Book excerpt: The relationship between the national and international has been central in the debate on the impact of globalisation on national patterns of employment relations. While some industrial relations researchers in recent years have put forward evidence not of convergence, but rather of continuing national diversity in employment relations, others see a complex power-sharing interplay emerging for which Europe is the laboratory. This ground-breaking book asks: Do EU or European industrial relations exist? What characterises EU industrial relations and their development? What are the differences between EU industrial relations and national industrial relations? Twelve outstanding authorities from seven countries discuss the theme from a variety of perspectives. Originally presented at an international and interdisciplinary research workshop held at the Faculty of Law at Lund University in November 2007, the essays probe a range of highly topical and important legal and industrial relations issues and developments, including the implications of the epochal and much-debated Laval and Viking cases from the European Court of Justice. The focus is on the EU dimension of industrial relations, common to the Member States, and not on comparative European industrial relations. The authors raise and discuss such crucial issues as the following: the power relationship and interactions between the social partners within the framework of the social dialogue; growing problems of posting of workers, low wage competition, and ‘social dumping’; approaches to creating an EU legal framework for transnational collective agreements; the right to take industrial action in order to achieve collective agreements; the fundamental asymmetry between the scope of action of players in companies and territories affected by restructurings; information, consultation and worker participation; potential benefits of increased tripartite co-operation between the social partners and governments; compatibility of the Swedish or Nordic system with the four freedoms and its eligibility as a European model; and issues of private international law arising from collective actions with transnational implications. An appendix includes relevant EC legislation and the ECJ opinions in Laval and Viking. EU Industrial Relations vs National Industrial Relations explores an emerging and still inchoate realm of law that is heavily fraught with implications for the near future of social relations, not only in Europe but worldwide. French culture and institutions, they argued, inhibited the changes in economic structure that sustained growth would require. But in spite of these predictions and the occasional volatility of the world economy, the French economy grew rapidly. Only the Japanese, of the major economies, has grown faster, and by 1975 the French standard of living matched that of West Germany. Restructuring the French Economy looks at the four decades of the structural changes that fostered growth and explores explanations of why such changes occurred. Drawing on many and diverse primary materials, including government statistics, judicial decisions, and professional memoirs, Adams examines three different explanations of France's postwar economic success. The first downplays the extent of structural change during the surge of growth. The second emphasizes the importance of government policies to compensate for inadequate private initiative. The third suggests that European economic integration and French decolonization created enough market competition to push the private sector into its own restructuring. Adams stresses that if government initiatives worked well, they did so in an environment of strong market competition; if competition seemed to work wonders, it occurred only as a result of government actions. He also devotes considerable attention to the implications of his findings for U.S. policy concerning European protectionism and the health and growth of American industries.

Die hier vorgestellten ausgewählten Länderstudien belegen, dass der Trend in Richtung rein gewerkschaftlicher Interessenvertretungen geht. Gerät damit das britische und nicht das deutsche Modell zum Orientierungspunkt einer Ausgestaltung des «sozialen Dialogs» in Europa? Der vorliegende Band, der Beiträge von Arbeitsrechtlern, Sozialwissenschaftlern sowie von Vertretern von Unternehmerverbänden und Gewerkschaften enthält, soll Orientierungspunkte für die Beantwortung dieser Frage liefern. Les directives européennes, qui respectent les traditions des Etats-membres d'Europe occidentale, doivent servir, dans le cadre de l'élargissement de l'UE, à garantir des standards minimaux en droit social dans les pays nouvellement intégrés, notamment en accordant des droits d'information et de consultation aux salariés. Cela conduit-il au transfert d'un certain type de « modèle européen » de participation des salariés aux processus décisionnels des entreprises ? Or, il n'existe pas en la matière de modèle unique en Europe de l'Ouest. La discussion relative à l'harmonisation des droits des salariés en Europe est donc marquée par l'existence parallèle de différentes traditions nationales. Les études présentées dans cet ouvrage révèlent que la tendance est aux systèmes de représentation d'émanation syndicale. Ne serait-ce donc pas plutôt le système britannique que le système allemand qui servirait désormais de référence dans l'élaboration d'un « dialogue social » en Europe ? Des spécialistes du droit du travail et des sciences sociales ainsi que des représentants d'organisations patronales et syndicales, proposent ici des points de repère pour analyser ce phénomène.
