Book excerpt: The Committee's report examines the UK Government's diplomatic handling of the seizure of eight Royal Navy sailors and seven Royal Marines by the Iranian Revolutionary Guard in the Shatt al-Arab waterway in March 2007. Issues discussed include: Iran's objectives and strategy during this incident, the Government's diplomatic strategy, the role of regional states and the United States, the sale of stories by captured personnel to the media, and the value of diplomacy to resolve such incidents. Amongst its findings, the report condemns the treatment of the British personnel by Iranian authorities as unacceptable, particularly the use of public confessions and its refusal to grant consular access to detainees. It broadly supports the Government's dual-track diplomatic approach against Iran but criticises the Government's failure to engage with the appropriate interlocutors within the Iranian regime at a sufficiently early stage. The Committee also finds that the MoD's decision to allow returning detainees to sell their stories to the media displayed a disturbing lack of judgement and calls on the Foreign & Commonwealth Office to state in its response to the report who took the decision to give authorisation. Overall, the Committee supports the FCO's overall approach during the crisis, despite some tactical mistakes, and argues that the incident shows the value of diplomacy to resolve a crisis peacefully.

Book excerpt: Eighteen months since the Arab Spring began, there has been extraordinary progress in Egypt, Tunisia and Libya. Yet many challenges still lie ahead, not least the need to support and reform the economies of these Arab Spring states. In 2011, the G8 Deauville Partnership identified $38 billion of funding available to support reform. The UK must use its leadership in the EU and G8 to ensure that we deliver on our promises. The Government needs to learn lessons from its experience in anticipating and handling the Arab Spring. Questions arose about the FCO's staffing levels, linguistic expertise and information gathering in the Middle East and North Africa region, although diplomats understood well the long-term problems in the region. The report welcomes the Government's recent moves to establish contacts with Islamist parties in the region and calls for deeper engagement to demonstrate at an early stage the UK's support and assistance for democratically elected leaders who respect human rights and democratic reforms. The BBC's Arabic Service further highlighted the importance of the BBC World Service in providing an independent news service and enhancing the UK's standing in the region. The Committee welcomes the Government's decision to reverse planned cuts to the Arabic Service last year, expresses concerns that cuts made elsewhere in the World Service will prove detrimental to the national interest, and urges that there be a sustained investment in the World Service

Book excerpt: Roger Douglas compares responses to terrorism by five liberal democracies—the United States, the United Kingdom, Canada, Australia, and New Zealand—over the past 15 years. He examines each nation’s development and implementation of counterterrorism law, specifically in the areas of information-gathering, the definition of terrorist offenses, due process for the accused, detention, and torture and other forms of coercive questioning. Douglas finds that terrorist attacks elicit pressures for quick responses, often allowing national governments to accrue additional powers. But emergencies are neither a necessary nor a sufficient condition for such laws, which may persist even after fears have eased. He argues that responses are influenced by both institutional interests and prior beliefs, and complicated when the exigencies of office and beliefs point in different directions. He also argues that citizens are wary of government’s impingement on civil liberties and that courts exercise their capacity to restrain the legislative and executive branches. Douglas concludes that the worst antiterror excesses have taken place outside of the law rather than within, and that the legacy of 9/11 includes both laws that expand government powers and judicial decisions that limit those very powers.

