Book No Easy Answers

Download or read book No Easy Answers written by Sarah Tofte and published by . This book was released on 2007 with total page 141 pages. Available in PDF, EPUB and Kindle. Book excerpt: No Easy Answers is the first comprehensive study of US sex offender registration, community notification and residency restriction laws, their public safety impact, and the effect they have on former offenders and their families. It concludes the laws are poorly crafted and misguided, failing to protect children from sex crimes but making it nearly impossible for former offenders to rebuild their lives. In many states, everyone convicted of a sex crime must register and the requirement can last for life. The requirements are overbroad in scope and overlong in duration. As a result, there are more than 600,000 registered sex offenders, including individuals convicted of sexual sex between teenagers, prostitution, and public urination, as well as those who committed their only offenses decades ago. Unfettered public access to online sex offender registries exposes registrants to harassment, ostracism, and even violence, with little evidence that this form of community notification protects anyone from sexual violence. Residency restrictions prohibit former offenders from living within a designated distance (anywhere from 500 to 2,500 feet) from places where children gather. The restrictions have the effect of banishing former offenders from entire towns, forcing them to live far from home, families, jobs, and treatment, and hindering law-enforcement supervision. The restrictions may have no impact on the likelihood of recidivism. Sex offender laws reflect public concern that children are at grave risk of sexual abuse by strangers who are repeat offenders. The real risks children face are quite different: statistics demonstrate that most sexual abuse of children is committed by family members or persons known and often trusted by the victim, and by someone who has not previously been convicted of a sex offense. The laws also reflect the widely shared but erroneous belief that sex offenders continually repeat their offenses. Authoritative studies, however, indicate that three out of four adult offenders do not reoffend.

Book Sex Offender Perceptions of Residency Restriction Laws

Download or read book Sex Offender Perceptions of Residency Restriction Laws written by Carmen Zoraida Gomez-Torres and published by . This book was released on 2015 with total page 102 pages. Available in PDF, EPUB and Kindle. Book excerpt: The use of residency restriction laws to monitor and control the movements of registered sex offenders in the United States has gained momentum in recent years since the passage of the first federal laws mandating sex offender registries. More than 30 states and hundreds of cities and towns have passed these laws. The purported theory behind residency restriction laws is to prevent registered sex offenders from possible interactions with potential victims. While the residency restriction laws may be theoretically sound, in practice there has been little in the way of empirical proof that they work as designed. As of yet, Massachusetts does not have a statewide residency restriction law, however, there is continuing pressure to enact one. This study explored the possible effects of such a law on those who would be most affected by it: registered sex offenders in Massachusetts. The theoretical framework drew upon social exclusion, disintegration, and labeling theories regarding the potential effects of residency restriction. One hundred registered sex offenders were selected to take part in a survey responding to 12 statements designed to determine their perceptions and attitudes towards potential residency restriction laws. The survey was followed by open-ended interviews with ten of the participating registered sex offenders. The results of the survey and the interviews show that the vast majority of the participants felt that the residency restriction laws would hinder their ability to reintegrate into society. Such findings consequently suggest that new laws would not provide additional safety to potential victims and might instead lead to increased recidivism (repeat offending).

Download or read book Democracy and Deliberation written by Cary Federman and published by University of Michigan Press. This book was released on 2021-06-15 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sex offender laws include residency restrictions, registration and notification requirements, and post-conviction civil commitment. These laws and regulations impose serious restrictions on the movements of convicted sex offenders. This is controversial because these laws and regulations occur after the sex offender has completed his time in prison. These laws and regulations are intended to have both a deterrent and therapeutic effect. Residency restrictions seek to prevent sex offenders from recommitting their crimes and civil commitment provides psychological services while incarcerated in a forensic facility. Most works on this subject are deeply critical of these laws. Cary Federman takes a more sympathetic approach to sex offender legislation. He focuses on the deliberative intentions of legislators, exploring the limits of judicial review and the rights of interested parties to influence lawmaking. Leaders of these interested parties are usually the parents of children who have been sexually violated and murdered. Critics of sex offender legislation tend to focus on the convicted parties, arguing that their rights have been violated. Democracy and Deliberation asserts that these laws are expressions of the deliberative intentions of lawmakers concerned about public safety—they are thus constitutional, if not always wise.

