Book Cambridge Yearbook of European Legal Studies Vol 9 2006 2007

Download or read book Cambridge Yearbook of European Legal Studies Vol 9 2006 2007 written by Catherine Barnard and published by Bloomsbury Publishing. This book was released on 2007-12-18 with total page 598 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Cambridge Yearbook of European Legal Studies provides a forum for the scrutiny of significant issues in EU Law, the Law of the Council of Europe, and Comparative Law with a 'European' dimension, and particularly those issues which have come to the fore during the year preceding publication. The contributions appearing in the collection are commissioned by the Centre for European Legal Studies (CELS) Cambridge, a research centre in the Law Faculty of the University of Cambridge specialising in European legal issues. The papers presented are all at the cutting edge of the fields which they address, and reflect the views of recognised experts drawn from the University world, legal practice, and the civil services of both the EU and its Member States. Inclusion of the comparative dimension brings a fresh perspective to the study of European law, and highlights the effects of globalisation of the law more generally, and the resulting cross fertilisation of norms and ideas that has occurred among previously sovereign and separate legal orders. The Cambridge Yearbook of European Legal Studies is an invaluable resource for those wishing to keep pace with legal developments in the fast moving world of European integration. Book Television without frontiers

Download or read book Television without frontiers written by Great Britain: Parliament: House of Lords: European Union Committee and published by The Stationery Office. This book was released on 2007-02-05 with total page 226 pages. Available in PDF, EPUB and Kindle. Book excerpt: The draft Audiovisual Media Services (AMS) Directive, published in December 2005, was met with some alarm. It sought to extend the existing 'Television without Frontiers' Directive to new services which were seen to be competing for audience and revenue. In doing so it would have introduced inappropriate regulation on the new media sector. There have now been some changes to the original draft and a tightening of the definition of "television like" services. Although an improvement, the Committee is concerned that there is still not enough legal certainty. They are also worried about the need to defend the 'Country of Origin' approach to single market legislation and reject the idea that regulators should act to preserve the market dominance of existing players from new entrants. They are also unconvinced of the need for any quantitative restriction on advertising.

Download or read book Regulatory Impact Assessment written by C. H. Kirkpatrick and published by Edward Elgar Publishing. This book was released on 2007 with total page 299 pages. Available in PDF, EPUB and Kindle. Book excerpt: The practice of regulatory impact assessment has long needed a critical evaluation. This volume, which is interdisciplinary and international, and combines academic and practitioner insights, hits the spot to great effect. Colin Scott, UCD College of Business and Law and UCD School of Law, Ireland Better state regulation is a key component of economic reform. This is the first book to comprehensively explore international experience in the use of Regulatory Impact Assessment (RIA), which involves assessing the potential benefits and costs of any regulatory change. The contributors reveal that RIA is being adopted by an increasing number of countries as a route to better regulation with varying degrees of success. The book includes contributions from leading experts on regulatory reform and introduces a range of case studies from developed, developing and transitional economies. Comprehensive in its approach, this book contributes to the literature on evidence-based decision making as part of the new public management. By rigorously examining the principles of better regulation and focusing on the problem of applicability and adoption of RIA practices around the world, it will greatly aid understanding of regulatory policy design and implementation. The book will be invaluable for academics and researchers of public policy and management in developed, developing and transitional countries. It will also be of great practical relevance to government administrators and policymakers challenged by the need to understand the scope and limitations of RIA.

Book European Financial Services Regulation

Download or read book European Financial Services Regulation written by Great Britain: Parliament: House of Commons: Treasury Committee and published by The Stationery Office. This book was released on 2006-06-08 with total page 148 pages. Available in PDF, EPUB and Kindle. Book excerpt: The EU's ambitious Financial Services Action Plan, started in 1999, is drawing to an end. A single market in wholesale financial services exists. Many retail financial services institutions are expanding through acquisitions of banks and insurers across Europe, though the prospect of a single market in such services, with comparable products and services available to consumers direct across borders, is not a realistic proposition in the near future. The Commission has set out its policy objectives for 2005-2010, attaching greater importance to consistent and workable implementation of existing legislation. The Committee welcomes this, and the commitment to ensure that any new regulation will have a clear benefit to the European economy. The Committee examined three specific case studies: implementation of the Markets in Financial Instruments Directive (MiFID), the consideration of a Clearing and Settlement Directive, and consideration of mortgage credit in the context of the development of a single market in retail financial services. In all the Commission will need to demonstrate its commitment to "better regulation", and its new focus on implementation and enforcement. The Committee is concerned that MiFID will not be implemented consistently across Europe. It finds that the case for a new mortgage directive remains unproven, and that there is a clear need to reduce the additional costs associated with clearing and settlement across borders.

Download or read book Lost in Translation written by Great Britain: National Audit Office and published by The Stationery Office. This book was released on 2005-05-26 with total page 86 pages. Available in PDF, EPUB and Kindle. Book excerpt: Much European Community law, in the form of directives and regulations, needs to be given effect by domestic legislation in UK law, a process referred to as "transposition". This report focuses on the way the Department for Environment, Food and Rural Affairs - which is responsible for implementing some 30 per cent of all Community law - handles this transposition, though the findings will have wider application to other government departments. Implementation in full and on time has to be balanced with the UK Government's policy of avoiding unnecessary over-implementation (known as "gold-plating"). Getting transposition wrong can incur avoidable costs for taxpayers, industry and consumers, and lead to adverse environmental effects. The report examines: accuracy in understanding and interpreting Community law; timeliness of transposition and implementation; and communication with key players. The report points to good practice examples from Defra, praises the Department for establishing a Task Force and Better Regulation Team to examine and improve procedures, and makes a number of additional recommendations. Case studies are used to illustrate the difficulties and problems encountered in the transposition procedure.
