It takes a human rights-based approach to tax havens, and is a detailed analysis of structures and the laws that generate and support these. It makes plain the unscrupulous or merely indifferent ways in which, using tax havens, businesses and individuals systematically undermine and for all practical purposes eliminate access to remedies under international human rights law. It exposes as abusive of human rights a complex structural web of trusts, companies, partnerships, foundations, nominees and fiduciaries; secrecy, immunity and smoke screens. It also lays bare the cynical manipulation by tax havens of traditional legal forms and conventions, and the creation of entities so bizarre and chimeric that they defy classification. Yet from the perspective of the tax havens themselves, these are entirely legitimate; the product of duly enacted domestic laws. This book is not a work of investigative journalism in the style of the Pulitzer Prize-winning authors of The Panama Papers, exposing political or financial corruption, money laundering or the financing of terrorism. All those elements are present of course, but the focus is on international human rights and how tax havens do not merely facilitate but actively connive at their breach. The tax havens are compromising the international human rights legal continuum.

Ownership – specifically, the quest to identify beneficial owners - has been chosen by national and international regulators as the touchstone, the litmus test in the fight back. An owner by definition must possess something for which they are financially accountable. But what is meant by "ownership"? This book explains why ownership is pivotal to accountability, and what ownership means in common law, civil law and Shariah law terms. The book examines whether widespread implementation of UNSCR 1325 and the broader WPS agenda via gender mainstreaming in UN operations has translated into increased gender equality in peacekeeping operations, the broader UN institutional context and, by extension, the host countries in which missions are situated, via norm dissemination. The book investigates this via a review of the implementation of UNSCR1325 in the operations chosen as research sites over three snapshot years. The book undertakes a comparative analysis that scrutinizes if, how and under what conditions gender mainstreaming has succeeded as a strategy to advance gender equality by analyzing the factors/conditions that have led to successful gender mainstreaming across the operational context, and those that have impeded this outcome. The book concludes that, despite rhetorical commitments to women’s equality in peacekeeping since the passage of UNSCR 1325, progress on the ground has remained minimal, and that the operational environment continues to be discriminatory against women. Both quantitatively and qualitatively, women do not participate as equal partners in peacekeeping and continue to have less access to resources and decision-making power, overall. The book interrogates that by exploring the spaces available within law, policy and practice of the UN to pursue the human rights agenda of gender equality and considers whether UNSCR 1325 has enlarged those spaces. It also points to the irony of internal UN structures failing to adequately adapt to their own gender mainstreaming mandates, while those same structures have delivered some gender equality mandates successes externally, at local levels. During Sudan’s Anglo-Egyptian colonial rule, the Arabic Muslim north and Christian and animist south were ruled as two distinct entities. The north was modernized but the south neglected, creating parallel entities which overlooked the diversity and historical interrelations between the areas. Sudan’s conflicts are rooted in the creation of the state. A 1947 policy change to unify them meant that when the country was granted independence in 1956, Sudan was left with a heavily unified and centralized state, ruled from the north. The south, which already had social and political grievances, feared it would be dominated by the Arabic and Islamist North. Promises to create a federal system were soon broken. In 1955, tensions flared up and led to the outbreak of the first Sudanese civil war. The conflict, which featured successive coups and regime changes, ended with the 1972 Addis Abeba agreement and another promise of political autonomy for the South. Disputes over the discovery of oil in the south in 1979, together with President Nimeiry’s decision to implement Islamic Sharia law for the whole of Sudan and end southern autonomy, led to a new surge in civil violence in 1983.

These requests are often accepted by the other states, despite the circumvention of the United Nations Security Council and extensive violation of international humanitarian law and human rights. In this book, Erika De Wet examines the authority entitled to extend a request for (or consent to) direct military assistance, as well as the type of situations during which such assistance may be requested, notably whether it may be requested during a civil war. Ultimately, De Wet addresses the question of if and to what extent the proliferation of military assistance on the request of a recognized government is changing the rules in international law applying to the use of force.
