Toutefois, malgré une consécration presque centenaire, de nombreuses interrogations subsistent. En particulier, les conditions d'existence de cette obligation demeurent incertaines et son utilité est contestée. Faut-il alors décontractualiser cette obligation et soumettre l'ensemble du contentieux relatif à la réparation des dommages corporels aux seules règles de la responsabilité délictuelle ou quasi-délictuelle ? Cette entreprise ne risque-t-elle pas alors d'entraîner à terme un recul des droits de la victime contractante ? Le domaine de cette obligation doit manifestement être réduit. L'existence de l'obligation de sécurité ne se justifie que dans les contrats qui exposent le cocontractant à un risque spécifique lié à la prestation objet de l'obligation principale. Accessoirement, certaines lois spéciales imposent aussi une semblable obligation dans le contrat de travail et le contrat conclu avec une agence de voyage. Afin de mieux la distinguer du devoir de ne pas nuire à autrui, cette obligation devrait d'ailleurs être entendue plus strictement, soit comme une obligation de moyens renforcée, soit comme une obligation de résultat. Les conditions particulières d'existence de cette obligation exercent une influence décisive sur ses traits essentiels. Elle est un rapport contractuel d'origine légale, accessoire à une obligation principale. De plus, seuls les débiteurs professionnels sont en principe tenus d'une telle obligation. Enfin, l'utilité de cette obligation est en général réduite à une simple fonction indemnitaire. L'intérêt du processus de contractualisation de la sécurité est toutefois plus large et intègre une prévention des dommages corporels au sein du contrat. Cette obligation astreint avant tout le débiteur à faire de la sécurité un objectif contractuel avant de constituer un fait générateur de responsabilité contractuelle.

La première partie est consacrée à la question de la stabilité du contrat et de l'équilibre des rapports contractuels. Elle tente d'abord de cerner la question de la stabilité du contrat, commençant par l'aspect général du principe de la lutte contre les clauses abusives et la nécessité de créer de nouvelles règles afin de protéger le contractant le plus faible et de sauvegarder le contrat. Au XXIe siècle, les structures classiques du droit des contractants n'arrivent plus à assurer ces deux impératifs la sûreté et la sécurité. Ainsi un critère législatif, complété par un critère jurisprudentiel, cherche à déterminer les clauses qui peuvent être sanctionnées, mettant ainsi fin aux tentatives de banalisation qu'a subi le mécanisme de la lutte contre les clauses abusives. Ce travail a ensuite pour objet le contenu de cette protection composé d'un mécanisme de lutte contre les clauses abusives et des institutions réalisant cette lutte, marqué par l'ascension du juge. La deuxième partie de l'étude est consacrée aux avancées réelles de la loi n° 95-96 du 01er février 1995, car son champ d'application matériel comme son champ d'application personnel souffrent d'incertitude et d'imprécision, qui sont dues à l'indétermination de son support matériel et aux caractères imprécis des clauses incriminées, pour le premier, à l'ambiguïté des textes de la loi du 1er février 1995 et à une jurisprudence incertaine à propos des personnes concernées, pour le deuxième. Elle analyse également les nouveaux domaines ou la loi de 1995 peut intervenir, par exemple le contrat de service afin d'exploiter au maximum les potentielles de cette loi.

Book excerpt: The reactivation of the Security Council at the beginning of the last decade has resulted, since the invasion of Kuwait by Iraq on August 2, l990, in increasing use of its powers under Chapter VII of the Charter and the adoption of measures against a number of state and non-state entities. The notion of a threat to the peace has now come to encompass violations of fundamental norms of international law such as human rights and humanitarian law, and the wide-ranging measures adopted have included such innovations as the establishment of the UN Compensation Commission or that of the two international criminal tribunals for Former Yugoslavia and Rwanda. These measures have not only infringed on the legal rights of the targeted state (sometimes with irreversible effects where they have remained in force over a long period of time) and its population, but also on those of implementing states and of private rights within these states. The current debate over the legitimacy and long-term effects of economic sanctions on states and their populations makes it imperative to re-evaluate this instrument and the broader peace maintenance function of the Security Council in the light of current community concerns. Part One of this book addresses the theoretical issues by focussing on: 1) The place of sanctions in the international legal system; 2) the limits to the powers of the Security Council and the question of accountability; and 3) an assessment of the alternatives to collective economic sanctions. Part Two looks at the relationship between sanctions and humanitarian issues, examining the relationship between: 1) Sanctions and human rights law; 2) sanctions, humanitarian issues and mandates; and 3) sanctions and humanitarian law. Part Three focuses on implementation by states of Security Council sanctions resolutions by examining: 1) Sanctions and private rights; and 2) special problems for implementing states. Part Four addresses the future in reassessing the place and ethics of sanctions in an international legal system which is giving increased importance to the individual. This work is based on papers presented at a colloquium of the Graduate Institute of International Studies in Geneva.

They are often applied in varying degrees in various legal systems to a rather wide range of contract cases when certain issues arise issues such as abuse of rights, unfairness, good faith, fairness of duty or loyalty or honesty, duty of care, and other such contract terms not lending themselves readily to clear or permanent definition. Here for the first time is a systematic discussion of this kind of rule in the evolving and dynamic context of European contract law. A collection of twelve insightful essays by leading European law authorities, the book is based on a conference organized jointly by the Society of European Contract Law (SECOLA) and l'association Henri Capitant, held in the `grande salle' of the French Supreme Court in Paris in 2005. The subject is approached along three distinct but interconnected avenues: comparative contract law, in which the different models to be found among Member States particularly the Germanic, French, and English common law systems are explored with an eye to differences and common ground;EC contract law, in which the general clause approach has tended to focus on labour law and consumer law, and in which the European Court of Justice more and more assumes the final say; andthe European codification dimension, in which a potential instrument on the European level would compete with national laws and develop closely with them.
