The city's most notorious astrologer--Orazio Morandi, abbot of the monastery of Santa Prassede--was brought before the governor's court on charges of possessing prohibited books, fortune telling, and political chicanery. His most serious crime was to have predicted the death of Pope Urban VIII and allowed news of this to spread as far as Spain, where cardinals quickly embarked for Italy to attend a conclave that would not occur for fourteen years. The pope, furious at such astrological and political effrontery, personally ordered the criminal inquiry that led to Morandi's arrest, trial, and death in prison, probably by assassination. Based on new evidence, this book chronicles Morandi's fabulous rise and fall against the backdrop of enormous political and cultural turmoil that characterized Italy in the early seventeenth century. It documents a world in which occult knowledge commanded power, reveals widespread libertinism behind monastery walls, and illuminates the arduous metamorphosis of intellectual culture already underway. It also sets the stage for, and lends new understanding to, the trial of Galileo that would follow shortly. The mystery of Morandi concerns the basic compulsion to advance in a status-drenched society and the very nature of knowledge at the birth of science. Told here in colorful detail, Morandi's story is fascinating in its own right. Beyond that, it allows us to glimpse the underside of early modern high society as never before.

Book excerpt: This book investigates the actions of marriage tribunals by analyzing the richest source of marriage suits extant in Italy, those of the Venetian ecclesiastical tribunal, between 1420 and the opening of the Council of Trent. It offers a strongly representative overview of the changes the Council introduced to centuries-old marriage practices, relegating it to the realm of marginality and deviance and nearly erasing the memory of it altogether. From the eleventh century onward, the Church assured itself of a jurisdictional monopoly over the matter of marriage, operating both in concert and in conflict with secular authorities by virtue of marriage’s civil consequences, the first of which regarded the legitimacy of children. Secular tribunals were responsible for patrimonial matters between spouses, though the Church at times inserted itself into these matters either directly, by substituting itself for the secular authority, or indirectly, by influencing Rulings through their own sentences. Lay magistratures, for their part, somewhat eroded the authority of ecclesiastical tribunals by continuing to exercise autonomous jurisdiction over marriage, especially regarding separation and crimes strictly connected to the nuptial bond and its definition, including adultery, bigamy, and rape.

In the context of transition from authoritarian rule to democratic state, Brazil has produced a significant literature on the challenges and shortcomings of the transition, but little attention has been given to the role of law and legal actors/institutions. Different approaches focus on the legal mechanisms, discourses and practices used by the military regime and by the players involved in the political transition process in Brazil. A comparative perspective that takes into account different political transitions – and their legal consequences – in Europe and Latin America complements the analysis. Part 1 (4 essays) discusses some of the central issues of political transition and legal history in contemporary Brazil, focusing on the time of the transition (and its effects on transitional justice) with different perspectives, from racial and gender issues to constitutional reform and police repression. Part 2 (3 essays) brings the comparative studies on South American experiences. Part 3 (4 essays) analyses different cases of transition to democracy in Chile, Portugal, Spain and Italy. Book excerpt: The book “Criminal proceedings, languages and the European Union: linguistic and legal issues” – the first attempt on this subject – deals with the current situation in the jurislinguistic studies, which cover comparative law, language and translation, towards the aim of the circulation of equivalent legal concepts in systems which are still very different from one another. In the absence of common cultures and languages, in criminal procedure it is possible to distinguish features that are typical of common law systems and features that are typical of civil law systems, according to the two different models of adversarial and inquisitorial trials. Therefore, the most problematic challenges are for the European Union legislator to define generic measures that can be easily implemented at the national level, and for the individual Member States to choose corresponding domestic measures that can best implement these broad definitions, so as to pursue objectives set at the European level. In this scenario, the book assesses the new framework within which criminal lawyers and practitioners need to operate under the Lisbon Treaty (Part I), and focuses on the different versions of its provisions concerning cooperation in criminal matters, which will need to be implemented at the national level (Part III). What is the articulation of removal, reclamation and consequently the implementation of devices and the establishing of prevention practices? Why are the majority of victims and also the control agency professionals seemingly resigned to these ignored insecurities? Following more than 20 years of research in the area, the authors examine these questions and how the securitisation of society has been exacerbated. They argue that the primary cause of the increase in ignored insecurities is the consequence of the neoliberal turn in security governance. This book proposes an innovative approach to security governance, not only through a serious analysis of the balance of the costs and benefits, but also highlighting what is here termed `ignored insecurities'. The authors propose a review of the problems, showing that the governance of security is a crucial element of the contemporary political organisation of society.
