The key legal question of the initiative is how access and use rights in industrial data, as a digital resource, should be defined and allocated in order to achieve the objectives of the EU data-driven economy. This analysis focuses on the proposals for new rights in industrial data and takes a methodological perspective of designing a regulatory intervention. The overall argument is that the 'intervention logic' behind the presented proposals for a data producer's right does not appear straightforward, and that keeping the scenario of non-intervention by such rights might not be the least optimal option among the possible 'ways forward'

Eventually, it proposes insights about why public rules are needed, what kind of rules could be more effective, fair, and efficient, and who should pose and enforce them. The book is opened by an introduction, dealing with Digital Transformation, Big Techs, and Public Policies, which provides a general conceptual and thematic framework to the following analysis but could be also read as a stand-alone paper. The following chapters are grouped in two parts: I. The Evolution of Digital Markets and Digital Rights, and II. Regulating Big Tech’s Impact on Market and Society. The secondary title - the European approach – has a twofold meaning. It highlights the fact that this work has a clear focus on EU law and policy - although the economic and institutional issues addressed are global phenomena, common to all world’s economies. In addition, it also underlines that European digital policy is not yet complete and effective. This book intends to provide a small contribution to the ongoing policy making process, as well as to the wider academic and policy debate.

Book excerpt: The recently published Communication on “Building a European Data Economy” (COM(2017)9) clearly highlights the increasing importance of data as a driver for growth, innovation and job creation. It is estimated that by year 2020, the value the EU data economy will increase to EUR 643 billion, representing over 3% of the EU GDP. At the same time there is no comparable and quantifiable evidence on the current state and the future perspectives of the data driven economy in the European Union neighbouring countries. It can however safely be assumed that the role of data will be following a similar pattern, and is therefore expected to be contribution to an increasing relative share of GDP. Furthermore, some European neighbouring countries, most notably those in Central and Eastern Europe, are a recognised destination for IT businesses that grow two to three times faster than in their economy of origin. Within this context, a workshop was co-organized by the World Bank, the UN Economic Commission for Europe (UNECE), the Food and Agriculture Organization of the United Nations (FAO) and the Joint Research Centre of the European Commission (JRC). The workshop took place on 05 September as part of the annual INSPIRE Conference in 2017 (co-organised in Strasbourg and Kehl by France and Germany). The workshop explored the challenges and possibilities related with Data driven economy in Central and Eastern Europe. All the presentation of attendees are available online. The rapidly emerging spatial data infrastructures (SDI) were used as a use case to have a better insight into the data economy as they address a broad spectrum of topics that relate to the legal, technological and organisational challenges towards the use and reuse of data. Particular emphasis was put on good practices that if re-used and extended, can further foster innovation and intensify growth. This JRC technical report summarises the outcomes of the WB/UNECE/FAO/JRC workshop. It includes (i) overview of relevant processes on the global and European agenda, (ii) good practices from countries in the target region on the value-added from data that provide indications future policy directions and emerging opportunities.

The data economy is not a new sector, but more like a challenge for all firms to compete and innovate as part of a new wave of economic value creation.With data playing an increasingly important role across all sectors of the economy, the results of this report point European policymakers to promote the development and adoption of unified reference architectures. These architectures constitute a technology-neutral and cross-sectoral approach that will enable companies small and large to compete and to innovate-unlocking the economic potential of data capture in an increasingly digitized world.Data access appears to be less of a hindrance to a thriving data economy due to the net increase in capabilities in data capture, elevation, and analysis. What does prove difficult for firms is discovering existing datasets and establishing their suitability for achieving their economic objectives. Reference architectures can facilitate this process as they provide a framework to locate potential providers of relevant datasets and carry sufficient additional information (metadata) about datasets to enable firms to understand whether a particular dataset, or parts of it, fits their purpose.Whether third-party data access is suitable to solve a specific business task in the first place ought to be a decision at the discretion of the economic actors involved. As our report underscores, data captured in one context with a specific purpose may not be fit for another context or another purpose. Consequently, a firm has to evaluate case-by-case whether first-party data capture, third-party data access, or a mixed approach is the best solution. This evaluation will naturally depend on whether there is any other firm capturing data suitable for the task that is willing to negotiate conditions for third-party access to this data. Unified data architectures may also lower the barriers for a firm capturing suitable data to engage in negotiations, since its adoption will lower the costs of making the data ready for a successful exchange. Such architectures may further integrate licensing provisions ensuring that data, once exchanged, is not used beyond the agreed purpose. It can also bring in functions that improve the discoverability of potential data providers.

On January 10, 2017, the EU Commission published a Communication entitled "Building a European Data Economy", which presents various ideas and proposals for legal framework conditions in connection with the European data economy. Besides a Europe-wide cross-border data flow, liability aspects of autonomous systems and Internet of Things applications as well as portability and interoperability of non-personal data and standards, access and transmission of data is also being discussed there. A working paper complements this Communication. From the point of view of competition law, two main questions derive from this paper for a data access: • First, it must be clarified whether there can be any right of access to data from an antitrust point of view (A.). • Secondly, insofar as such access is to be granted, this access relationship is still to be specifically designed (B.).
