Téngase presente que la trascendencia que para ese momento (en que Engisch publica su trabajo), tenía este asunto, radicaba en que la sistematicidad se consideraba un atributo esencial del carácter científico o no de una disciplina del cono-cimiento humano. Una ciencia se caracterizaba, sobre todo, por ser «sistemática». Ello es válido, para muchos, incluso hoy. Para dar res-puesta a esta cuestión, Engisch procede a examinar varios sentidos (u opciones) en que se puede afirmar que el Derecho es sistemático. En primer lugar, y de la mano de pensadores como David Hilbert, Weyl, Carnap, Bochenski, examina algunos de los atributos del denominado método axiomático que se utiliza en disciplinas como la lógica y las matemáticas, para concluir que dicha pretensión científica está descartada del ámbito de la Jurisprudencia [de la ciencia jurídica]. «Sin tener que entrar ahora en una más amplia discusión lógica de estos diferentes aspectos de la Axiomática y su relación mutua, podemos decir que el ideal científico que aquí se propone no es posible realizarlo en la Jurisprudencia, o en todo caso lo es sólo muy parcialmente». Primer escalón, descartado. En segundo lugar, se pregunta el profesor de Múnich si, entonces, el Derecho podrí a entender se ya no como una Axiomática en sentido estricto, pero al menos como un sistema completo de enunciados que se deriven por vía de la deducción lógica. Así, por ejemplo, es conocido el estilo de argumentación propio del añejo silogismo jurídico, según el cual, a partir de premisas establecidas en el ordenamiento jurídico, se infieren (mediante unas reglas de inferencia simples: modus bárbara o modus ponens) unas conclusiones seguras y previsibles".
