Inoltre è stata introdotta una disciplina incentrata sulla figura del figlio, con il superamento del tradizionale concetto di potestà in favore della RESPONSABILITÀ GENITORIALE. Sono state dettate nuove norme in tema di riconoscimento, azioni di stato, PROVA DELLA FILIAZIONE, inserimento del figlio nato fuori del matrimonio nella famiglia del genitore, specificazione della nozione di abbandono, diritto internazionale privato, in parte recependo gli orientamenti nel tempo maturati nella giurisprudenza costituzionale e di legittimità. Sono state specificamente regolamentate le forme con le quali gli ascendenti possono far valere il loro diritto a mantenere rapporti significativi con i nipoti minorenni e le modalità con cui deve essere realizzato L’ASCOLTO DEL MINORE, privilegiando la spontaneità e genuinità delle relative dichiarazioni. È stato ribadito il fondamentale diritto del figlio di vivere e crescere nella propria famiglia di origine e sono state introdotte importanti modifiche in materia di successione mortis causa. - Dai filii iusti o legitimi ed i figli naturales o vulgo concepti alla equiparazione della filiazione legittima e naturale. Le decisioni della Corte europea dei diritti dell’uomo- La legge 10 dicembre 2012, n. 219 recante le “Disposizioni in materia di riconoscimento dei figli naturali”.
