Updated as of May 29, 2018 This action finalizes changes to the Environmental Protection Agency's (EPA) emissions inventory reporting requirements. This action lowers the threshold for reporting lead (Pb) emissions sources as point sources, eliminates the requirement for reporting emissions from wildfires and prescribed fires, and replaces a requirement for reporting mobile source emissions with a requirement for reporting the input parameters that can be used to run the EPA models that generate emissions estimates. This action also reduces the reporting burden on state, local, and tribal agencies by removing the requirements to report daily and seasonal emissions in their submissions under this rule, while clarifying the requirement to report these emissions under pollutant-specific regulations. Lastly, this action modifies some emissions reporting requirements which we believe are not necessary for inclusion in the Air Emissions Reporting Requirements (AERR) rule or are not clearly aligned with current inventory terminology and practices. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Book excerpt: GAO reviewed selected data collection and reporting requirements of the 1990 Clean Air Act Amendments, focusing on whether: (1) the Environmental Protection Agency's (EPA) planned state emissions reporting requirements exceed its program needs; and (2) states use the EPA Aerometric Information Retrieval System (AIRS) to monitor emissions data. GAO found that: (1) EPA draft regulation would have required states to submit emissions data that exceeded its minimum air pollution program needs and to develop complicated pollutant databases that they could not afford; (2) EPA has since suspended the regulation and is considering alternative reporting options; (3) despite EPA intentions, 9 of the 10 heavy emission states use their own independently developed systems to track air pollution emissions; and (4) the state tracking systems are more efficient and easier to use than AIRS.

The Laboratory has the potential to emit 100 tons per year of suspended particulate matter (PM), nitrogen oxides (NO(subscript x)), carbon monoxide (CO), and volatile organic compounds (VOCs). For 1997, combustion products from the industrial sources contributed the greatest amount of regulated air emissions from the Laboratory. Research and development activities contributed the greatest amount of VOCs. Emissions of beryllium and aluminum were reported for activities permitted under 20 NMAC 2.72, Construction Permits.

The applicability of the requirements is based on the Laboratory's potential to emit 100 tons per year of suspended particulate matter, nitrogen oxides, carbon monoxide, sulfur oxides, or volatile organic compounds. For calendar year 2003, the Technical Area 3 steam plant and the air curtain destructors were the primary sources of criteria air pollutants from the Laboratory, while the air curtain destructors and chemical use associated with research and development activities were the primary sources of volatile organic compounds and hazardous air pollutants. Emissions of beryllium and aluminum were reported for activities permitted under 20.2.72 NMAC. Hazardous air pollutant emissions were reported from chemical use as well as from all combustion sources. In addition, estimates of particulate matter with diameter less than 2.5 micrometers and ammonia were provided as requested by the New Mexico Environment Department, Air Quality Bureau.
