The overarching legal and hydropolicy issue is whether states can simultaneously pursue hydrosovereignty on tributaries and ensure the Mekong legal regime’s efficacy to achieve holistic water resources management and basin-wide governance.

The water resources of the Mekong region - from the Irrawaddy and Nu-Salween in the west, across the Chao Phraya to the Lancang-Mekong and Red River in the east- are increasingly contested. Governments, companies, and banks are driving new investments in roads, dams, diversions, irrigation schemes, navigation facilities, power plants and other emblems of conventional 'development'. Their plans and interventions should provide some benefits, but also pose multiple burdens and risks to millions of people dependent on wetlands, floodplains and aquatic resources, in particular, the wild capture fisheries of rivers and lakes. This book examines how large-scale projects are being proposed, justified, and built. How are such projects contested and how do specific governance regimes influence decision making? The book also highlights the emergence of new actors, rights and trade-off debates, and the social and environmental consequences of 'water resources development'. This book shows how diverse, and often antagonistic, ideologies and interests are contesting for legitimacy. It argues that the distribution of decision-making, political, and discursive power influences how the waterscapes of the region will ultimately look and how benefits, costs and risks will be distributed. These issues are crucial for the transformation of waterscapes and the prospects for democratizing water governance in the Mekong region. The book is part of the action-research of the M-POWER (Mekong Program on Water, Environment and Resilience) knowledge network. The Se San River is affected by multi-scale politics, souvereignty issues and mismanagement of valuable environmental resources. This mismanagement is no longer confined to the tributaries of the Mekong but is now also reaching the mainstream of the river with a new dam starting construction near Xayabury in Laos. The people of Ratanakiri province live on the edge of civilisation and have traditionally not received much attention from the central government in Phnom Penh.

A framework for analysis is proposed which serves as a tool for analysis by civil society actors. The author generates fresh insights into the way in which opportunities and barriers are created for NGOs to influence state-centric decision-making processes. The book also discusses Mekong riparian states’ negotiation process over the Xayaburi hydropower dam in detail, providing an analysis of the Mekong River’s governance under the 1995 Mekong Agreement. Based on the development of a multidisciplinary knowledge base assessment in all case studies (policy, social and natural sciences) and an early stage development of IWRM conceptual framework, this book investigates IWRM in the four selected twinned catchments covering six countries in Europe and Asia. Twinning activities based on a problem-based approach have been performed in four case river basins: Tunga Bahdra (2 states in India), Sesan (Vietnam/Cambodia), Glomma (Norway), Tejo/Tagus (Spain/Portugal). The problems covered are water regimes in transboundary regulated rivers; environmental flow; land and water use interaction; and pollution under the IWRM framework. The research used sub-basins of each river basin in all cases to allow more detailed studies and easier integration of all stakeholders, for transferability purposes. Since then, the importance of the role that indigenous peoples play in economic, social and environmental conservation through traditional sustainable agricultural practices has been gradually recognized. Consistent with the mandate to eradicate hunger, poverty and malnutrition--and based on the due respect for universal human rights--in August 2010 the Food and Agriculture Organization of the United Nations adopted a policy on indigenous and tribal peoples in order to ensure the relevance of its efforts to respect, include, and promote indigenous people's related issues in its general work. This publication is an outcome of a regional consultation held in Bangkok, Thailand in November 2013. It documents seven case studies which were conducted in Bangladesh, Cambodia, India, Indonesia, the Lao People's Democratic Republic, Nepal and Thailand to take stock of the changes in livelihood and food security among indigenous shifting cultivation communities in South and Southeast Asia against the backdrop of the rapid socio-economic transformations currently engulfing the region. The case studies identify external--macro-economic, political, legal, policy--and internal--demographic, social, cultural--factors that hinder and facilitate achieving and sustaining livelihood and food security. The case studies also document good practices in adaptive changes among shifting cultivation communities with respect to livelihood and food security, land tenure and natural resource management, and identify intervention measures supporting and promoting good practices in adaptive changes among shifting cultivators in the region.
