It would centralize and simplify the administrative design registration process of obtaining design registration in member countries. The Hague Agreement (1960 text), administered by WIPO, serves this function for 20 member countries, but it has limitations that prevent wider membership. One purpose of this report is use as a working document by U.S. organizations preparing for the third meeting of experts. Another use is to publicize information about the second meeting of experts. This introduction contains background information on the draft treaty, including an explanation of how the draft treat system would operate, from the point of view of U.S. design owners. Relevant sections from the draft treaty (DT) and the second meeting report (R) are cited with each topic discussed in the following text of the article.

Book excerpt: The Hague Agreement Concerning the International Deposit of Industrial Designs (Hague Agreement) offers a cost effective way to obtain international design protection, but it has certain provisions that have prevented adherence by the U.S. to any of its versions. It was my privilege to represent the American Bar Association, Section of Patent, Trademark and Copyright Law (ABA) at the third meeting of experts on the development of a revised text for the Hague Agreement (Draft Act). This meeting was held at the World Intellectual Property Organization (WIPO) in Geneva, Switzerland, on April 26 to 30, 1993. In addition to serving as a report on the third meeting, this article should serve as a working document to help prepare for the next meeting of experts. Another feature of this report is a detailed review of the protection cost under the Draft Act. It is very important that design owners and practitioners understand the tremendous opportunity for relatively low cost international design protection provided by the Hague Agreement. It is this greater “bang” for your design protection the money that attracts a lot of U.S. interest in the Hague Agreement revision. Third meeting highlights are presented in section II, followed by a brief description, in section III, of the proposed system including a helpful diagram. The topics on which agreement has been reached, in principle, are listed in section IV. Major issues needing further discussion are reviewed in section V. Fees for typical protection situations are discussed in section VI. The report conclusion, section VII, summarizes the steps needed to complete successfully the Draft Act. The primary document for the third meeting was the WIPO Draft Act containing the proposed articles and explanatory notes. All citations in this report will be to that document, unless otherwise stated. WIPO prepared a report on the meeting that is quite useful. The accomplishments of the second meeting of experts, held in 1992, are reviewed in my recent article that is a very helpful source of background information.

Book excerpt: The development of a revised intellectual property treaty is a long and challenging process, even with the guidance of the World Intellectual Property Organization (WIPO). A group of experts from governments, intergovernmental organizations and non-government organizations meet annually, usually, with WIPO providing a draft text. Technical aspects of draft text provisions are not the only challenges. Political changes occur that can influence the direction and pace of successful treaty revision. Revision of the Hague Agreement for the International Deposit of Industrial Designs (Hague Agreement) is a good case study to illustrate this process. The Hague Agreement revision remains the best avenue for developing a centralized system for filing industrial design applications and establishing uniformity in procedures. The first four meetings, starting in 1991, were very efficient, with most of the technical aspects resolved. The fifth meeting of experts turned its attention to more political aspects, primarily the topic of benefits from adherence to the revised treaty. This article is divided into two main parts. Sections II-IV review the progress made at the fifth meeting on technical aspects, assuming an understanding of prior developments. Sections V-XII analyze the benefits issues, in a realistic perspective, and offer a method and specific proposals for completing the treaty revision. Background information for the treaty work is provided in Sections XII and XIII, respectively, on the second annual Hague Agreement User Meeting and an update of current Hague Agreement use by U.S. related companies.

Perhaps one of the most important events is the European Community (“BC”) work on a design protection system (“Community Designn”). Hugh Griffiths' conference paper gives an excellent review of that project. The Community Design proposal has been a lightning rod and catalyst for industrial design law issues, both legal and political. It has increased the level of interest and activity on industrial design protection around the world. I was privileged to be at the Max Planck Institute for Patent, Copyright and Competition Law during the time the basic EC proposal was being developed. I continue to study this proposal, for several reasons. It offers an excellent insight on how many current issues concerning industrial design protection may be resolved in the United States and in other countries. The primary purpose of this paper is to present another major industrial design law development, the revision of the Hague Agreement Concerning the International Deposit of Industrial Designs (“Hague Agreement”). It is a treaty that can bring the world closer together on design protection. I have been privileged to represent the American Bar Association (“ABA”), Section of Patent, Trademark and Copyright Law, and the American Intellectual Property Law Association (“AIPLA”) at the first two meetings of experts on the Hague Agreement revision. I will represent the ABA at the upcoming meeting on April 26-30, 1993. In addition, this paper will discuss. briefly, other major international design protection developments.
