Book excerpt: Private Military and Security Companies (PMSCs) have constituted a perennial feature of the security landscape. Yet, it is their involvement in and conduct during the ongoing wars in Iraq and Afghanistan that have transformed the outsourcing of security services into such a pressing public policy and world-order issue. The PMSCs’ ubiquitous presence in armed conflict situations, as well as in post-conflict reconstruction, their diverse list of clients (governments in the developed and developing world, non-state armed groups, intergovernmental and non-governmental organizations, and international corporations) and, in the context of armed conflict situations, involvement in instances of gross misconduct, have raised serious accountability issues. The prominence of PMSCs in conflict zones has generated critical questions concerning the very concept of security and the role of private force, a rethinking of "essential governmental functions," a rearticulation of the distinction between public/private and global/local in the context of the creation of new forms of "security governance," and a consideration of the relevance, as well as limitations, of existing regulatory frameworks that include domestic and international law (in particular international human rights law and international humanitarian law). This book critically examines the growing role of PMSCs in conflict and post-conflict situations, as part of a broader trend towards the outsourcing of security functions. Particular emphasis is placed on key moral, legal, and political considerations involved in the privatization of such functions, on the impact of outsourcing on security governance, and on the main challenges confronting efforts to hold PMSCs accountable through a combination of formal and informal, domestic as well as international, regulatory mechanisms and processes. It will be of interest to scholars, policymakers, practitioners and advocates for a more transparent and humane security order. This book was published as a special issue of Criminal Justice Ethics.

However, commercially-oriented entities have long been protagonists within the prevailing international legal order, concluding contracts and resolving disputes with governments. Is the international legal personality of corporations undergoing further qualitative transformations ? Corporations influence the State practice constitutive of custom and create, refashion or challenge normative rules. The corporate willingness to fill legal lacunae where governments do not exercise their full regulatory responsibility is also observable through resort to alternative legal mechanisms. Corporations moreover contribute directly to treaty negotiations and occupy crucial roles during subsequent implementation. Indeed, an analysis of the access conditions and participatory modalities for non-State actors could support a right to participate under common international procedural law. Their substantive contributions are also evident when corporations participate in enforcing international law against governments through national courts, diplomatic protection (including the WTO) and arbitration (including NAFTA). However, the practice of intergovernmental organizations reveals several challenges including managing corporate interaction with developing country governments and other non-State actors. Acknowledging corporate contributions also has important implications for national regulatory autonomy, the ability of governments to mediate contested policy issues, the democratic legitimacy of the contemporary lawmaking process and an understanding of consent as the underlying basis for international law.

For the past four decades, almost every real-world event of any consequence has been traced to the supposedly omnipresent influence of neoliberalism. Instead, this book argues that states across the world have actually grown in scope and reach. The authors in this volume contest the view that the past three decades have been marked by the diminution of the state in the face of neoliberalism. They argue instead that we are witnessing a new phase of state formation, which revolves around hybrid rule—that is, a more expansive form of state formation that works through privatization and seeks pacification and depoliticization as instrumental to enhancing state power. Contributors argue that that the process of hybridization, and hybrid rule point towards a convergence on a more authoritarian capitalist regime type, possibly, but not necessarily, more closely aligned with the Beijing model—one toward which even the United States, with its penchant for surveillance and discipline, appears to be moving. The work focuses on and compares the activities of the US companies Blackwater and Dyncorp. Despite sharing several important characteristics, such as working for the same client (the US State Department) during the same time period, the employees of Blackwater fired their weapons far more often, and killed and seriously injured far more people in Iraq than their counterparts in DynCorp. In order to explain this disparity, the book undertakes the most comprehensive analysis ever attempted on the use of violence by the employees of these firms. Based on extensive empirical research, it offers a credible explanation for this difference: Blackwater maintained a relatively bellicose military culture that placed strong emphasis on norms encouraging its personnel to exercise personal initiative, proactive use of force, and an exclusive approach to security, which, together, motivated its personnel to use violence quite freely against anyone they suspected of posing a threat. Specifically, Blackwater’s military culture motivated its personnel to fire upon suspected threats more quickly, at greater distances, and with a greater quantity of bullets, and to more readily abandon the people they shot at when compared to DynCorp’s personnel, who maintained a military culture that encouraged far less violent behaviour. Utilizing the Private Security Company Violent Incident Dataset (PSCVID), created by the author in 2012, the book draws upon data on hundreds of violent incidents involving private security personnel in Iraq to identify trends in the behaviour exhibited by the employees of different firms. Based on this rich and original empirical data, the book provides the definitive study of contemporary private security personnel in the Iraq War. This book will be of much interest to students of the Iraq War, Private Security Companies, Military Studies, War and Conflict Studies and IR in general.

Book excerpt: This book’s primary concern is the application of International Humanitarian Law and International Human Rights Law in addressing the business conduct of Private Military and Security Companies (PMSCs) during armed conflicts, as well as state responsibility for human rights violations and current attempts at international regulation. The book discusses four interconnected themes. First, it differentiates private contractors from mercenaries, presenting an historical overview of private violence. Second, it situates PMSCs’ employees under the legal status of civilian or combatant in accordance with the Third and Fourth Geneva Conventions of 1949. It then investigates the existing law on state responsibility and what sort of responsibility companies and their employees can face. Finally, the book explores current developments on regulation within the industry, on national, regional and international levels. These themes are connected by the argument that, in order to find gaps in the existing laws, it is necessary to establish what they are, what law is applicable and what further developments are needed.
