The Committee has set out a number of conclusions and recommendations, including: the Committee believes that the use of plain English in the Draft Legislative Programme is to be commended, and the Government should consider extending the approach to programmed Bills on a trial basis; that the Government's main non-legislative plans should be included in the Draft Legislative Programme, alongside the list of proposed bills, in order that a full programme of government is available for scrutiny; that there is a benefit to be derived from the presentation of the Government's legislative programme as a whole and that the Draft Legislative Programme should be published earlier in the year, preferably before Easter, so that select committee scrutiny and public consultation can be carried out more effectively; that the Draft Legislative Programme should be the subject of a separate debate in Parliament.

Book excerpt: In this report on the Borders, Citizenship and Immigration Bill, the Joint Committee on Human Rights says the Government should reconsider proposed changes to the pathway to British citizenship. Whilst the Bill does not change the underlying position of migrants' access to benefits, it extends the time it takes to get to applying for citizenship by a year. During this period a person given the new 'probationary citizenship' will be ineligible for 15 different types of benefit that are available to those with 'indefinite leave to remain'. The Committee is also concerned that the new rules may be applied retrospectively and urges the Government not to override the legitimate expectations of migrants already on the path to citizenship under the current rules. The Committee also has concerns about the proposed 'short cut' to citizenship, reducing the time it takes to naturalise can by two years if applicants participate in unpaid community activity. Tracking this activity risks infringing people's right to privacy, and the Committee is also concerned that the requirement risks penalising people who are unable to undertake such activities, because of disability or caring responsibilities or because they are already in paid full time work. The Committee welcomes the new positive duty to safeguard and promote the welfare of children in the discharge of immigration, asylum, nationality and customs functions and the reversal of the Government's previous policy of excluding children subject to immigration control from the protection of the UN Convention on the Rights of the Child.

Not all young people thrive in a school or college environment: some find the world of work more stimulating and a better place to learn. The Committee welcomes much of the Government's policy in seeking to raise the standards of apprenticeships, including some of the measures contained within the Draft Apprenticeships Bill. They are not convinced, however, that legislation is strictly necessary to achieve this. The real bite in the Draft Bill lies in the duty to be placed on the Learning and Skills Council (and, in due course, successor bodies), to secure the availability of apprenticeship places for anyone above compulsory school age but under 19, and who holds the necessary entry level requirements. Given the economic downturn, they have grave doubts about whether such a statutory duty can be met. Even if it can, it is feared that the pressure of that duty could lead to the quality of apprenticeships being compromised. The Government's aspiration for a greater supply of apprenticeships and greater diversity of entry to apprenticeships is very much dependent for success on the ability of the public sector to take up the apprenticeship challenge. The Committee also strongly supports group apprenticeship schemes, in which an organisation would have links to smaller firms which, singly, would find it difficult to offer the breadth of experience or continuity of work required for an apprenticeship. Concerns about the impact of the challenging economic circumstances extend beyond apprenticeships. The Government plans to introduce legislation in the 2008-09 Parliamentary Session to transfer responsibility for funding and delivering education and training for 16 to 18-year-olds from the Learning and Skills Council to local authorities. This will be a dramatic change and, caution is strongly urged
