Book Sale of Land in NSW

Download or read book Sale of Land in NSW written by Patricia Lane and published by . This book was released on 2018-04-03 with total page 750 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sale of Land in NSW: Commentary and Materials Sixth Edition analyses the effects of the 2017 standard form of contract for sale of land and the Conveyancing (Sale of Land) Regulation 2017 (NSW) on Conveyancing law and practice. The plain English style, carefully selected extracts and concise approach ensures readers gain a sound working knowledge of the fundamental legal principles of vendor and purchaser law. In the time since the last edition of this book, the law and practice of conveyancing has had to adapt to deal with the changing legal and regulatory environment. There have been three editions of the Standard From Contract in the last three years to deal with the introduction of electronic conveyancing and capital gains withholding for foreign residents, and further increases in the number and type of regulatory matters that affect the quality of land, including the requirement for warnings and vendor disclosure. The intent of this book is still to provide students with a sound introduction to the fundamental concepts of conveyancing law and practice; and to provide practitioners with a first point of reference from which to commence their research. We have sought in this edition to provide some comparative material on aspects of the law of conveyancing in other Australian jurisdictions. One thing that has stood out in preparing this edition has been the variety of standard form contracts in the Australian States and Territories and the extent of differences, both great and subtle, in their legislative regimes. It has not been possible to adopt a systematic review of those regimes, but where possible we have provided references to interstate statutes, or a short comparative commentary. The primary subject of the book, though, is the law of New South Wales. There have not been quite so many new decisions to extract as in the previous edition, but the interaction of principles of property, contract and equity has produced decisions on several practical aspects, such as the implications of providing settlement statements, and the relationship between the purchaser's obligation to submit a transfer and the vendor's obligation to convey

Download or read book The Boundaries of Australian Property Law written by Hossein Esmaeili and published by Cambridge University Press. This book was released on 2016-09-22 with total page 347 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Boundaries of Australian Property Law offers a unique perspective on real property law in Australia. As the overwhelming majority of land interests in Australia now fall under the Torrens title system, this book's particular focus on the development and operation of the Torrens system in Australia is both timely and welcome. Addressing the prescribed Priestly 11 requirements for a property law subject in Australia, this informative and academically rigorous book includes carefully selected statutory material and case law from all Australian jurisdictions, as well as the United Kingdom. The general law system is also discussed and referred to where necessary, to give context and depth to the analysis of real property law. Written by prominent real property law academics from law schools around Australia, and edited by Hossein Esmaeili and Brendan Grigg, this text is a modern and much-needed addition to real property law literature.

Download or read book Residential Construction Law written by Philip Britton and published by Bloomsbury Publishing. This book was released on 2021-07-15 with total page 672 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first book to offer a systematic and analytical overview of the legal framework for residential construction. In doing so, the book addresses two fundamental questions: Prevention: What assurances can the law give buyers (and later owners and occupiers) of homes that construction work – from building of a complete home to adding an extension or replacing a shower unit – will comply with minimum standards of design, safety and build quality? Cure: What forms of redress - from whom, and by what route - can residents expect, when, often long after completion of construction, they discover defects? The resulting problems pose some big and difficult questions of principle and policy about standards, rights and remedies, which in turn concern justice more generally. This book addresses these key issues in a comparative context across the United Kingdom, Ireland, Australia and New Zealand. It is an accessible guide to the existing law for residents and construction professionals (and their legal advisers), but also charts a course to further, meaningful reforms of the legal landscape for residential construction around the world. The book's two co-authors, Philip Britton and Matthew Bell, have taught in the field in the UK, Australia and New Zealand; both have been active in legal practice, as have the book's two specialist contributors, Deirdre Ní Fhloinn and Kim Vernau.

Book Powers of Attorney in Australia and New Zealand

Download or read book Powers of Attorney in Australia and New Zealand written by Berna Collier and published by Federation Press. This book was released on 1992 with total page 470 pages. Available in PDF, EPUB and Kindle. Book excerpt: From a review in the Australian Law Journal:"This book is a delightful surprise, for within its bare title the authors have covered the law concerning powers of attorney on both sides of the Tasman. The text is written in a clear and lucid fashion. It is well laid out, and provides in convenient form the texts of the relevant legislation applying throughout Australia and in New Zealand. It provides an accurate summary of the law as applying at the end of 1992. The index is unusually comprehensive, and the coverage of this area of law is thoroughly professional. It should prove to be a most useful text for practitioners in areas of company law, probate, and family law who will appreciate the specimen forms and clauses offered. It is so wide in its potential utility that (given its sensible price) it should be on every solicitor's bookshelf."

Book A BRIEF ECONOMIC HISTORY OF COLONIAL NSW

Download or read book A BRIEF ECONOMIC HISTORY OF COLONIAL NSW written by Gordon Beckett and published by Trafford Publishing. This book was released on 2012-08-23 with total page 268 pages. Available in PDF, EPUB and Kindle. Book excerpt: Any economic history written in the 21st century of colonial Australia, will highlight the economic gains made by Governor Macquarie, especially in the broad planning approach to efficiently and effectively use convict labour for economic improvement in the colony. Whilst Macquarie tried to make the colony safe and attractive to investors and entrepreneurs, he used the various Government business enterprises, such as the Lumber and Timber Yards, the Stone Quarry and the naval yard, to supplement the gains already accomplished by the Government Farms and the Government Store (the Commissariat) to underpin outstanding economic growth and impressive GDP in the colonial economy. The various aspects of the colonial economy make interesting reading not to mention the comparison of the Aboriginal economy of 1788 with the white economy. The study is a different approach to the colonial economy and is the first of an impressive series of studies of each of the aspects of the economy between 1788 and 1835.
