Book excerpt: Excerpt from Reports of Decisions in Criminal Cases, Vol. 2: Made at Term, at Chambers, and in the Courts of Oyer and Terminer of the State of New York Walworth, Circuit Judge, said the day laid in the indictment was not material, and the offence may be proved to have been committed on any other day, before or after that time. The jury, without leaving the bar, acquitted the prisoner on the merits. The People vs. William Winters. A husband has no right to beat his wife or to inflict corporal punishment upon her; but he may defend himself against her, and may restrain her from acts of violence towards himself or towards others. The prisoner was indicted for an assault and battery on his wife. It appeared on the trial that the prisoner attempted to correct one of his children, and that his wife interfered and made such a noise as to alarm the neighborhood. She testified that he struck her on the head with his hand, and bruised her severely. C. Nichols, for the prisoner, contended that the husband had a right to give his wife moderate correction. J. Palmer, (District Attorney, ) for the people. Walworth, Circuit Judge, said a husband has no right to heat his wife or to inflict punishment upon her. But he may defend himself against her, and may restrain her from acts of violence towards himself or towards others, for he is accountable for her acts which injure others. The jury being satisfied by other testimony that the prisoner had done nothing more than was necessary to defend himself, in this case, rendered a verdict of not guilty. The judge charged that if the husband was present at the time the intent to commit the offense was formed, the law presumed she acted under his compulsion; but if she formed the intent to commit the crime and actually commenced its consummation in his absence and without his knowledge, the fact that he afterwards arrived and aided in completing it did not create the presumption that she acted under his compulsion, and that whether the wife acted under the compulsion of her husband was a question for the jury. On writ of error brought by the prisoner, held, that the charge was not erroneous. In an indictment for robbery in tho first degree, the prisoner was charged with taking "bank bills of banks, to tho jurors unknown, and of a number and denomination to the jurors aforesaid unknown, of the value of forty-nine dollars, &c., &c.," and the allegation was held to be sufficient. Book excerpt: Excerpt from Reports Decisions in Criminal Cases, Vol. 5: Made at Term, at Chambers and in the Courts of Oyer and Terminer of the State of New York The judges of a Court of Oyer and Terminer have no power to settle and sign a bill of exceptions after a final adjournment of such court. Where, after the adjournment of a Court of Oyer and Terminer, a bill of exceptions in a criminal case which had been tried at such court, was settled by the justice of the Supreme Court, who had presided on the trial, and was afterward signed by such justice, and also by the two justices of the Sessions, who sat with him on the trial, and was filed more than ten days after such adjournment, and was afterward returned as part of the record on a writ of error, this court, on motion by the District Attorney, ordered the bill of exceptions to be struck from the record. Motion by the District Attorney of Otsego county, to dismiss writ of error, and strike the bill of exceptions from the return or record in this cause. The prisoner was convicted of forgery in the second degree, and sentenced to the state prison at Auburn, for the term of six years, at a Court of Oyer and Terminer, held in Otsego county, on the first day of July, 1859.