This volume of documents covers the occupation of Iraq from the planning stages of the invasion of Iraq in early 2002 to the transfer of governing authority to the Iraqi Interim Government on 28 June 2004. The book presents 595 selected documents including the first complete set of all Regulations, Orders, Memoranda and Public Notices issued by the US-led occupation administration of Iraq, the Coalition Provisional Authority (CPA), several of which were never published on the CPA`s website or promulgated in Alwaqai Aliraqiya, the Official Gazette of Iraq. Some of these legal acts have shaped the economic and political system of present day Iraq and will be part of the country`s legal order for years to come. The book also includes some 120 other CPA and CPA-related documents selected from more than 5000 unclassified CPA documents and received under freedom of information requests lodged in the United States, the United Kingdom, Australia and Switzerland. These documents include instructions and proclamations to the Iraqi people in the early stages of the occupation, organizational charts, internal legal opinions, diplomatic notes, international agreements concluded by the CPA with other States, and numerous internal memoranda for the head of the CPA, Ambassador Paul L Bremer, on legal, diplomatic and political issues. The book also presents for the first time all 235 resolutions passed by the Iraqi Governing Council (IGC) between July 2003 and June 2004. The resolutions as well as many of the 25 other important IGC documents (including various political statements, press releases and decrees of the Council`s Higher National De-Ba`athification Commission) have been translated from Arabic and are presented here for the first time in English. These documents are complemented by the relevant United Nations documents on the occupation of Iraq as well as some 50 policy documents of the United States, the United Kingdom and the Iraqi opposition movement as well as all relevant fatwas (religious rulings) of Grand Ayatollah Ali al-Sistani which shaped the internal Iraqi political process during the occupation. This collection archives these important documents for future use and makes them easily accessible to researchers and professionals. Considering that the main source of information for the occupying powers in Iraq were the precedents set during the First and Second World Wars, the occupation of Iraq will serve as a modern precedent for future administrations of occupied territory. The documents are made easily accessible by a comprehensive table of documents, a list of abbreviations, more than 1100 explanatory notes and cross-references and a substantive subject index. This volume is the second on The Occupation of Iraq. It is complemented by a monograph by the same author which, on the basis of the documents collection, presents a comprehensive analysis of The Governance of Occupied Territory in Contemporary International Law.

Since the publication of the second edition of International Law and the Use of Force the law in this area has continued to undergo a fundamental reappraisal. Operation Enduring Freedom carries on against Al Qaida and the Taliban in Afghanistan six years after the terrorist attacks of 11 September 2001. Can this still be justified as self-defense in the 'war on terror'? Is there now a wide right of pre-emptive self-defense against armed attacks by non-state actors? The 2006 Israel/Lebanon conflict and the recent intervention of Ethiopia in Somalia raise questions about whether the 'war on terror' has brought major changes in the law on self-defense and on regime change. The 2003 invasion of Iraq gave rise to serious divisions between states as to the legality of this use of force and to talk of a crisis of collective security for the UN. In response the UN initiated major reports on the future of the Charter system; these rejected amendment of the Charter provisions on the use of force. They also rejected any right of pre-emptive self-defense. They advocated a 'responsibility to protect' in cases of genocide or massive violations of human rights; the events in Darfur show the practical difficulties with the implementation of such a duty.

Specific recommendations include: that the Committee commends the Government's encouragement of Overseas Territories in reviewing their constitutions and setting out proposals for reform; that Gibraltar's presence on the UN list of non-self-governing territories is an anachronism; that territory governments should be given the opportunity to pass on their opinions of the candidates for Governor before appointments are made; that the FCO should ensure it takes Overseas Territories' interests into account in its relations with the EU; the Committee recommends that the FCO should strongly encourage all Overseas Territories to introduce freedom of information legislation; that the FCO must ensure that judicial decisions in Overseas Territories should not have any interference either from the Governor or the local government; that discrimination on the basis of sexual orientation or gender status should be made illegal in all Overseas Territories; the Committee believes the Government has been highly negligent in not carrying out a strategic assessment of Overseas Territories funding requirements for conservation and ecosystem managment; that Governors within Overseas Territories should use reserve powers to deal with irregularities, such as money laundering, in offshore financial services (for a related publication, see HCP 4, session 2007-08 NAO: Managing Risk in Overseas Territories). The Committee states that the Government has acted decisively in some Overseas Territories but in some other cases, has been too hands-off (eg. the corruption allegations on the Turks & Caicos Islands). Also that the choice of Governor for a Territory is crucial. Finally, the Committee deplores any retaliatory measures taken against indivduals who have assisted the Committee. Targeting Terrorist Financing argues that it is not the institutions that have failed the war on terrorist financing; rather it is the states that have failed the institutions. The measures contemplated by the world community to interdict terrorists and their financial infrastructures are sufficient to debilitate the terrorists both militarily and financially. However, what has been increasingly lacking is political will among the states, and this has overwhelmed the spirit of cooperation in this very critical front against terrorism. This volume assesses the need for international cooperation and the role of institutions and regimes in targeting terrorist financing. After the 9/11 attacks, there was an expression of global willingness to target terrorism generally, and terrorist financing in particular. The institutional mechanisms that grew out of this are explored in detail here, with a critical examination of the progress made by the international community. The impact of these measures is considered with respect to changes in the nature of the terrorist threat, money confiscated, adoption of international conventions, and global standards by states, and levels of compliance, among others.
