At the latest since the postcolonial debate, we know that we need to “test” our assumptions under radically different conditions. This book offers an extended perspective of local self-governance by examining cases from South Asia, Africa, and Latin America, together with a study of militias in the USA. The chapters present a wide variety of local actors who pursue different notions of order legitimized by local traditions based on hierarchy or deeply rooted communalism, Islamic theology, or grassroots democracy. Some local actors claim a state-like authority and challenge the territorial state. In such cases, there is no longer “a shadow hierarchy” but opposition to the state. Different violent actors fight for supremacy, and the state is just one actor among others. The empirical studies presented in this book show how different kinds of local self-governance are combined with varieties of statehood, and thus contribute to an understanding of the notion of governance in a fundamental sense that goes beyond the special case of the OECD world.

Richland looks at the way Native Americans and government officials talk about their relationship and seek to resolve conflicts over the extent of Native American authority in tribal lands when it conflicts with federal law and policy. The American federal government is supposed to engage in meaningful consultations with the tribes about issues that affect the tribes under long standing Federal law which accorded the federal government the responsibility of a trustee to the tribes. It requires the government to act in the best interest of the tribes and to interpret agreements with tribes in a way that respects their rights and interests. At least partly based on a patronizing view of Native Americans, the law has also sought to protect the interests of the tribes from those who might take advantage of them. In Cooperation without Submission, Richland looks closely at the language employed by both sides in consultations between tribes and government agencies focusing on the Hopi tribe but also discussing other cases. Richland shows how tribes conduct these meetings using language that demonstrates their commitment to nation-to -nation interdependency, while federal agents appear to approach these consultations with the assumption that federal l aw is supreme and ultimately authoritative"--

The central argument of this volume is that institutions of liberal learning are critical to a developing and flourishing civil society. It is within these civil society incubators that the habits of open discourse are practiced and honed; that a collaborative (often contentious) commitment to truth seeking serves as the rules that govern our work together; that the rules of personal and widespread social cooperation are established, practiced, and refined. Many have made this argument as it relates to community based learning, and we explore that theme here as well. But acquiring and practicing the habits of civil society recur within and throughout the college context--in the classrooms, in college governance structures, in professional associations, in collaborative research, in the residence halls, and on the playing field. To put it another way, when they are at their best, institutions of liberal learning are contexts in which students learn how to live in a free society and learn the art of self-governance.