Book Raised on the Registry

Book excerpt: This report details the harm public registration laws cause for youth sex offenders. The laws, which can apply for decades or even a lifetime and are layered on top of time in prison or juvenile detention, require placing offenders' personal information on online registries, often making them targets for harassment, humiliation, and even violence. The laws also severely restrict where, and with whom, youth sex offenders may live, work, attend school, or even spend time.

Available in PDF, EPUB and Kindle. Book excerpt: "This volume of readings provides an excellent source of information about sex offender laws and policies."--International Journal of Offender Therapy and Comparative Criminology "Sex Offender Laws...is a good source for balanced, objective, and thorough critique of our current sex offender policies as well as a source for accurate information about a very heterogeneous population...The message that sexual abuse is often a multifaceted and complex issue and that policy based on quick fixes or knee jerk reactions do not often work will be informative and enlightening to many readers." --Sex Roles "[T]his fine book by Richard Wright and his distinguished collaborators provides the evidence that wise policy-makers would want to consider. It covers every major field of research concerning sex offenders and sexual offenses and provides evidence of bad practices and policiesÖ.Intellectually honest politicians should read this book." --Michael Tonry, LL.B, Professor of Law and Public Policy University of Minnesota Law School (From the Foreword) In response to many high-profile cases of sexual assault, federal and state governments have placed a number of unique criminal sanctions on sex offenders. These include residency restrictions, exclusionary zones, electronic monitoring, and chemical castration. However, the majority of sex offender policies are not based on empirical evidence, nor have they demonstrated any significant reductions in offender recidivism. In fact, some of these policies have unintended consequences, which actually increase the likelihood of sexual offenses. In this book, Wright critically analyzes existing policies, and assesses the most effective approaches in preventing sex offender recidivism. This provocative and timely book draws from the fields of criminal justice, law, forensic psychology, and social work to examine how current laws and policies are enacted and what to-date is known about their efficacy. The team of expert contributors includes Karen Terry, author of Sexual Offenses and Offenders, and others who bring a wealth of insight to the field of sex offense. In response to the failed policies of sex offender laws, this book presents alternative models and approaches to sex offense laws and policies. Wright also explores critical, cutting-edge topics, such as internet sexual solicitation, the death penalty, and community responses to sex offense. Key Features: An introduction and overview of the history of sex offender laws Analyzes the role of the media in sex offense and sex offender policies Examines the political "untouchability" of sex offender laws and their adverse effects Features interviews with victims of sexual assault, investigating their points of views on what kinds of reforms need to be made to sex offender laws Thought-provoking and insightful, Sex Offender Laws serves as a vital resource for policy makers, researchers, and students of criminal justice, law, and social work.

Download or read book Protecting Our Kids written by Emily Horowitz and published by Praeger. This book was released on 2015-04-21 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This thought-provoking work raises important questions about sex offender laws, drawing from personal stories, research, and data to prove the policies promote fear, destroy lives, and fail to protect children. Do sex offender laws protect children, or are they inherently unfair practices that, at their worst, promote vigilante justice? The latter, this book argues. By analyzing the social, political, historical, and cultural context surrounding the emergence of current sex offender policies and laws, the work shows how sex offenders have come to loom as greater-than-life monsters when, in many cases, that is not true at all. Looking at its subject from a fresh viewpoint, the book shares research and new analyses of data and qualitative evidence to show how sex-offender laws are not only ineffective, but engender destructive fear and anxiety. To help readers understand the impact of these laws, the author presents interviews with sex offenders and their families as they describe the day-to-day reality of living on the sex offender registry. Citing research and statistics, the book challenges the idea that sex offenders must be continually monitored and publicly identified because they are incurably predatory. Most important, the study shows that undue sex offender panic is preventing policymakers from addressing the true threats to children—poverty and growing inequality.
