Book excerpt: The Asia-Pacific Fishery Commission (APFIC) was established in 1948 and has undergone various reforms since then to adapt to the changing international governance of fisheries as well as reforms in the function and resourcing of FAO’s regional fishery bodies. This gradually induced a major crisis in the commission’s ability to develop and execute a work programme for servicing its members. The 36th Session of the Asia-Pacific Fishery Commission, held in May 2021, recognized the pressing issues of financial unsustainability and FAO's declining willingness and ability to provide Regular Programme funding for commission activities. It recommended the establishment of an 'ad hoc working group on the future of APFIC' to analyse issues and explore possible options to advise the commission on its future. In a majority, the ad hoc working group recommended to support temporary suspension of the commission, in the light of questionnaire responses and the limited prospects for identifying financial resources for the activities of the commission. It prepared a draft resolution regarding suspension for consideration by the 37th session and recommended that suspension of the commission should be for a period five years. Noting that some Member Countries supported continuation, the ad hoc working group also prepared a draft resolution for continuation of the activities of the commission, should this be the decision of the 37th session. The text of this resolution incorporates specific reference to the establishment of a financial arrangement to support the work programme of the commission.

With some of the largest economies, and generally high economic growth rates compared to the rest of the world, it is unsurprising that East and South-East Asia has become the subject of global interest. East Asia’s rise inevitably focuses attention on the issue of China’s emergence as a regional and global power. Such a prospect challenges the current status quo, in which the region is dominated by the USA and its regional allies, and issues in Sino-US strategic relations have raised global awareness of the need to understand this pivotal region better. In addition, the Taiwan issue continues to evoke nationalist sentiments in China, and North Korea continues to threaten regional stability. Non-traditional (or alternative) security issues are also of major importance in the region, including natural disasters and epidemics, as well as challenges relating to human rights and governance, transnational crime, demographic issues, economics and trade and regionalism. This Handbook aims to offer an insight into these issues. The volume is divided into two main sections. The first, International Relations and Security Perspectives, will focus on the international relations of the region, paying special attention to the key state players. The chapter contributions will examine the security perspectives, and foreign and defence policies of these states, as well as key bilateral relationships. The second section will examine key Regional Non-traditional Security Issues, including globalization, transnational health challenges, population growth and the environment.

Book excerpt: The United Nations Convention on the Law of the Sea (UNCLOS) offers a legal framework for the sustainable development of the oceans and their natural resources. However, recently there have been calls to amend the Convention due to some ambiguous provisions which are unable to address a variety of contemporary maritime issues. This book evaluates the applicability and effectiveness of UNCLOS as a settlement mechanism for addressing ocean disputes. The book’s central focus is on the South China Sea (SCS) dispute, one of the most complex and challenging ocean-related conflicts in the world. The book examines the ways in which an emphasis on sovereignty, threats to maritime security and overlapping maritime claims caused by the newly established maritime regimes authorized by UNCLOS are all contributing factors to the SCS dispute. The book considers the internal coherence of the Law of the Sea Convention regime and its dispute settlement procedures. It looks at participation in the UNCLOS negotiations, maritime legislation, and the dispute settlement practice of relevant States party to the SCS dispute. The author goes on to explore the relationship between UNCLOS and the regimes and institutions in the SCS, particularly in regard to issues of maritime security, marine environment protection, joint development of oil and gas and general political interaction. The author proposes practical mechanisms to resolve the dispute whilst also offering a final judgement on the effectiveness of UNCLOS for settling disputes.
