Book Report on Legislation Regulation and Policies Relevant to the Ocean Environment in the Beaufort Sea

Download or read book Report on Legislation Regulation and Policies Relevant to the Ocean Environment in the Beaufort Sea written by IMG-Golder Corporation and published by . This book was released on 2008 with total page 63 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Integrated management of Canada's estuaries, coasts and oceans is guided by Fisheries and Oceans Canada's (DFO) national Policy and Operational Framework for Integrated Management of Estuarine, Coastal and Marine Environments in Canada (National Policy and Operational Framework) .... In keeping with the Canada's Oceans Strategy and the National Policy and Operational Framework, DFO introduced the Beaufort Sea Integrated Management Planning Initiative (BSIMPI) to develop and implement an Integrated Ocean Management Plan for the Beaufort Sea Large Ocean Management Area (LOMA). The multi-year, strategic level plan will provide long-term direction and a common basis for integrated, ecosystem-based and adaptive management of all marine activities. The Canadian Beaufort Sea LOMA has been chosen for the application of integrated ocean management because it contains important living and non-living marine resources, areas of high biological diversity and productivity, and increasing levels of multiple use and competition for space and resources .... The objective of this document is to identify key regulatory frameworks that apply to key ocean use sectors. Areas of regulatory overlap and strategies for future management objectives will be identified. This information can be used by stakeholders with interests and activities in key ocean use sectors to raise their awareness of relevant legislation, key policies and permitting requirements relating to the Beaufort Sea area. Key ocean use sectors are best described as important ocean activities and trends occurring in the Ocean Management Area .... Key ocean use sectors applicable to the Beaufort LOMA are: Culture and Subsistence; Fisheries; Marine Conservation and Protection; Marine Science and Technology; Marine Transportation; Marine Defence; Oil and Gas; and Recreation and Tourism. ... Considerable regulatory overlap currently exists in terms of the environmental assessment process in the Beaufort Sea region, with up to three levels of review existing for proposed projects. ... Navigating the legislation, regulations and agreements governing activities in the Beaufort Sea can be a complex task. When seeking project approvals, permits and licences, there may be multiple federal government departments, territorial government departments and Aboriginal groups to contact .... With each governing body, there may exist unique regulatory processes, and legislated terms and conditions that must be met. For proponents, this can lead to increased costs and an increased risk of regulatory duplication. Where possible, a "single window" regulatory approach should be implemented such that proponents need only contact a single regulatory authority for a given type of approval, e.g. permits and licences for oil and gas exploration and operations, or environmental impact assessments. When a "single window" approach is not possible, it would be recommended that federal authorities participate in the development of guides for the various permitting processes related to activities conducted in the Beaufort Sea. Such guides have been developed for oil and gas exploration for areas throughout Canada with the support from INAC, Natural Resources Canada, provincial governments and industry stakeholders .... There appears to be philosophical agreement among stakeholders on the need to implement an integrated resource management approach for the Beaufort Sea. Current efforts in the region, such as DFO's Beaufort Sea Integrated Management Planning Initiative, will improve regulatory efficiency through multi-stakeholder participation and horizontal and vertical integration of decision processes"--ASTIS [online] database.

Book The Environmental Rule of Law for Oceans

Download or read book The Environmental Rule of Law for Oceans written by Froukje Maria Platjouw and published by Cambridge University Press. This book was released on 2023-02-28 with total page 415 pages. Available in PDF, EPUB and Kindle. Book excerpt: Our oceans need a strong and effective environmental rule of law to protect them against increased pressures and demands, including climate change, pollution, fisheries, shipping and more. The environmental rule of law for oceans requires the existence of a set of rules and policies at multiple governance levels that appropriately regulate human activities at sea and ensure that pressures on the marine ecosystem are tackled effectively. Adhering to the rule of law through clear, predictable, coherent, and legitimate rules, and their implementation and enforcement, is timely and urgent. In this book, we are searching for ways to improve, strengthen and further develop the environmental rule of law for oceans. The book provides future-oriented perspectives on how law should evolve to better preserve the oceans. All chapters incorporate novel insights and ideas for legal solutions that might inspire scholars, actors, authorities, citizens and communities around the globe. This title is Open Access.

Book Canadian Oceans Policy

Download or read book Canadian Oceans Policy written by Don M. McRae and published by UBC Press. This book was released on 2011-11-01 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book deals with Canada's oceans management policies since the conclusion of the 1982 Convention of the Law of the Sea. That Convention set out a jurisdictional framework for the management of the world's oceans, but it did not provide states with precise guidance on all the issues that can arise. As a state with one of the world's longest coastlines, Canada was one of the principal beneficiaries under the 1982 Convention regime. A study of Canadian policy is particularly significant, as Canadian oceans management places in relief many of the difficult questions yet to be resolved.

Available in PDF, EPUB and Kindle. Book excerpt: "Oceans Policy: New Institutions, Challenges and Opportunities" draws attention to three new international institutions created by the 1982 Convention on the Law of the Sea. The International Seabed Authority located in Jamaica governs global activities to convert polymetallic resources into reserves of metal. The Legal Counsel for the Authority provides the first public review of the Authority's draft Mining Code containing the rules, regulations, and procedures for deep seabed mining. The second institution dealt with is the International Tribunal for the Law of the Sea. Professor Louis Sohn outlines several innovative uses of advisory opinions available to the Tribunal while the President of the Tribunal reports on a busy first year of work by this new institution located in Hamburg. Other items discussed are the jurisdiction of the Tribunal and its working methods, including its rules, proceedings and internal procedures. The third international institution established to implement the 1980 Convention is the Commission on the Limits of the Continental Shelf beyond 200 nautical miles. An explanation is given of the geographical context for the development of the legal concept of the Continental Shelf. The principal problems that the Commission must resolve are summarized, in particular with respect to the definition in the Convention of the outer limit of the Continental Shelf. The fourth part of this work is focused on the global challenges posed by drug trafficking in the Caribbean region. The international legal framework governing intercepting illegal drug shipments at sea is analyzed. Recent counter-drug initiatives undertaken at the International Maritime Organization are thenreviewed. The book also contains discussion of the growing threat to ocean freedom posed by piracy and armed robbery at sea, as well as the increasing problems in reconciling the rules for salvage of shipwrecks and underwater archeology. The publication is based on a conference held in Jamaica that was organized by the Center for Oceans Law and Policy, University of Virginia School of Law.
