In The Long Reach of the Sixties, eminent legal historian Laura Kalman focuses on the period between 1965 and 1971, when Presidents Johnson and Nixon launched the most ambitious effort to do so since Franklin Roosevelt tried to pack it with additional justices. Those six years-- the apex of the Warren Court, often described as the most liberal in American history, and the dawn of the Burger Court--saw two successful Supreme Court nominations and two failed ones by LBJ, four successful nominations and two failed ones by Nixon, the first resignation of a Supreme Court justice as a result of White House pressure, and the attempted impeachment of another. Using LBJ and Nixon's telephone conversations and a wealth of archival collections, Kalman roots their efforts to mold the Court in their desire to protect their Presidencies, and she sets the contests over it within the broader context of a struggle between the executive, judicial and legislative branches of government. The battles that ensued transformed the meaning of the Warren Court in American memory. Despite the fact that the Court's work generally reflected public opinion, these fights calcified the image of the Warren Court as "activist" and "liberal" in one of the places that image hurts the most--the contemporary Supreme Court appointment process. To this day, the term "activist Warren Court" has totemic power among conservatives. But by the mid-1970s, postwar liberalism was in a shambles: while its commitment to pluralism remained, its economic policies had been abandoned, and the Democratic Party, its primary political vehicle, was collapsing. Schiller attributes this demise to the legal architecture of postwar liberalism, arguing that postwar liberalism's goals of advancing economic egalitarianism and promoting pluralism ultimately conflicted with each other. Through the use of specific historical examples, Schiller demonstrates that postwar liberalism was riddled with legal and institutional contradictions that undermined progressive politics in the mid-twentieth-century United States.

This was the last piece of advice on a list Will Thurmond gave his son Strom in 1923. The younger Thurmond would keep the words in mind throughout his long and colorful career as one of the South's last race-baiting demagogues and as a national power broker who, along with Barry Goldwater and Ronald Reagan, was a major figure in modern conservative politics. But as the historian Joseph Crespino demonstrates in Strom Thurmond's America, the late South Carolina senator followed only part of his father's counsel. Political skill was the key to Thurmond's many successes; a consummate opportunist, he had less use for integrity. He was a thoroughgoing racist—he is best remembered today for his twenty-four-hour filibuster in opposition to the Civil Rights Act of 1957—but he fathered an illegitimate black daughter whose existence he did not publicly acknowledge during his lifetime. A onetime Democrat and labor supporter, he switched parties in 1964 and helped to dismantle New Deal protections for working Americans. If Thurmond was a great hypocrite, though, he was also an innovator who saw the future of conservative politics before just about anyone else. As early as the 1950s, he began to forge alliances with Christian Right activists, and he eagerly took up the causes of big business, military spending, and anticommunism. Crespino's adroit, lucid portrait reveals that Thurmond was, in fact, both a segregationist and a Sunbelt conservative. The implications of this insight are vast. Thurmond was not a curiosity from a bygone era, but rather one of the first conservative Republicans we would recognize as such today. Strom Thurmond's America is about how he made his brand of politics central to American life.
