Available in PDF, EPUB and Kindle. Book excerpt: Law in Northern Ireland is the essential textbook for all students of Northern Ireland's legal system. Changes to this new edition – some of them substantial – have been made to every section, taking full account of five years of developments. The book explores the evolution of law-making in Northern Ireland before going on to explain the relevant constitutional arrangements, how to identify and interpret applicable sources of law, and what are the fundamental rules and principles of public law, criminal law and private law, highlighting where appropriate what may be unusual about them. It contextualises the myriad of legal institutions operating in the jurisdiction, sets out how criminal and civil proceedings work in practice and provides useful information on how people become lawyers, what lawyers actually do once they become qualified and how the legal system is funded. The appendices set out some sample sources of law so that readers can familiarise themselves with what is involved in handling legal documents. The language throughout is accessible and there are Tables of Cases and Legislation, as well as a comprehensive index.

Download or read book Drink and drug driving law written by Great Britain: Parliament: House of Commons: Transport Committee and published by The Stationery Office. This book was released on 2010-12-02 with total page 152 pages. Available in PDF, EPUB and Kindle. Book excerpt: 18% of all drivers killed in road accidents are over the drink-drive limit (In 2007, based on coroners' data.) but only approximately 3% of drivers in the UK are stopped and tested for alcohol compared to the European average of 16%.. This report calls for the police to be given an additional power to permit preliminary breath tests as part of any designated drink drive enforcement operation. Currently, the police may stop any vehicle but can only test the driver's breath if there is an element of suspicion. There is concern that a reduction in the blood alcohol concentration limit would send out mixed messages but that the aimed for effectively zero limit is too great a step at present. Instead, concentration should be on stricter enforcement of the current limit and public education. It is felt that the success of Great Britain's drink driving policy to date is largely attributable to the deterrent effect of the current 12-month mandatory disqualification penalty and the Committee supports retaining that penalty. The committee also calls for the improvement of the detection of drug driving and to strengthen public perception about the likelihood of drug drivers being caught by the police. The Government's commitment to install drug screening devices in every police station by 2012 is welcomed though this interim measure should not eclipse the Government's aim over the medium-term to develop and type-approve a drug screening device for use at the roadside, drawing on relevant experience of doing this in the other parts of the world

Download or read book The Government of Risk written by Christopher Hood and published by Oxford University Press, USA. This book was released on 2001 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: Why does regulation vary so dramatically from one area to another? Why are some risks regulated aggressively and others responded to only modestly? Is there any logic to the techniques we use in risk regulation? These key questions are explored in The Government of Risk. This book looks at a number of risk regulations regimes, considers the respects in which they differ, and examines how these differences can be explained. Analysing regulation in terms of 'regimes' allows us to see the rich, multi-dimensional nature of risk regulation. It exposes the thinness of society-wide analyses of risk controls and it offers a perspective that single case studies cannot reach. Regimes analysis breaks down the components of risk regulation systems and shows how these interact. It also shows how different parts of the same regime may be shaped by different factors and have to be understood in quite different ways. The Government of Risk shows how such an approach is of high policy relevance as well as of considerable theoretical importance.

Download or read book A Practical Guide to the Insurance Act 2015 written by David Kendall and published by Taylor & Francis. This book was released on 2017-09-22 with total page 180 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Insurance Act 2015 ('the Act') is the first comprehensive statutory reform of the insurance law of the United Kingdom since the Marine Insurance Act 1906. It introduces thorough and, in some cases, fairly drastic reform of some of the core tenets of UK insurance law, including: the insured’s pre-contractual duty to the insurer, and remedies for its breach; the knowledge of the insured and the insurer for the purposes of the pre-contractual duty; the effect of insurance warranties and other terms tending to reduce the risk of loss; fraudulent claims; and damages for failure to pay an insurance claim in a reasonable time. This book is a thorough introduction to the Act. It focuses primarily on the impact of the Act on English law as applied to non-consumer insurance and reinsurance. Of assistance not only to insurance lawyers and members of the judiciary, but also underwriters, claims handlers, brokers and buyers of non-consumer insurance policies, this book covers each of the core changes brought about by the Act. It also analyses the particular ways in which the Act differs from existing law, by reference to the Marine Insurance Act 1906, and cases decided under the old law.
