Book Forging Alberta s Constitutional Framework

Download or read book Forging Alberta s Constitutional Framework written by Richard Connors and published by University of Alberta. This book was released on 2005-11 with total page 575 pages. Available in PDF, EPUB and Kindle. Book excerpt: Forging Alberta’s Constitutional Framework analyzes the principal events and processes that precipitated the emergence and formation of the law and legal culture of Alberta from the foundation of the Hudson’s Bay in 1670 until the eve of the centenary of the Province in 2005. The formation of Alberta’s constitution and legal institutions was by no means a simple process by which English and Canadian law was imposed upon a receptive and passive population. Challenges to authority, latent lawlessness, interaction between indigenous and settler societies, periods (pre- and post-1905) of jurisdictional confusion, and demands for individual, group, and provincial rights and recognitions are as much part of Alberta’s legal history as the heroic and mythic images of an emergent and orderly Canadian west patrolled from the outset by red coated mounted police and peopled by peaceful and law-abiding subjects of the Crown. Papers focus on the development of criminal law in the Canadian west in the nineteenth century; the Natural Resources Transfer Agreement of 1930; the National Energy Program of the 1980s; Federal-Provincial relations; and the role and responsibilities of the offices of Justices of the Peace and of the Lieutenant-Governor; and the legacies of the Lougheed and Klein governments.

Book International Criminal Procedure

Download or read book International Criminal Procedure written by Göran Sluiter and published by OUP Oxford. This book was released on 2013-03-21 with total page 2646 pages. Available in PDF, EPUB and Kindle. Book excerpt: International Criminal Procedure: Principles and Rules is a comprehensive study of international criminal proceedings written by over forty leading experts in the field. The book offers a systematic overview and detailed comparison of the standards governing the conduct of proceedings in all major international and internationalized criminal courts from the Nuremberg and Tokyo Tribunals to the recently established Cambodian Extraordinary Chambers and the Special Tribunal for Lebanon. Based on a major research project, the study covers all procedural phases from the initiation of investigation to the appeals process. It pays special attention to the crosscutting themes which shape the contemporary discourse on international criminal justice, including the law of evidence, the defence issues, the procedural role of victims, and negotiated dismissal of international crime cases. The book not only takes stock of the procedural legacy of the UN ad hoc Tribunals for the former Yugoslavia and Rwanda and the International Criminal Court, but also reflects on the future directions of international criminal procedure. Investigating the tribunals' procedural law and practice through the prism of human rights law, domestic legal traditions, and tribunals' special objectives, the expert group puts forth proposals on how the challenges facing international criminal jurisdictions can best be met. International Criminal Procedure will be an indispensable work for practitioners involved in the adjudication of serious crimes on both national and international level, as well as international law students and academics.

Book Canadian State Trials Volume IV

Download or read book Canadian State Trials Volume IV written by Barry Wright and published by University of Toronto Press. This book was released on 2015-11-26 with total page 544 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fourth volume in the Canadian State Trials series examines the legal issues surrounding perceived security threats and the repression of dissent from the outset of World War One through the Great Depression. War prompted the development of new government powers and raised questions about citizenship and Canadian identity, while the ensuing interwar years brought serious economic challenges and unprecedented tensions between labour and capital. The chapters in this edited collection, written by leading scholars in numerous fields, examine the treatment of enemy aliens, conscription and courts martial, sedition prosecutions during the war and after the Winnipeg General Strike, and the application of Criminal Code and Immigration Act laws to Communist Party leaders, On to Ottawa Trekkers, and minority groups. These historical events shed light on contemporary dilemmas: What are the limits of dissent in war, emergencies, and economic crisis? What limits should be placed on government responses to real and perceived challenges to its authority?

Book Beverley McLachlin

Download or read book Beverley McLachlin written by Ian Greene and Peter McCormick and published by James Lorimer & Company. This book was released on 2019-09-16 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: As a judge, Beverley McLachlin has had an unequalled impact on Canadian life. She stands out for her unique ability to stand up for the values and beliefs that reflect the best of Canada and Canadians. As chief justice, she led the way to assisted suicide legislation, far greater recognition of aboriginal rights and title, allowing safe injection sites for drug users and many other changes that have had a dramatic impact on Canadian life. Less well known is her work to modify the way the Supreme Court judges work together to emphasize collegiality and to encourage judges on the court to pay closer attention to real-world information about the issues they are considering. Her courageous action to defend the independence of the court and her own personal integrity when it was attacked by Stephen Harper — an incident discussed and documented fully in this book — underlines her strength of character and integrity. This book sketches Beverley McLachlin's experiences growing up in rural Alberta, attending university, becoming a lawyer and then a judge. At a time when governments were seeking qualified women for senior positions in Canada's courts, she was selected by politicians, both Liberal and Conservative, to fill progressively higher positions. Ian Greene and Peter McCormick focus on her time on the Supreme Court offering readers a balanced, informed perspective on the role she defined for herself, remarkable for her prodigious work and the clarity of her decisions. Their background as leading Canadian writers on the role of the judiciary in Canada allows them to offer an independent and readable appreciation of her contributions to Canadian life.

Book Constitutional Amendment in Canada

Download or read book Constitutional Amendment in Canada written by Emmett Macfarlane and published by University of Toronto Press. This book was released on 2016-08-12 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Canada, the 1982 Constitution Act contains the amending formula, which outlines a set of procedures required to make changes to the constitution. Recent debates over Senate reform, the status of the Supreme Court of Canada, and the rules governing royal succession have highlighted how important the amending formula is in maintaining the vitality and relevance of the governing system. Constitutional Amendment in Canada is the first volume to focus solely on the implications of the amending formula in Canada. Emmett Macfarlane has brought together a group of expert authors to address such topics as the difficulties of constitutional reform, the intersection of various levels of government and the judiciary, and the ability of the public to veto proposed changes. Filling a serious gap in the literature, Constitutional Amendment in Canada is an authoritative study of the historical and contemporary implications of the amending formula.

Book Trade and Commerce

Download or read book Trade and Commerce written by Malcolm Lavoie and published by McGill-Queen's Press - MQUP. This book was released on 2023-02-15 with total page 186 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent decades, the economic framework of Canada’s Constitution has been a subject largely neglected by judges, scholars, and commentators. Trade and Commerce fills this gap by bringing to light a lost understanding of how the Constitution structures economic relations. As Malcolm Lavoie reveals, the Constitution includes foundational commitments to property rights, local government autonomy, and the principle of subsidiarity. At the same time, it creates a platform for integrated national markets with secure channels for interprovincial trade. This economic vision remains a vital part of Canada’s constitutional order and is relevant to a purposive interpretation of the Constitution. But contemporary legal discourse has begun to lose touch with this vision, with regrettable consequences in a number of different policy areas. Exploring the implications of the economic Constitution in the context of contemporary issues – including disputes over interprovincial trade and jurisdictional tensions between federal, provincial, and Indigenous governments with respect to the environment and the economy – Trade and Commerce restores economic ideas to the forefront of constitutional thinking in Canada.
