Book excerpt: The Richard Commission was established in July 2002 to examine the adequacy of the powers and electoral arrangements of the National Assembly of Wales. The report considers: the history of the Assembly's establishment and its international context; the attitudes of the Welsh public towards the Assembly; its role and structure; the scope of its devolved powers; scrutiny of unelected public bodies; the relationship between the Welsh Assembly Government and the UK Government at ministerial and official level; the boundaries of devolution and the implications of extending the Assembly's powers; and financing devolution in Wales. Based on their evaluation of the evolving constitutional arrangements in Wales over the past four years, the Commission's report concludes that the status quo does not provide a sustainable basis for the future development of devolved government in Wales. It sets out a recommended model for a legislative Assembly for Wales (with primary law-making powers) which it is argued will improve both public accountability and clarity of governance. Although there would continue to be areas where the competence of the UK Government and that of the legislative Assembly overlap, the burden of proof would benefit devolution, with matters not specifically reserved to the UK falling within the competence of the Assembly. Devolved matters would include fields of health, education, housing, tourism and transport. These reforms will require new primary legislation, a Wales Bill, and the report sets out a proposed timetable for implementation of the model by 2011. Tax-varying powers are regarded as desirable but not essential to the exercise of primary legislative powers. Other recommendations include a change of the single unitary Assembly body to a separate executive and legislature; an increase in the number of Assembly members to 80; and a change in voting methods (to the single transferable vote system of PR).
