First, after decades of restrictive import policies, several countries began to liberalize their trade and investment regimes. Then, beginning a decade ago, numerous bilateral and sub-regional trade agreements were achieved, to serve as vital complements to domestic reforms and to foster trade flows among member countries. At the Second Summit of the Americas in 1998, negotiations among 34 democracies were launched to establish the Free Trade Area of the Americas (FTAA). This report takes stock of the remarkable progress to date in the development of free trade in the Western Hemisphere. It examines trade flows between countries in the same regional groupings and between members of different sub-regional arrangements. The report describes the main characteristics of the trade arrangements signed between countries of the Hemisphere and explores the development of trade rules in these arrangements. Finally, the report details recent advances in the construction of the FTAA.

Book excerpt: This comprehensive book resents a thorough guide on interpreting the complex Rules of Origin in the NAFTA and how to apply those rules in completing the NAFTA Certificate of Origin which is needed to qualify goods for free or preferential duty rates in Canada, Mexico, or the United States. Exporters may be subject to additional duties and fees for goods that don't qualify for NAFTA upon entry of the goods into one of the three NAFTA countries. The entire Annex 401 "Specific Rules of Origin" which contains over 100 pages is included in this book. The six general rules of origin (A through F) are all presented in an easy to read format with examples of how a product may qualify under each of the rules. Simple formulas are presented in how to calculate regional value content under the net cost or transaction value methods. Regional value content (minimum percentage) is required for some of the rules which represent the percentage of North American content in the good. Specific provisions of NAFTA are included which cover how to treat accessories, spare parts, tools, retail and shipment packaging. The NAFTA Certificate of Origin and continuation sheet is covered with a complete chapter on the most frequent questions and answers for completion of this mandatory form for NAFTA qualification. There are addresses and procedures for each of the three NAFTA Countries to request NAFTA Advance Rulings. NAFTA Advance Rulings are issued by the Customs Service in reply to whether a product qualifies for NAFTA and the correct rule, correct country of origin marking, and verification of regional value content calculations. The audit process is also covered from origin verifications to appeal procedures. The country of Origin in Marking Rules for all three countries are covered as well as required record keeping and penalties. An entire chapter is devoted to the maquiladora (assembly) industry in Mexico and changes which took place on January 1, 2001 with simple examples explaining each of those changes.
