Book excerpt: Le marché européen de l’assurance s’est construit de manière classique à partir des grands principes de liberté d’établissement et de libre prestation de services. L’harmonisation ne s’y est toutefois réalisée que de manière imparfaite : en dépit d’un encadrement renforcé des professionnels – s’agissant notamment de la réglementation prudentielle et de la distribution –, le droit des assurances demeure, en effet, un droit essentiellement national. Si le contrat d’assurance doit donc respecter certaines règles uniformes au niveau européen, destinées à la protection du preneur, il demeure régi principalement par les lois nationales. Néanmoins, plusieurs évolutions tempèrent ce constat. La crise économique et financière de 2008, qui n’a pas épargné le secteur de l’assurance, même s’il n’a pas été le plus touché, a suscité des interrogations. Elle a ainsi mis en évidence les insuffisances de la régulation européenne et montré combien était nécessaire un encadrement harmonisé de la matière. Les produits d’assurance peuvent en effet s’apparenter à des produits d’investissement – c’est le cas de certains contrats d’assurance-vie – et exposer le preneur à un risque de perte ; dans ce contexte, le législateur européen a procédé à un alignement progressif de la régulation du secteur de l’assurance sur celui des secteurs bancaire et financier, s’agissant notamment de la lutte contre le risque systémique. Il a ainsi, par exemple, mis en place un régime propre aux produits d’investissement fondés sur l’assurance. Au-delà de cette dimension financière, qui modifie en profondeur le droit européen des assurances, on peut constater l’influence grandissante de la réglementation européenne dite horizontale, issue du droit de la concurrence, du droit de la consommation, du droit fiscal, etc., qui s’applique au contrat d’assurance et le modèle indirectement. Le droit européen des assurances se trouve en outre confronté aux événements géopolitiques récents, en particulier au Brexit, ainsi qu’aux grands débats de société que sont le développement des technologies digitales (blockchain, intelligence artificielle), l’enjeu crucial du développement durable ou encore le vieillissement de la population, auquel le législateur a apporté récemment une réponse par la création du label «PEPP», désignant les produits paneuropéens d’épargne-retraite individuelle. Autant de défis qui contribueront à façonner le droit européen des assurances de demain.

It provides a comparative analysis based on national reports from countries with common law and civil law traditions in Asia, America and Europe, and presents the reports in the form of chapters that have been drafted on the basis of a questionnaire, and which use the same structure as the questionnaire to allow them to be easily compared. The book starts with an analysis of the basic assumptions underlying the current consumer protection models and examines whether and how consumer models adapt to the new market conditions. The second part addresses the information obligations themselves, first highlighting the differences in the reported countries before narrowing the analysis down to countries with a general pre-contractual information duty, particularly the transparency requirements that often come with such a duty. The next part examines recent developments in the law on food labelling, commercial practices and unfair contract terms in order to identify whether similar traits can be found in European and non-European jurisdictions. The fourth part of the book focuses on specific information obligations in the financial services and e-commerce sectors, discussing the fact that legislators are experimenting with different forms of summary disclosures in these sectors. The final part provides a critical appraisal of the recent developments in consumer information obligations, addressing the question of whether the multiple criticisms from behavioural sciences necessitate abandonment or refinement of current consumer information models in favour of new, more adequate forms of consumer protection, and providing suggestions.

Book excerpt: The Violence of Modernity turns to Charles Baudelaire, one of the most canonical figures of literary modernism, in order to reclaim an aesthetic legacy for ethical inquiry and historical critique. Works of modern literature are commonly theorized as symptomatic responses to the trauma of history. In a climate that tends to privilege crisis over critique, Debarati Sanyal argues that it is urgent to rethink literary experience in terms that recall its contestatory potential. Examining Baudelaire's poems afresh, she shifts the focus of critical attention toward an account of modernism as an active engagement with violence, specifically the violence of history in nineteenth-century France. Sanyal analyzes a literary current that uses the traditional hallmarks of modernism—irony, intertextuality, self-reflexivity, and formalism—to challenge the historical violence of modernity. Baudelaire and the committed ironists writing in his wake teach us how to read and resist the violence of history, and thereby to challenge the melancholy tenor of our contemporary "wound culture." In a series of provocative readings, Sanyal presents Baudelaire's poetry as an aesthetic form that contests historical violence through rhetorical strategies of complicity, counterviolence, and critique. The book develops a new account of Baudelaire's significance as a modernist by dislodging him both from his traditional status as a practitioner of "art for art's sake" and from his more recent incarnation as the poet of trauma. Following her extended analysis of Baudelaire's poetry, Sanyal in later chapters considers a number of authors influenced by his strategies—including Rachilde, Virginie Despentes, Albert Camus, and Jean-Paul Sartre—to examine the relevance of their interventions for our current climate of trauma and terror. The result is a study that underscores how Baudelaire's legacy continues to energize literary engagements with the violence of modernity.
