Book excerpt: Excerpt from Report of the Attorney General of the State of California, 1910 Acting upon such advice, the Surveyor General has since refused to file applications for the purchase of lands of such character. Early in the year 1908 my attention was called to the fact that many years ago patents had been issued by the State to various individuals and corporations, conveying to them practically the entire bed of Wilmington Bay, as well as the tide lands bordering upon the channel leading from Wilmington Bay to the Pacific Ocean. Entertaining grave doubts as to the validity of these patents and the power of the State to issue them, I commenced some twelve actions in the name of the People in the Superior Court of Los Angeles County, with the object of securing a judgment canceling such patents. In October and November, 1909, these cases were tried, briefed, and submitted, and decisions are due. Should the State be successful in these cases, it will follow that Wilmington Bay will be released from all claims of private ownership, and the benefits of a free public harbor secured to southern California. An action of similar character, involving a part of the water front of the city of Vallejo, Solano County, is pending in the Superior Court of said county, awaiting the decision in the San Pedro cases. Grand Trunk Western Railway Co. vs. Curry. Lewis vs. Curry. These cases involved the constitutionality and operation of the Corporation License Tax Law. The first case above cited was instituted in the Circuit Court of the United States and the second was an original proceeding in the Supreme Court of this State. In both courts, the contentions of the State, as to the constitutionality and operation of the law, were fully sustained. Pullman Company Tax Cases. Since my last report, two additional actions have been instituted against the Pullman Company to recover delinquent taxes. These actions were filed, one in June, 1909; another June, 1910. In support of the State's claim, much testimony has been taken by deposition, and the cases are set for trial in December. They involve about $100,000.00 of tax money. The defendant is contesting the cases, claiming a lack of jurisdiction in the State Board of Equalization to assess it. Alameda County vs. Nye. This case involves a claim on the part of Alameda County against the State for some $62,000.00. The claim is based upon the wording of sections 3696 and 3713 of the Political Code as those sections read prior to 1909, the contention being that the term "costs of collection," as used therein, was intended to act as an appropriation to repay to the various counties of the State the expense sustained in collecting State taxes by the county authorities. Book excerpt: Excerpt from Report of the Attorney-General of the State of California: 1891-1892 Of the reversals 2 percent were occasioned by reason of the Federal Census of 1890, which showed that the jurisdiction of the Superior Court had ceased in cases commenced therein, the Supreme Court reversing the cases on that ground. On account of the small percentage of reversals by the Supreme Court, appeals in criminal cases diminished forty in number during the time covered by this report, relieving the Supreme Court of that amount of criminal work. The case of People vs. McNulty, a murder case, pending when I took office, has occasioned the Supreme Court and this office a great deal of work and trouble. Four opinions have been rendered by the Supreme Court in the case since January 5, 1891. It was first argued upon the theory that the instructions of the Court below, upon the subject of insanity as a defense, were erroneous - not in accordance with law. This point was easily overcome; the instructions were proper, and the Court affirmed the doctrine that when an accused murderer sets up insanity as a defense, the burden of the proof that he was insane at the time of the commission of the deed rests upon him. Afterwards a rehearing was granted on defendant's contention that the new execution law, passed March 30, 1891, had the effect of increasing the punishment for murder, and that it repealed the former law, and that by reason of the increased punishment provided for by the new law the defendant could not be executed under that law, and the old law having been repealed, the defendant could not be executed at all. This point was fully discussed and briefed by me on part of the State, and the Court held that the execution law of 1891 was unconstitutional, and that the defendant should be executed under the law in existence at the time the deed was committed. Another rehearing was granted. The matter was again discussed, and the Court's attention was called to Section 329, Political Code. It was finally held that the old statute was not repealed as to offenses committed while it was in force, and that the defendant should be executed in accordance with that statute. A fourth opinion was afterwards rendered, which settles the proposition that the controversy involved in the third opinion was properly before the Court. Defendant's counsel are now preparing an application to be made to the Supreme Court of the United States for a writ of error directed to the Supreme Court of this State to certify the record of the McNulty case in that Court, the defendant contending that he cannot be executed under the old law, and that the new execution law is in violation of the provisions of the Federal Constitution. If defendant's contention is sustained, the present laws providing for the execution of murderers would be wiped out, and the effect would be to liberate not only the defendant, but all convicted and unsentenced murderers who committed the crime of murder previous to the statute of March 30, 1891, and prevent the prosecution of all murderers whose crimes were committed prior to that date, and who are fugitives from the State of California. Book excerpt: Excerpt from Biennial Report of the Attorney General of the State of California: 1904-1906 Sir: I have the honor to transmit to you herewith my biennial report, made pursuant to the provisions of law in that behalf, covering the work of this office for the two years ending September 15, 1906. It will be observed that, up to the middle of April of the present year, the routine business of the department has shown a constant growth in volume, quite consistent with the growth of the State and its manifold material interests. Subsequent to the date mentioned, there has been a temporary lull in ordinary routine affairs, owing to the destruction of court records and the interruption of judicial and commercial functions throughout the State by the recent disastrous conflagration in San Francisco. These routine matters have, however, been more than compensated for, during the past six months, by the large number of matters of extraordinary character that have come before me, requiring the closest attention and application of every member of my office force. Without entering into detail, these matters may be summarized by a reference to the insurance situation; to the governmental questions arising from the long series of holidays necessarily proclaimed by your Excellency; to the confusion arising from lost or destroyed public records; ind to the duties attendant upon the special session of the Legislature called to pass laws to meet the abnormal conditions caused by the recent calamity. The division of the work of the office into three separate channels has been maintained, as far as possible, viz: into civil litigation, criminal appeals, and opinions. At the date of my last biennial report there were pending before this office one hundred and three civil cases; since that time one hundred and one new cases have been received, as against seventy-two cases for the previous two years; one hundred and six cases of civil litigation have been finally disposed of so far as the interests of the State arc-concerned, leaving now pending in the office ninety-seven civil cases. In addition to the formal report herewith transmitted, I beg to call attention to some of the more important civil matters that have come before me. This report shows that there is an ever-increasing amount of business coming before the office; that this business has been disposed of expeditiously and in a manner consistent with the best interests of the State, and that such matters as are now pending are being hastened to a determination as rapidly as the circumstances of each case will permit. The work of the office may be roughly divided into three separate departments; namely, civil litigation, criminal appeals, and opinions. At the date of the last biennial report of my able predecessor, there were pending before the office, in various stages, one hundred and one civil actions, exclusive of so-called "leave to sue" cases. Subsequent to that report there have come into the office seventy-two new cases, and my report now transmitted to you, shows one hundred and three civil eases now pending; in other words, there is constantly before and engaging the attention of the office at least one hundred civil suits. In addition to the detailed report appended hereto, I beg to make brief mention of a few of the more important civil matters which have claimed my attention. Civil Litigation. Coyote Scalp Cases. The Legislature of 1903 made appropriations to pay the judgments obtained against the State in suits commenced under the Act of March 23, 1901, such suits arising out of claims against the State under an Act of March 31, 1891, fixing a bounty on coyote scalps. Each of the Appropriation Acts, however, contained the proviso "that no warrant shall be drawn or paid unless, at the time such warrant is drawn, the said judgment shall be standing, not reversed or vacated, and there be no appeal pending therefrom."
