. Clinton's testimony stated: "Our economy depends on international trade, and the United States benefits from the global mobility that those navigational provisions accord to commercial ships of all nations. We have the world's second longest coastline, so the United States benefits greatly from the Convention's favorable provisions on offshore natural resources. The treaty accords sovereign rights over natural resources within a 200-mile exclusive economic zone. The United States is further advantaged by provisions in the treaty that allow the continental shelf - and oil and gas rights - to extend beyond 200 miles in certain areas. Off the north shore of Alaska, our continental shelf could extend 600 miles into the Arctic. American companies are equipped and ready to engage in deep seabed mining. But the United States can only take advantage of the Convention's provisions that accord security of tenure to mine sites in areas beyond national jurisdiction as a party to this treaty. The Convention, which was modified to meet U.S. demands, accords the United States a guaranteed seat on the key decision-making body. It is no wonder then that there is such a strong and wide-ranging coalition supporting U.S. accession. The U.S. military has consistently and unequivocally supported the Convention for its national security benefits. Affected U.S. industries, including shipping, fisheries, telecommunications, and energy, have consistently supported U.S. accession for its economic benefits. Non-governmental organizations concerned with the protection of natural resources have consistently supported U.S. accession. And both Republican and Democratic Presidents have supported U.S. accession. I have never seen another treaty with such intensive and broad support. Furthermore, no treaty has been as thoroughly scrutinized by the Senate as the Law of the Sea Convention. This Committee has twice examined it and sent it to the full Senate. Four other Committees held hearings in 2004, including the Senate Armed Services Committee, of which I was a member. In 2007, the Foreign Relations Committee held two additional hearings and another favorable vote. Every conceivable question has been asked and answered. As President George W. Bush said in 2007, joining the Convention will serve the national security interests of the United States, secure U.S. sovereign rights over extensive marine areas, promote U.S. interests in the health of the oceans, and give the United States a seat at the table where rights essential to our interests are debated and interpreted."

Book excerpt: Navigational rights and freedoms have been central to the development of the law of the sea since the original debates over whether the seas were `open' or `closed' to maritime traffic. The 1982 UN Convention on the Law of the Sea recognises the legitimate rights of coastal states to proclaim sovereignty and assert jurisdiction over vast areas of maritime space. In return, maritime states are given a range of navigational rights over waters ranging from the territorial sea through to the high sea. The new regime of the law of the sea created by the Convention presents an opportunity to review developments in the law of navigational rights and freedoms. This book assesses the navigational regime established by the 1982 Convention, with emphasis given to the continuing importance of the freedom of the seas. Navigation in the territorial sea and international straits is reviewed, especially in the Straits of Malacca and Singapore, and the Torres Strait. Archipelagic navigation from the perspective of two claimant states, Indonesia and the Philippines, and a user state, South Korea, is also considered. What distinguishes this book from others is the fact that it is not limited to examining the effects of climate change and how it is reshaping the way scholars assume the Arctic will be in the near future. Rather it creates a transparent nexus between opposing claims and increasing commercial interests and proceeds to scrutinize the efforts of the Arctic Council and individual Arctic coastal states. In this context, the book follows a given equation based on initial theories and how the opposing claims and increasing commercialization side of the equation can be balanced with the appropriate legal norm. It also reflects on the critical aspects of “hard law and soft law” which are two opposite ends of the legal pole and core elements of any legal spectrum. The book, after reflecting on those two elements, finally proposes a new Arctic legal regime, which is intricate and detailed and is basically a hierarchy based on logic and reasoning. In doing so, it imports a pristine theory for a pristine territory.

To face these challenges, this book claims that environmental law needs to shift attention from media-specific pollution regimes to integrative life-cycle approaches of waste management i.e., from the prevention of waste generation to the actual handling of wastes. Furthermore, the cooperation of States and the establishment of coordinated activities is essential because states can no longer have separate standards for wastes posing transboundary risks and for ‘purely domestic’ wastes. Drawing upon both International and EU law, the book provides a detailed analysis of the regimes set up to deal with the transboundary movement of wastes and ship-source pollution, so as to elucidate the obligations and legal principles governing such regimes. It concludes that treaty obligations concerning transboundary movements of wastes are inapplicable to ship wastes while on board ships and on land. However, despite the limitations of the transboundary movement of wastes regime, the principle of Environmentally Sound Management (ESM) embodied in this regime has gradually transformed into a legal principle. ESM works to address the legal gaps in the regulation of wastes, and consequently, it provides the desired coherence to the legal system since it acts as a bridge between several regulatory and sectoral levels. Furthermore, ESM offers a new light with which to understand and interpret existing obligations, and it provides a renewed impetus to regimes that directly and indirectly govern wastes. This impetus translates into greater coordination and the establishment of cross-sectional policies. By offering alternative ways to solve problems linked to the management of ship wastes in the sea-land interface, this book will appeal to anyone with an interest in International Environmental Law.
